The dispute between the Rabbis and Rabbi Yehuda with regard to the times beyond which the different prayers may not be recited is rooted in a profound disagreement, also manifest in a later amoraic dispute. It was stated: Rabbi Yosei, son of Rabbi Ḥanina, said: The practice of praying three times daily is ancient, albeit not in its present form; prayers were instituted by the Patriarchs. However, Rabbi Yehoshua ben Levi said that the prayers were instituted based on the daily offerings sacrificed in the Holy Temple, and the prayers parallel the offerings, in terms of both time and characteristics. The Gemara comments: It was taught in a baraita in accordance with the opinion of Rabbi Yosei, son of Rabbi Ḥanina, and it was taught in a baraita in accordance with the opinion of Rabbi Yehoshua ben Levi. The Gemara elaborates: It was taught in a baraita in accordance with the opinion of Rabbi Yosei, son of Rabbi Ḥanina: Abraham instituted the morning prayer, as it is stated when Abraham came to look out over Sodom the day after he had prayed on its behalf: “And Abraham rose early in the morning to the place where he had stood before the Lord” (Genesis 19:27), and from the context as well as the language utilized in the verse, the verb standing means nothing other than prayer, as this language is used to describe Pinehas’ prayer after the plague, as it is stated: “And Pinehas stood up and prayed and the plague ended” (Psalms 106:30). Clearly, Abraham was accustomed to stand in prayer in the morning. Isaac instituted the afternoon prayer, as it is stated: “And Isaac went out to converse [lasuaḥ] in the field toward evening” (Genesis 24:63), and conversation means nothing other than prayer, as it is stated: “A prayer of the afflicted when he is faint and pours out his complaint [siḥo] before the Lord” (Psalms 102:1). Obviously, Isaac was the first to pray as evening approached, at the time of the afternoon prayer. Jacob instituted the evening prayer, as it is stated: “And he encountered [vayifga] the place and he slept there for the sun had set” (Genesis 28:11). The word encounter means nothing other than prayer, as it is stated when God spoke to Jeremiah: “And you, do not pray on behalf of this nation and do not raise on their behalf song and prayer, and do not encounter [tifga] Me for I do not hear you” (Jeremiah 7:16). Jacob prayed during the evening, after the sun had set.

(א) ויצא יצחק לשוח בשדה. כבר פירשו חז״ל שהוא הי׳ מתפלל מנחה. וע״כ אין הפי׳ בשדה כמשמעו שהרי אסור להתפלל בשדה כדאי׳ בברכות ספ״ה חציף עלי מאן דמצלי בביקתא. אלא כדאי׳ במס׳ פסחים ר״פ האשה דבשדה היינו הר המוריה שקראו שדה וכ״כ התוס׳ שם וכמש״כ לעיל י״ב י״ז דבשביל שמדת יצחק הי׳ עבודה שהוא שורש לפרנסה ע״כ קרא אותו מקום שהוא שער השמים שדה המסוגל לפרנסה. ואין הכונה שהי׳ יצחק עומד אז בהר המוריה אלא הוא התפלל תחת אילן וכדומה ועינו ולבו היו לצד הר המוריה שנקרא שדה והתפלל אז על הפרנסה שבכלל זה הוא השגת אשה שהיא צרכי האדם ונקראת ג״כ פרנסה כלשון הגמ׳ פרנסת נשואין. והזמין ה׳ לפניו באותה שעה את אשתו וזהו וישא עיניו וגו׳:

(א) מִצְוַת עֲשֵׂה לְהִתְפַּלֵּל בְּכָל יוֹם שֶׁנֶּאֱמַר (שמות כג כה) ״וַעֲבַדְתֶּם אֵת ה׳ אֱלֹהֵיכֶם״. מִפִּי הַשְּׁמוּעָה לָמְדוּ שֶׁעֲבוֹדָה זוֹ הִיא תְּפִלָּה שֶׁנֶּאֱמַר (דברים יא יג) ״וּלְעָבְדוֹ בְּכָל לְבַבְכֶם״ אָמְרוּ חֲכָמִים אֵי זוֹ הִיא עֲבוֹדָה שֶׁבַּלֵּב זוֹ תְּפִלָּה. וְאֵין מִנְיַן הַתְּפִלּוֹת מִן הַתּוֹרָה. וְאֵין מִשְׁנֶה הַתְּפִלָּה הַזֹּאת מִן הַתּוֹרָה. וְאֵין לַתְּפִלָּה זְמַן קָבוּעַ מִן הַתּוֹרָה:
(1) It is a positive commandment to pray every day, as it is written: "You shall worship the Lord your God" (Ex. 23:25). By tradition, they learned that this worship is prayer, as it says: "and to worship God with all of your heart" (Deut. 11:13)—the sages said what is worship of the heart? This is prayer. The number of prayers is not biblical, the form of prayer is not biblical, and prayer has no biblically fixed time.
(ב) וּלְפִיכָךְ נָשִׁים וַעֲבָדִים חַיָּבִין בִּתְפִלָּה לְפִי שֶׁהִיא מִצְוַת עֲשֵׂה שֶׁלֹּא הַזְּמַן גְּרָמָא אֶלָּא חִיּוּב מִצְוָה זוֹ כָּךְ הוּא שֶׁיְּהֵא אָדָם מִתְחַנֵּן וּמִתְפַּלֵּל בְּכָל יוֹם וּמַגִּיד שִׁבְחוֹ שֶׁל הַקָּדוֹשׁ בָּרוּךְ הוּא וְאַחַר כָּךְ שׁוֹאֵל צְרָכָיו שֶׁהוּא צָרִיךְ לָהֶם בְּבַקָּשָׁה וּבִתְחִנָּה וְאַחַר כָּךְ נוֹתֵן שֶׁבַח וְהוֹדָיָה לַה׳ עַל הַטּוֹבָה שֶׁהִשְׁפִּיעַ לוֹ כָּל אֶחָד לְפִי כֹּחוֹ:
(2) Therefore, women and slaves are obligated in prayer because it is a positive commandment lacking a fixed time, but the obligation of this commandment is as follows: a person should supplicate and pray every day and relate the praise of God, and afterwards ask for their needs as a request and a supplication, and afterwards give praise and thanks to God for the good that has been bestowed upon them, each person according to their ability.
(פט) ונראה לעניות דעתי דאפילו להרמב"ן אין הכוונה דעיקר חיובו דרבנן, ומן התורה ליכא חיוב כלל להתפלל. דאין זה סברא כלל. אלא שאומר דאין זה נחשב במנין המצות, ודינה ככל דיני דרבנן דספיקן לקולא. וזה אצלי כמו שכתב הרמב"ן עצמו על שבותי שבת, דזה דקיימא לן דמקח וממכר בשבת דרבנן, אין הכוונה דמן התורה מותר לישב בחנות בשבת, דאם כן אין זה שבת. והרי נחמיה צעק על זה שמחללין את השבת. אלא הכוונה דוודאי האיסור מן התורה, אלא שאינה נכנסת בסוגי המלאכות שיהא חייב על זה סקילה. אבל האיסור הוא מן התורה. כן כתב הריטב"א בשם הרמב"ן.
(ב) בָּרוּךְ אַתָּה ה' אֱלהֵינוּ וֵאלהֵי אֲבותֵינוּ. אֱלהֵי אַבְרָהָם. אֱלהֵי יִצְחָק. וֵאלהֵי יַעֲקב. הָאֵל הַגָּדול הַגִּבּור וְהַנּורָא אֵל עֶלְיון. גּומֵל חֲסָדִים טובִים. וְקונֵה הַכּל. וְזוכֵר חַסְדֵּי אָבות. וּמֵבִיא גואֵל לִבְנֵי בְנֵיהֶם לְמַעַן שְׁמו בְּאַהֲבָה:
(2) Blessed are You, Lord our God and God of our fathers, God of Abraham, God of Isaac and God of Jacob; the great, mighty and awesome God, the most high God, Who bestows loving kindness and goodness and is master/creator of all, Who remembers the good deeds of the fathers, and brings a redeemer to their children, in love and for the sake of His name.
