Comprehension:

  • What is a parapet? How can this be a metaphor for gun safety?
  • Why is a roof considered dangerous?
  • Who is responsible for the safety of guests? What might this tell us about gun safety?

רבי ינאי... דאמר לעולם אל יעמוד אדם במקום סכנה לומר שעושין לו נס שמא אין עושין לו נס

Rabbi Yannai... said: A person should never stand in a place of danger saying that they on High will perform a miracle for him, lest in the end they do not perform a miracle for him.

Comprehension:

  • Consider how this text works with the previous text about placing a fence on one's roof. What are they telling us about safety and preventative measures?

  • Do you think gun ownership is placing one’s self in danger? Why or why not?

(ח) כְּשֵׁם שֶׁאֵין מוֹכְרִין לְעוֹבֵד כּוֹכָבִים דְּבָרִים שֶׁמַּחֲזִיקִין בָּהֶן יְדֵיהֶן לַעֲבוֹדַת כּוֹכָבִים כָּךְ אֵין מוֹכְרִין לָהֶם דָּבָר שֶׁיֵּשׁ בּוֹ נֵזֶק לָרַבִּים כְּגוֹן דֻּבִּים וַאֲרָיוֹת וּכְלֵי זַיִן וּכְבָלִים וְשַׁלְשְׁלָאוֹת. וְאֵין מַשְׁחִיזִין לָהֶם אֶת הַזַּיִן. וְכָל שֶׁאָסוּר לְמָכְרוֹ לְעוֹבֵד כּוֹכָבִים אָסוּר לְמָכְרוֹ לְיִשְׂרָאֵל הֶחָשׁוּד לִמְכֹּר לְעוֹבֵד כּוֹכָבִים. וְכֵן אָסוּר לִמְכֹּר כְּלֵי נֵזֶק לְיִשְׂרָאֵל לִסְטִים:

(8) Even as it is forbidden to sell to idolaters things which uphold their hands to idolatry so it is forbidden to sell them things wherein there is a menace to the public, for instance, bears, lions, weapons, iron fetters, and chains; it is likewise forbidden to sharpen their weapons for them. And, everything which is forbidden to sell to an idolater is also forbidden to sell to an Israelite who is under suspicion that he might resell it to an idolater. It is likewise forbidden to sell instruments of harm to robbers who profess to be Israelites.

Comprehension:

  • Both of these texts advise us who we should and should not sell weapons to. Summarize who we should not sell weapons to and why not.
  • If we consider modern application, who might be “idolaters” in our society?
  • These texts warn us not to “sharpen/grind” weapons that are already owned by criminals/idolaters. What in our society might be similar to “sharpening” a weapon?
  • In the Mishneh Torah text, it says we cannot sell to someone who has the right to a weapon if they are suspected of selling it to someone who doesn’t have the right. Who might the players be in our modern society of gun sales?

Challenges to Grapple With:

  • Should reformed criminals in our country – who have already paid debt to society – be allowed to own guns? Why or why not?
  • Should those that sell guns to criminals who go on to commit a crime be held liable? Why or why not?
  • Who in our society should laws ban from owning guns?

(ה) הַרְבֵּה דְּבָרִים אָסְרוּ חֲכָמִים מִפְּנֵי שֶׁיֵּשׁ בָּהֶם סַכָּנַת נְפָשׁוֹת. וְכָל הָעוֹבֵר עֲלֵיהֶן וְאוֹמֵר הֲרֵינִי מְסַכֵּן בְּעַצְמִי וּמַה לַּאֲחֵרִים עָלַי בְּכָךְ אוֹ אֵינִי מַקְפִּיד בְּכָךְ מַכִּין אוֹתוֹ מַכַּת מַרְדּוּת:

(5) The sages have prohibited many things because they are dangerous to life. If anyone disregards them and says : "What claim have others on me if I risk my own life?" or: "I do not mind this," he should be lashed for disobedience.

Comprehension:

  • What does this text say about responsibility to others when we choose dangerous activity?
  • What does it mean to be “lashed?” To whom is the perpetrator being disobedient?

Challenges to Grapple With:

  • Is owning a gun dangerous? Why or why not? Is it dangerous to oneself? Is it dangerous to others? In what ways?
  • Do you think gun owners who don’t take precautions (gun training, gun lock boxes, etc) should be punished for unsafe practices?

(כח) וְכִֽי־יִגַּ֨ח שׁ֥וֹר אֶת־אִ֛ישׁ א֥וֹ אֶת־אִשָּׁ֖ה וָמֵ֑ת סָק֨וֹל יִסָּקֵ֜ל הַשּׁ֗וֹר... וּבַ֥עַל הַשּׁ֖וֹר נָקִֽי׃ (כט) וְאִ֡ם שׁוֹר֩ נַגָּ֨ח ה֜וּא מִתְּמֹ֣ל שִׁלְשֹׁ֗ם וְהוּעַ֤ד בִּבְעָלָיו֙ וְלֹ֣א יִשְׁמְרֶ֔נּוּ וְהֵמִ֥ית אִ֖ישׁ א֣וֹ אִשָּׁ֑ה הַשּׁוֹר֙ יִסָּקֵ֔ל וְגַם־בְּעָלָ֖יו יוּמָֽת׃

(28) When an ox gores a man or a woman to death, the ox shall be stoned... but the owner of the ox is not to be punished. (29) If, however, that ox has been in the habit of goring, and its owner, though warned, has failed to guard it, and it kills a man or a woman—the ox shall be stoned and its owner, too, shall be put to death.

Comprehension:

  • What is the law for an ox that killed one person? What about one that habitually kills?
  • How would you define "has been in the habit of goring?"
  • Why do you think the owner is punished in the second case?
  • How might these principles be adopted for gun control? What should a person's level of responsibility be to his/her weapons?

    1. Cultural role of weapons in society

    The next source, Mishnah Shabbat, discusses the prohibition on the Sabbath to carry objects in public. The text lists objects which one does not physically carry with one's hands but rather wears as an ornament explores whether this is considered 'carrying', and forbidden on the Sabbath, or 'wearing' and permitted. The focus of the text for this discussion is the opinion of the Sages.

    (ד) לֹא יֵצֵא הָאִישׁ לֹא בְסַיִף, וְלֹא בְקֶשֶׁת, וְלֹא בִתְרִיס, וְלֹא בְאַלָּה, וְלֹא בְרֹמַח. וְאִם יָצָא, חַיָּב חַטָּאת.. וַחֲכָמִים אוֹמְרִים, אֵינָן אֶלָּא לִגְנַאי, שֶׁנֶּאֱמַר (ישעיה ב) וְכִתְּתוּ חַרְבוֹתָם לְאִתִּים וַחֲנִיתוֹתֵיהֶם לְמַזְמֵרוֹת, לֹא יִשָּׂא גּוֹי אֶל גּוֹי חֶרֶב וְלֹא יִלְמְדוּ עוֹד מִלְחָמָה.

    (4) A man may not go out with a sword, bow, shield, club, or spear, and if he does go out, he incurs a sin-offering... But the sages say, they are nothing but a disgrace, as it is said, “And they shall beat their swords into plowshares, and their spears into pruning hooks: nation shall not lift up sword against nation, neither shall they learn war any more” (Isaiah 2:4).

    2. Self Defense

    The text from Rashi explains the law presented on the scenario in Exodus

    (א) אִם־בַּמַּחְתֶּ֛רֶת יִמָּצֵ֥א הַגַּנָּ֖ב וְהֻכָּ֣ה וָמֵ֑ת אֵ֥ין ל֖וֹ דָּמִֽים׃

    (1) If the thief is seized while tunneling [in order to steal from the homeowner], and he is beaten to death, there is no bloodguilt in his case [and the homeowner is not liable].

    אין לו דמים - כגון שאר כל האדם שניתן רשות לבעל הבית להורגו פטור מלשלם דחיוב מיתה וחיוב תשלומין באין כאחד ואע"פ שניצל פטור מן התשלומין דקי"ל (כתובות דף לה.) חייבי מיתות שוגגין כגון שלא התרו בהן אין משלמין ממון שעם המיתה אע"פ שאין נהרגין:

    He has no blood. [This signifies that] this is not [considered] murder. It is as though he [the thief] is [considered] dead from the start. Here the Torah teaches you: If someone comes to kill you, kill him first. And this one [the thief] has come to kill you, because he knows that a person will not hold himself back and remain silent when he sees people taking his money. Therefore, he [the thief] has come with the acknowledgement that if the homeowner were to stand up against him, he [the thief] would kill him [the owner].

    3. Power of God vs. power of weapons

    (ו) וַיַּ֜עַן וַיֹּ֤אמֶר אֵלַי֙ לֵאמֹ֔ר זֶ֚ה דְּבַר־ה' אֶל־זְרֻבָּבֶ֖ל לֵאמֹ֑ר לֹ֤א בְחַ֙יִל֙ וְלֹ֣א בְכֹ֔חַ כִּ֣י אִם־בְּרוּחִ֔י אָמַ֖ר ה' צְבָאֽוֹת׃

    (6) Then he explained to me as follows: “This is the word of the LORD to Zerubbabel: Not by might, nor by power, but by My spirit—said the LORD of Hosts.
