שְׁמַעְיָה אוֹמֵר, אֱהֹב אֶת הַמְּלָאכָה, וּשְׂנָא אֶת הָרַבָּנוּת, וְאַל תִּתְוַדַּע לָרָשׁוּת:
Shemayah says, "Love work, hate authority over others and do not become familiar with the government."
(ג) הֱווּ זְהִירִין בָּרָשׁוּת, שֶׁאֵין מְקָרְבִין לוֹ לָאָדָם אֶלָּא לְצֹרֶךְ עַצְמָן. נִרְאִין כְּאוֹהֲבִין בִּשְׁעַת הֲנָאָתָן, וְאֵין עוֹמְדִין לוֹ לָאָדָם בִּשְׁעַת דָּחְקוֹ:
(3) Be careful about the government, as they approach a man only when they need him. They seem like good friends in good times, but they don't stay for him in time of his trouble.
(ב) רַבִּי חֲנִינָא סְגַן הַכֹּהֲנִים אוֹמֵר, הֱוֵי מִתְפַּלֵּל בִּשְׁלוֹמָהּ שֶׁל מַלְכוּת, שֱׁאִלְמָלֵא מוֹרָאָהּ, אִישׁ אֶת רֵעֵהוּ חַיִּים בְּלָעוֹ.
(2) Rabbi Chanina, the Deputy High Priest, says: Pray for the welfare of the government, for were it not for the fear of it, man would swallow his fellow alive.
אמר רב יהודה אמר שמואל כל האמור בפרשת מלך מלך מותר בו רב אמר לא נאמרה פרשה זו אלא לאיים עליהם שנאמר (דברים יז, טו) שום תשים עליך מלך שתהא אימתו עליך
נודרין להרגין. ולחרמין. ולמוכסין. שהיא תרומה. אף על פי שאינה תרומה.
One may vow [in front of] murderers and thieves and [royal] tax collectors that [something] is terumah, even if it isn't terumah
MISHNA: One may not exchange larger coins for smaller ones from the trunk of customs collectors nor from the purse of tax collectors, and one may not take charity from them, as they are assumed to have obtained their funds illegally. But one may take money from the collector’s house or from money he has with him in the market that he did not take from his collection trunk or purse. GEMARA: It was taught in a baraita with regard to the prohibition against exchanging money from the trunk of a customs collector: But one may give the customs collector a dinar as payment for a debt that amounts to less than a dinar, and when the collector gives him change, he may accept it. It was taught in the mishna that one may not exchange money from the trunks of customs collectors, which are assumed to include stolen funds. The Gemara questions this ruling: But doesn’t Shmuel say that the law of the kingdom is the law, i.e., halakha requires Jews to obey the laws of the state in which they live. Accordingly, the customs are collected legally and it should be permitted to make use of the funds. The Gemara answers: Rabbi Ḥanina bar Kahana said that Shmuel says: The mishna is discussing a customs collector who does not have a limitation placed by the governor on the amount he may collect, and he collects as he pleases. Alternatively, the Sages of the school of Rabbi Yannai said: The mishna is discussing a customs collector who stands on his own, i.e., he was not appointed by the government but, on his own, he forces people to give him money.
והאמר שמואל דינא דמלכותא דינא אמר רב חיננא אמר רב כהנא אמר שמואל במוכס שאין לו קצבה דבי ר' ינאי אמר במוכס העומד מאליו:
Didn't Shmuel say: The law of the land is the law?
Rav Chinena said that Rav Kahana said that Shmuel said: [This Mishnah refers to] a tax collector who does not have a limit [on what he can tax].
The House of Rabbi Yannai said: [This Mishnah refers to] a self appointed tax collector.
כתב הרשב"א בתשובה לענין דינא דמלכות' דינא דע שלא אמרו אלא במאי דאיכא הורמנא דמלכא ובדברים שהם מדיני המלכות כי כמו שיש לנו משפטי מלוכה כמו שאמר שמואל לישראל (שמואל א ח) כך בשאר העכו"ם דינים ידועים יש למלכות ועליהם אמרו דדיניהם דין אבל דינים שדנים בערכאות אין אלו ממשפטי המלוכה אלא הערכאות דנין לעצמם כמו שימצאו בספרי הדיינים שאם אי אתה אומר כן בטלת ח"ו דיני ישראל עכ"ל. עיין במהרי"ק סי' ס"ו וקפ"א וקצ"ה בענין דינא דמלכותא ועיין בדברי רבינו סימן שס"ט:
כללו של דבר כל דין שיחקוק אותו המלך לכל ולא יהיה לאדם אחד בפני עצמו אינו גזל. וכל שיקח מאיש זה בלבד שלא כדת הידועה לכל אלא חמס את זה הרי זה גזל. ג לפיכך גבאי המלך ושוטריו שמוכרים השדות במס הקצוב על השדות ממכרן ממכר. אבל מס שעל כל איש ואיש אינו גובה אלא מן האדם עצמו ואם מכרו השדה במס שעל הראש הרי זה אינו ממכר אלא אם כן היה דין המלך כך.
The general principle is: Any law that a king decrees to be universally applicable, and not merely applying to one person, is not considered robbery. But whenever he takes from one person alone in a manner that does not conform to a known law, but rather seizes the property from the person arbitrarily, it is considered to be robbery.
Therefore, when the king's tax collectors and enforcement officers sell fields because the owner did not pay the fixed tax for the field, the sale is binding. A head tax, however, is the personal responsibility of each person and it may not be collected from his property. Thus, if a field was sold because an individual was delinquent in paying the head tax, the sale is not binding, unless this is the law enacted by this particular king.
ט אָדָם שֶׁחֶזְקָתָן גַּזְלָנִין וְחֶזְקַת כָּל מָמוֹנָן מִן הַגֵּזֶל מִפְּנֵי שֶׁמְּלַאכְתָּן מְלֶאכֶת גַּזְלָנִין כְּגוֹן הַמּוֹכְסִין וְהַלִּסְטִים אָסוּר לֵהָנוֹת מֵהֶן שֶׁחֶזְקַת מְלָאכָה זוֹ שֶׁהוּא גָּזוּל וְאֵין מִצְטָרְפִים דִּינָרִים מִן הַתֵּבָה שֶׁלָּהֶן שֶׁהַכּל בְּחֶזְקַת גְּזֵלָה:

יג וְכֵן מֶלֶךְ שֶׁכָּעַס עַל אֶחָד מֵעֲבָדָיו וְשַׁמָּשָׁיו מִבְּנֵי הַמְּדִינָה וְלָקַח שָׂדֵהוּ אוֹ חֲצֵרוֹ אֵינָהּ גֵּזֶל וּמֻתָּר לֵהָנוֹת בָּהּ וְהַלּוֹקְחָהּ מִן הַמֶּלֶךְ הֲרֵי הִיא שֶׁלּוֹ וְאֵין הַבְּעָלִים מוֹצִיאִין אוֹתָהּ מִיָּדוֹ. שֶׁזֶּה דִּין הַמְּלָכִים כֻּלָּם לִקַּח כָּל מָמוֹן שַׁמָּשֵׁיהֶם כְּשֶׁכּוֹעֲסִין עֲלֵיהֶם וַהֲרֵי הַמֶּלֶךְ הִפְקִיעַ שִׁעְבּוּדָן וְנַעֲשֵׂית חָצֵר זוֹ אוֹ שָׂדֶה זוֹ כְּהֶפְקֵר וְכָל הַקּוֹנֶה אוֹתָהּ מִן הַמֶּלֶךְ זָכָה בָּהּ. אֲבָל מֶלֶךְ שֶׁלָּקַח חָצֵר אוֹ שָׂדֶה שֶׁל אֶחָד מִבְּנֵי הַמְּדִינָה שֶׁלֹּא בַּדִּינִין שֶׁחָקַק הֲרֵי זֶה גַּזְלָן וְהַלּוֹקֵחַ מִמֶּנּוּ מוֹצִיאִין הַבְּעָלִים מִיָּדוֹ:
יד כְּלָלוֹ שֶׁל דָּבָר כָּל דִּין שֶׁיַּחְקֹק אוֹתוֹ הַמֶּלֶךְ לַכּל וְלֹא יִהְיֶה לְאָדָם אֶחָד בִּפְנֵי עַצְמוֹ אֵינוֹ גֵּזֶל. וְכָל שֶׁיִּקַּח מֵאִישׁ זֶה בִּלְבַד שֶׁלֹּא כַּדָּת הַיְדוּעָה לַכּל אֶלָּא חָמַס אֶת זֶה הֲרֵי זֶה גֵּזֶל. לְפִיכָךְ גַּבָּאֵי הַמֶּלֶךְ וְשׁוֹטְרָיו שֶׁמּוֹכְרִים הַשָּׂדוֹת בְּמַס הַקָּצוּב עַל הַשָּׂדוֹת מִמְכָּרָן מִמְכָּר. אֲבָל מַס שֶׁעַל כָּל אִישׁ וְאִישׁ אֵינוֹ גּוֹבֶה אֶלָּא מִן הָאָדָם עַצְמוֹ וְאִם מָכְרוּ הַשָּׂדֶה בְּמַס שֶׁעַל הָרֹאשׁ הֲרֵי זֶה אֵינוֹ מִמְכָּר אֶלָּא אִם כֵּן הָיָה דִּין הַמֶּלֶךְ כָּךְ:

יח בַּמֶּה דְּבָרִים אֲמוּרִים בְּמֶלֶךְ שֶׁמַּטְבְּעוֹ יוֹצֵא בְּאוֹתָן הָאֲרָצוֹת שֶׁהֲרֵי הִסְכִּימוּ עָלָיו בְּנֵי אוֹתָהּ הָאָרֶץ וְסָמְכָה דַּעְתָּן שֶׁהוּא אֲדוֹנֵיהֶם וְהֵם לוֹ עֲבָדִים. אֲבָל אִם אֵין מַטְבְּעוֹ יוֹצֵא הֲרֵי הוּא כְּגַזְלָן בַּעַל זְרוֹעַ וּכְמוֹ חֲבוּרַת לִסְטִים הַמְזֻיָּנִין שֶׁאֵין דִּינֵיהֶן דִּין וְכֵן מֶלֶ
...If the tax collectors took his cloak and returned to him a different one (took his donkey and returned a different donkey) - Behold, those [switched properties] are his because this is like a sale, and there is presumption of despairing of ownership by the [original] owners, and he does not know with certainty that this was stolen. And if he is established, and strict with himself, he returns [the things] to the original owners. ...
When is the previous case applicable? When the tax collector is like a robber, like when an idolater or the tax collector that is standing above him or the one sent by the king, and there is no limit, rather, he takes as much as he wants and gives [to the king] as much as he wants. But the tax established by the king, and is he said he should take a third or a fourth, or any amount with a limit. And [if] he appoints a Jew to collect this part for the king and it is known that this person is trustworthy, and he does not add anything over what the king has decreed, he is not under the assumption that he is a robber, since the law of the king is law. Not only that, but one who transgresses and smuggles from this tax is stealing from the king, whether the king is an idolater or a Jewish king. ...And so too a king who put a tax over the inhabitants of a city, or over each and every person, a predictable thing of every year; or over a field, something predictable. Or if he decreed that everyone who passes over this thing, all his possessions will be taken to the house of the king. Or that every person who is found in the field at the time of working the threshing floor will pay a tax whether he is or not the owner of the field - and all cases similar: this is not theft, and a Jew that is collecting those for the king is not under the assumption of being a thief, and he is a "kosher" person - provided that he does not add, nor change, nor get anything for himself. The general principle is: Any law that a king decrees to be universally applicable, and not merely applying to one person, is not considered robbery. But whenever he takes from one person alone in a manner that does not conform to a known law, but rather seizes the property from the person arbitrarily, it is considered to be robbery. Therefore, the king's dues collectors and his officers that sell fields with a defined tax on the fields, their sale is valid. But a personal tax is only collected from the person himself, and if they sold the field with a personal tax, behold this is not a valid sale unless the king has decreed that it is. [In the case of] a king who cut down trees belonging to individual property owners and made a bridge out of them, it is permissible to cross the bridge. So too if he destroyed homes to make a path or a wall, one is allowed to benefit from it. And so it is for all similar circumstances, for the king's law is the law. In what instances does this principle [the king's law is the law] apply? When the king's coins are accepted throughout those lands [under his control], for the residents of that country have agreed to him and have accepted that he is their master and they are to him as slaves. But if his coins do not circulate, he is like a robber by force and like a band of armed thieves whose laws are not enforced, and such a king and all his servants are considered thieves in all matters.
(יא) וכן מלך שגזר שכל מי שיתן מס הקצוב על האיש ישתעבד בזה שלא נתן ובא ישראל ונתן המס שעל ישראל זה העני הרי זה עובד בו יותר מדאי שדין המלך דין אבל אינו עובד בו כעבד: הגה: ישראל שהיה חייב לעכו"ם והעכו"ם מכר השטר לישראל אע"פ שאסור לדון עם ישראל חבירו בפני עכו"ם ואע"פ שבא מכח עכו"ם מ"מ דייני ישראל יפסקו לישראל זה מה שהיה העכו"ם מרויח לפני דייני עכו"ם הואיל וישראל זה בא מכחו הרי הוא כמוהו בכל מה שהיה יכול לזכות לפני דייני עכו"ם שהוא דינא דמלכותא (תשובת הרא"ש כלל י"ח סי' א' וכנ"ל ס"ס כ"ו) הנושא אשה במקום שדנין בדיני עכו"ם ומתה אשתו לא יוכל אבי אשתו או שאר יורשיה לומר כל הנושא אשה על דעת המנהג הוא נושא ונדון הדבר בדיני עכו"ם דאם מתה (לא) יורשה בעלה או כדומה לזה וליכא בזה משום דינא דמלכותא (ב"י בסי' כ"ו בשם תשובת הרשב"א) דלא אמרינן דינא דמלכותא אלא בדבר שיש בו הנאה למלך או שהוא לתקנת בני המדינה אבל לא שידונו בדיני עכו"ם דא"כ בטלו כל דיני ישראל (מהרי"ק שורש קפ"ח בשם רשב"א):
if a king decrees that whoever pays a head tax for a person who has not paid acquires the delinquent person as a servant the decree is binding. If one Jew comes and pays a head tax for another indigent, he may compel him to work beyond ordinary limits, for the laws of a king are binding. He may not, however, have him toil as a slave.
Gloss (from the Mappah): ...If a (man) marries a woman in a place in which rulings are (made) in the courts of non-Jews and his wife died, the father of his wife or the rest of her successors could not (claim the inheritance), which is to say, any man who marries a woman, who gets married under (non-Jewish) custom, and the matter is ruled through non-Jewish courts that if she died, her husband inherits it or something along these lines, there is no grounds to apply the concept of "the law of the land is the law," for we only apply "the law of the land is the law" in a matter that involves benefit for the king, or that is for a legal change for the members of the state, but not in the cases where non-Jewish courts make rulings, for if this were so, they would have nullified all the laws of Israel.
(ד) בני אדם שחזקתם גזלנים וחזקת כל ממונם גזל מפני שמלאכתם מלאכת גזלנים כגון המוכסים והליסטים אסור ליהנות מהם שחזקת מלאכה זו שהיא גזל ואין מצרפים דינרים מהתיבה שלהם שהכל בחזקת גזילה אבל ממה שיש לו בבית או בשוק שלא בתיב' המוכסים מותר לצרף ואפילו מתיבתו אם הוא חייב לתת לו חצי דינר ואין לו אלא דינר נותנו לו ולוקח ממנו חצי דינר אפילו מתיבת המוכסין מפני שהוא כמציל מידו:
(ו) בד"א שהמוכס כלסטים בזמן שהמוכס עכו"ם או מוכס העומד מאליו או מוכס העומד מחמת המלך ואין לו קצבה אלא לוקח מה שירצה אבל מוכס שפסקו המלך ליטול דבר קצוב (ואפי' צוה שישראל יתן יותר מעכו"ם מ"מ מקרי דבר קצוב לכל איש) (מהרי"ק שורש קנ"ה) והעמיד מוכס ישראל לגבותו למלך ונודע שאדם זה נאמן ואינו מוסיף כלום על מה שגזר המלך אינו בחזקת גזלן משום דדינא דמלכותא דינא ולא עוד אלא שהמבריח ממכס זה עובר (על לא תגזול) מפני שהוא גוזל מנת המלך בין שהיה מלך ישראל בין שהיה מלך עכו"ם וכן אם ישראל קנה המכס מהמלך המבריח עצמו הרי זה גוזל ישראל שקנאו (וי"א דאפי' ידוע דהישראל לוקח יותר מן הקצבה מ"מ אסור להבריח ממנו דבר הקצוב דהוי כגוזל מן הגזלן דאסור) (ב"י) אבל אם קנאו עכו"ם מותר משו' דהוי כהפקע' הלוואתו דשרי במקום דליכא חלול השם: הגה וי"א דאפי' המוכס ישראל אם לא קנאו לעצמו רק גובה למלך אע"ג דאסור להבריח מכח דינא דמלכותא מ"מ אם אדם מבריח אין למוכס לכוף אותו ליתן דהוי כהפקעת הלוואתו דשרי מיהו אם יש בזה משום יראת המלך ודאי יכול לכוף אותו (ר"ן פ"ד דנדרים):
(ז) וכן מלך ששם מס על בני העיר או על כל איש ואיש דבר קצוב משנה לשנה או על כל שדה ושדה דבר קצוב או שגזר שכל מי שיעבור על דבר זה ילקחו כל נכסיו לבית המלך או כל מי שימצא בשדה בשעת הגורן הוא יתן המס שעליה בין שהיה הוא בעל השדה בין שאינו בעל השדה וכל כיוצא בדברים אלו אינו גזל וישראל שגבה אותם למלך אינו בחזקת גזלן והרי הוא כשר והוא שלא יוסיף ולא ישנה ולא יקח לעצמו כלום:
(ח) וכן מלך שכעס על אחד מעבדיו ושמשיו מבני המדינה ולקח שדהו או חצירו אינו גזל ומותר ליהנות בה והלוקחה מהמלך הרי הוא שלו ואין הבעלים מוציאין אותה מידו (וכ"כ לעיל ס"ס רכ"ז) אבל מלך שלקח שדה או חצר של אחד מבני המדינה שלא בדינים שחקק הרי זה גזלן והלוקח ממנו מוציאין הבעלים מידו כללו של דבר כל דין שיחקוק אותו המלך לכל ולא יהיה לאדם אחד בפני עצמו אינו גזל וכל שיקח מאיש זה בלבד שלא כדת הידוע לכל אלא חמס את זה הרי זה גזל: הגה ואם חקק לבעל אומנות אחד כגון שחקק למלוה בריבית איזה דבר י"א דנא אמרי' ביה דינא דמלכותא דינא הואיל ואינו חקוק לכל (מהרי"ק שורש ס"ו) י"א דלא אמרינן דינא דמלכותא דינא אלא במסים ומכסים התלוים בקרקע כי המלך גוזר שלא ידורו בארנו כי אם בדרך זה אבל בשאר דברים לא (הרא"ש פ"ד דנדרים בשם הר"מ ומרדכי פ' הגוזל בתרא) וי"ח וסבירא להו דאמרי' בכל דבר דינא דמלכותא דינא (מרדכי שם בשם התוס' ות"ה סי' ש"ט) ולכן המלוה על המשכון יכול למכרו אחר שנה הואיל וכן דינא דמלכותא (שם בשם ר"י בר פרץ) וכן הוא עיקר וכמו שנתבאר לעיל סי' שנ"ו סעיף ז':
(כו) הָשִׁיבָה שׁוֹפְטֵינוּ כְּבָרִאשׁוֹנָה, וְיוֹעֲצֵינוּ כְּבַתְּחִלָּה. וְהָסֵר מִמֶּנוּ יָגוֹן וַאֲנָחָה, וּמְלֹךְ עָלֵינוּ אַתָּה יְהֹוָה לְבַדְּךָ, בְּחֶסֶד וּבְרַחֲמִים, בְּצֶדֶק וּבְמִשְׁפָּט. בָּרוּךְ אַתָּה יְהֹוָה, מֶלֶךְ אוֹהֵב צְדָקָה וּמִשְׁפָּט:
