דאיתמר דברים רב אמר אין בהן משום מחוסרי אמנה ורבי יוחנן אמר יש בהם משום מחוסרי אמנה מיתיבי רבי יוסי ברבי יהודה אומר מה תלמוד לומר (ויקרא יט, לו) הין צדק והלא הין בכלל איפה היה אלא לומר לך שיהא הן שלך צדק ולאו שלך צדק
The Gemara comments: This is as it was stated: There is an amoraic dispute with regard to reneging on a verbal commitment that was unaccompanied by an act of acquisition. Rav says: It does not constitute an act of bad faith. And Rabbi Yoḥanan says: It constitutes an act of bad faith. The Gemara raises an objection: Rabbi Yosei, son of Rabbi Yehuda, says: What is the meaning when the verse states: “A just ephah, and a just hin, shall you have” (Leviticus 19:36)? But wasn’t a hin included in an ephah? Why is it necessary to state both? Rather, this is an allusion that serves to say to you that your yes [hen] should be just, and your no should be just. Apparently, it is a mitzva for one to fulfill his promises. Abaye says: That verse means that one should not say one matter with his mouth and think one other matter in his heart. It is prohibited for one to make a commitment that he has no intention of fulfilling. Rav Kahana made his commitment in good faith and reneged due to changed circumstances. That is not prohibited.
(א) מי שנתן דמים ולא משך המטלטלים אף ע"פ שלא נקנו לו המטלטלים כמו שנתבאר כל החוזר בו בין לוקח בין מוכר לא עשה מעש' ישראל וחייב לקבל מי שפרע ואפי' לא נתן אלא מקצת הדמים:
(ז) הנושא ונותן בדברים בלבד ה"ז ראוי לו לעמוד בדבורו אע"פ שלא לקח מהדמים כלום ולא רשם ולא הניח משכון וכל החוזר בו בין לוקח בין מוכר אע"פ שאינו חייב לקבל מי שפרע ה"ז ממחוסרי אמנה ואין רוח חכמים נוחה הימנו:
(יא) : הגה אע"פ שבדברים בלא מעות יכול לחזור בו וא"צ לקבל עליו מי שפרע מ"מ ראוי לאדם לעמוד בדיבורו אע"פ שלא עשה שום קנין רק דברים בעלמא וכל החוזר בו בין לוקח בין מוכר אין רוח חכמים נוחה הימנו והני מילי בחד תרעי אבל בתרי תרעי אין זה ממחוסרי אמנה וכל האומר לתת לחבירו מתנה מועטת ולא נתנה לו הרי זה ממחוסרי אמנה (הכל בטור) וע' לקמן סי' רמ"ט וי"א דאפילו בתרי תרעי אסור לחזור ואם חזר בו יש בו משום מחוסרי אמנה (נ"י פ' הזהב והמגיד פ"ו דמכירה וב"י בשם תוס' ור' ירוחם נ"ט ח"ד) וכן נראה עיקר:
הנושא אשה ופסקה עמו לזון את בתה ה' שנים חייב לזונה במאכל ובמשקה ה' שנים הראשונים שאחר הנישואין בין אם המזונות ביוקר או בזול
(1) If a man married a woman and agreed that he would feed her daughter for five years, he must provide food and drink for the first five years of the marriage, whether food prices are high or low. If he did not feed her during those years, and food prices dropped - if he had withheld [the food] he must pay her according to the higher prices., but if she prevented him [from providing the food], he only pays her according to the lower prices. If food prices rose, even if he had withheld the food, he only pays according to the lower prices.
