Drunken Prayer
מֵיתִיבִי: שִׁיכּוֹר מִקָּחוֹ מִקָּח, וּמִמְכָּרוֹ מִמְכָּר. עָבַר עֲבֵירָה שֶׁיֵּשׁ בָּהּ מִיתָה — מְמִיתִין אוֹתוֹ, מַלְקוֹת — מַלְקִין אוֹתוֹ. כְּלָלוֹ שֶׁל דָּבָר: הֲרֵי הוּא כְּפִיקֵּחַ לְכׇל דְּבָרָיו, אֶלָּא שֶׁפָּטוּר מִן הַתְּפִלָּה.
With regard to one who is intoxicated, his acquisition is a binding acquisition; and similarly, his sale is a binding sale. Moreover, if he committed a transgression for which he is liable to receive the death penalty, he is executed; and if the offense is punishable by lashes, he is flogged. The principle is: he is like a sober person in all matters, except that he is exempt from prayer.
(א) דין שתוי ושכור לתפלה. ובו ג סעיפים:שתה יין כדי רביעית אל יתפלל עד שיסיר יינו ואם שתה יותר אם הוא יכול לדבר לפני המלך אם התפלל תפלתו תפלה ואם אינו יכול לדבר לפני המלך אם התפלל תפלתו תועבה וצריך לחזור ולהתפלל כשיסיר יינו מעליו ואפי' אם עבר זמן התפלה משלים אותה בתפלה שאחריה כדין שוגג: הגה ודין ק"ש כדין תפלה אבל שאר ברכות יכול לברך אע"פ שהוא שכור (מרדכי ריש פ' הדר הגה' מה'' פ"ד מהלכות תפלה):
The Laws of One Who is Tipsy and One Who Is Drunk in [Regards to] Prayers
1. If one drank a revi'it of wine, he may not pray the Amidah prayer until the effects of the wine pass.
2. And if he drank more than a revi'it: if he is able to speak before a king, if he prayed, his prayer is considered a prayer;
3. and if he is not able to speak before a king, and he prayed, his prayer is an abomination and he is required to pray again when the effects of the wine passes from him. And even if the time of prayer passed, he should make it up in the prayer that follows, in accordance with the law of one who could not pray because he had an extenuating circumstance.
(ג) אל יתפלל - ואפילו אם עי"ז יעבור זמן תפלה פר"ח. ועיין בסוף הסימן בשם הים של שלמה דעכשיו שבלא"ה אין מכונין כ"כ בתפלה אין לחוש כ"כ להחמיר אם ע"י המתנתו יעבור זמן תפלה:
Should not pray - according to the book Yam Shel Shlomo, nowadays when we never have so much kavvanah anyway, we shouldn't be so strict about this if by waiting we would miss the proper time for prayer.
(יא) שהוא שכור - עיין בביאור הגר"א ולפי דבריו יש להחמיר לכתחילה בשיכור שאינו יכול לדבר לפני המלך אף בשאר ברכות וכ"כ הפמ"ג יו"ד סימן א' ס"ק ל"ה במשבצות זהב וכ"ז כשלא הגיע לשכרותו של לוט דאל"ה כשוטה יחשב לגמרי לכו"ע ופטור אז מכל המצות ע"כ אפילו בדיעבד אם קרא אז ובירך לא מיפטר בכך שהרי פטור היה באותה שעה וחייב אח"כ לחזור ולקרות ולברך. פר"ח ופמ"ג:
All this discussion is in the case of one who did not arrive at the drunken state of Lot, since one who reached this level of drunkenness is like a shoteh, a mentally incapable person, and can certainly not be obligated in anything, and any blessings that they say are invalid and need to be repeated.
Speech and Golems
וַיִּ֩יצֶר֩ ה' אֱלֹקִ֜ים אֶת־הָֽאָדָ֗ם עָפָר֙ מִן־הָ֣אֲדָמָ֔ה וַיִּפַּ֥ח בְּאַפָּ֖יו נִשְׁמַ֣ת חַיִּ֑ים וַֽיְהִ֥י הָֽאָדָ֖ם לְנֶ֥פֶשׁ חַיָּֽה׃
the LORD God formed man from the dust of the earth. He blew into his nostrils the breath of life, and man became a living being.
וּבְרָא ה' אֱלֹקִים יָת אָדָם עַפְרָא מִן אַדְמְתָא וּנְפַח בְּאַפּוֹהִי נִשְׁמְתָא דְחַיֵּי וַהֲוַת בְּאָדָם לְרוּחַ מְמַלְלָא:
And the Lord God created man, dirt from the ground, and He blew into his nostrils a living soul, and it was for a speaking spirit in man.
רבא ברא גברא שדריה לקמיה דר' זירא הוה קא משתעי בהדיה ולא הוה קא מהדר ליה אמר ליה מן חבריא את הדר לעפריך
Indeed, Rava created a man, a golem, using forces of sanctity. Rava sent his creation before Rabbi Zeira. Rabbi Zeira would speak to him but he would not reply. Rabbi Zeira said to him: You were created by one of the members of the group, one of the Sages. Return to your dust.
שו"ת חכם צבי צ"ג
ונראה לי דכיון דאשכתן לרבי זירא דאמר ’מן הברייא את תוב לעפרך׳׳ הרי שהרגו ואי ס׳ד שיש בו תועלד לצרפו לעשרה לכל דבר שבקדושה לא היה רבי זירא מעבירו מן העולם דאף שאין בו איסור שפיכת דמים דהכי דייק קרא (אף שיש בו דרשור אחרות) שופך דם האדם באדם דמו ישפך׳׳ דוקא אדם הנוצר תוך אדם דהיינו עובר הנוצר מעי אמו הוא דחייב עלי׳ משום שפיכת יצא ההוא גברא דברא רבא שלא נעשה במעי אשה. מ׳׳מ כיון שיש בו תועלת לא היה לו להעבירו מן העולם אלא ודאי שאינו מצטרף לעשרה לכל דבר שבקדושה כך נ׳׳ל.
Responsa Chacham Tzvi 93
It seems to me that since R. Zeira killed it, saying, "Creature, return to the dust" and thus killing him -- if you thought that it could participate in the ten for things that require Keduasha, then R. Zeira would not have removed it from this world. Even though there is not a prohibition of "spilling blood", since the Torah states "Whoever sheds the blood of man, By man shall his blood be shed;"--specifically a person created by a person, i.e. only a person that is born from his mother's womb would qualify as "spilling blood", the being here was created by Rava and not from the womb of a woman. In any case, since it has utility [i.e. it could count in the minyan] he would not have removed him from this world; thus, since he did remove him, we learn that certainly it would not be counted in the minyan for things that are holy.
ליל ג' פרשת בא ב' שבט. חלם לי על מה שאמרו סנהדרין (סה ב') אמר לו תוב לעפרך דדקדק מזה בתשובות חכם צבי (סימן צג) שאין בו תועלת לצרפו לדבר שבקדושה. אין מוכרח דיש לומר דהיה ירא שלא יהיה נעשה מזיק לבריות כשיגדל קצת ואז אפילו העושהו יהיה קשה לו גם כן להחזירו לעפרו כי יוכל להזיק גם לו וכמו שסיפר בשאילת יעב"ץ חלק ב' (סימן פב) מאותו הנוצר על ידי זקינו מה"ר אליהו בעל שם. ועל כן אין להשהות בריה כזה אלא לבראו לצורך הדבר שצריך לו.... ובעיקר דינו דהחכם צבי נראה לי דחידוש הנזכר טובה. ובחלומי היה נראה לי פשוט הדין דלא כותיה ודחזי לדבר שבקדושה. ונראה דאפשר לקיים זה ומה שכתב בשאילת יעב"ץ שם דלא עדיף מחרש שאינו שומע ואינו מדבר וכן הוא בברכי יוסף או"ח סימן נ"ה. אין מוכרח דחרש לאו בר דעת הוא כמו קטן דאדם נוצר בלא דעת רק כשגדל בא לו הדעת וזה שאינו שומע ואינו מדבר אם הוא בתולדה לפי שאין למד דעת מבני אדם ואם נתחרש אחר כך הוא לפי שנולד בו חסרון במוח אין בו דעת אבל זה שנוצר בקומתו כאדם גדול יש לומר דיש בו גם כן דעת כבגדול ואף על פי שאינו שומע ואינו מדבר יש לומר דאינו מחסרון במוחו ודעתו ושלא יהיה בו דעת. ואף שכתב בחסד לאברהם עין יעקב נהר ל' דאין לו נשמה ורוח ממללא רק רוח הבהמית ועל כן מותר להרגו כבהמה עיין שם וכן הוא במהרש"א בחלק א' בסנהדרין שם אלא דיש לומר מטעם אחר דהא מכל מקום לאו בר חיוב מצות הוא ואם כן אפילו תאמר דקרינן ביה בני ישראל מטעמו דהחכם צבי שם דהוא מעשה ידיו של צדיק מכל מקום נראה דאין להטיל עליו חובת מצות מטעם זה ולומר דכל מה שכתוב בתורה דבר אל בני ישראל יהיה גם הוא בכלל כיון דאין בו נשמת חיים והשארת נפש לעולם הבא לשכר לעונש ואם כן איך נצרפו לדבר שבקדושה כיון דהוא לאו בר חיובא. ואפשר לומר מכל מקום לענין עשרה לברכת המזון אם יכול לאכול דמצרפין קטן מצרפין גם אותו ואפשר דגם כן יודע למי מברכין וצריך ביאור ואין כאן מקומו להאריך יותר].
On Tuesday night, the second of Shevat, I dreamed about the statement of Rabbi Zeira in the Talmud, who forced the Golem to go back to the dust. It was on this account that the Chacham Zvi deduced that the golem has no value and cannot be included in a minyan. I think this deduction is not valid. We can suppose that the golem was dangerous to its surroundings and had to be destroyed in order that it not harm anybody, as was the case of the golem created by the Baal Shem of Chelm. This was the reason it was destroyed, and not because it was invalid for a minyan...
In my dream it seemed that the Chacham Zvi had erred, and that the golem could have been in the minyan. This fits the opinion written by Yaakov Emden, that the golem should have the same status as a deaf-mute. A deaf person is not void of understanding like a baby, because one is born without understanding but gains it as they grow. It could be that a deaf person lacks understanding because they were not able to be taught or had a disability as they grew up. But this golem is not so, it was created as an adult and we can assume it has the intellectual capacity of an adult.
The Chesed Le'Avraham wrote that the golem lacks a speaking soul, but there are problems with this approach....
Nonetheless, the golem is not obligated in commandments and cannot be part of the minyan for prayer. Even if it has some status, as 'adopted' by a righteous Jew who created it, since it has no eternal soul and no reward and punishment, it can't be brought together into a holy community for prayer. However, perhaps it could count as one of the ten needed to say the blessing after meals, like a child who is sometimes included in this, since it also knows to whom one is blessing. But there is no room here to continue this thought.
