לכן כליותי יעצוני וגם לבי מלאני, מזקנים אתבונן סותמי משנה, לבל אקח אחריהם בשנה, לכסות מוצא הדברים מחדל להשמיעם יחד, מלהדר מקטן גדול, פן תהיה חכמת מסכנים בזויה, ודברת העשיר לפני גדולים נחויה, כי דברי חכמת חכמים המה יחד, אמת, נתנו מרועה אחד

...So my viscera counseled me,
Learn from the Ancients who rendered the Mishna anonymous,
And follow their lead without shame,
To obscure the source of ideas,
To refrain from linking a name to an opinion, and
Glorifying the greater over the so-called lesser.
Lest the wisdom of the lowly be shunned,
While the words of the prominent hold sway.
For my words are bound in the wisdom of the wise
In truth, they derive from a single Shepherd...
וַיִּכְתֹּב מֹשֶׁה, אֵת כָּל-דִּבְרֵי יקוק. מִבְּרֵאשִׁית וְעַד מַתַּן תּוֹרָה, וְכָתַב מִצְווֹת שֶׁנִּצְטַוּוּ בְמָרָה:
ויכתב משה — from בראשית up to the account of the Giving of the Torah, and he wrote down the commandments that were given to them in Marah (Mekhilta, Exod. 19:10).
(א) את כל אשר דבר ה׳ אתו בהר סיני כל המצות שנאמרו במ׳ יום ראשונים ובמ׳ יום אחרונים. וכל המצוות שנצטוו ישראל נאמרו מניסן, שבו יצאו ישראל ממצרים, עד עשרים באייר בשנה השנית. אבל התורה מגלה נתנה שלפי שהיה משה שומע המצות מפי הקב״ה היה כותב כל אחת ואחת במגלתה לעצמה, וכשבא ליפטר מן העולם סידר ספר תורה וקבע בו הפרשיות עד היום הזה לפי הסמוכין הראויין להם כמו שדרשו רבותינו.
(1) את כל אשר דבר ה' אתו בהר סיני, “This encompasses all the commandments that G-d had spoken to him during the first 40 days on Mt. Sinai and the last 40 days, as well as all the commandments that were commanded from Nissan when they had left Egypt until the twentieth of Iyar in the second year. However, the written Torah was given in scroll form, he wrote down personally, when he heard each commandment, one parchment at a time. At the end of his life, Moses arranged these parchments in the order in which we read them nowadays with the appropriate orders and juxtapositions, as our rabbis interpret.
א"ר יוחנן משום רבי בנאה: תורה מגילה מגילה ניתנה שנא' (תהלים מ, ח) אז אמרתי הנה באתי במגילת ספר כתוב עלי ר"ש בן לקיש אומר תורה חתומה ניתנה שנאמר (דברים לא, כו) לקוח את ספר התורה הזאת
Rabbi Yoḥanan says in the name of Rabbi Bana’a: The Torah was given from the outset scroll by scroll, as it is stated: “Then I said, behold, I come with the scroll of the book that is written for me” (Psalms 40:8). Rabbi Shimon ben Lakish says: The Torah was given as a complete book, as it is stated: “Take this scroll of the Torah” (Deut. 31:26).
(א) וְאֵ֙לֶּה֙ הַמִּשְׁפָּטִ֔ים אֲשֶׁ֥ר תָּשִׂ֖ים לִפְנֵיהֶֽם׃ (ב) כִּ֤י תִקְנֶה֙ עֶ֣בֶד עִבְרִ֔י שֵׁ֥שׁ שָׁנִ֖ים יַעֲבֹ֑ד וּבַ֨שְּׁבִעִ֔ת יֵצֵ֥א לַֽחָפְשִׁ֖י חִנָּֽם׃

(ז) וְכִֽי־יִמְכֹּ֥ר אִ֛ישׁ אֶת־בִּתּ֖וֹ לְאָמָ֑ה לֹ֥א תֵצֵ֖א כְּצֵ֥את הָעֲבָדִֽים׃ (ח) אִם־רָעָ֞ה בְּעֵינֵ֧י אֲדֹנֶ֛יהָ אֲשֶׁר־לא [ל֥וֹ] יְעָדָ֖הּ וְהֶפְדָּ֑הּ לְעַ֥ם נָכְרִ֛י לֹא־יִמְשֹׁ֥ל לְמָכְרָ֖הּ בְּבִגְדוֹ־בָֽהּ׃ (ט) וְאִם־לִבְנ֖וֹ יִֽיעָדֶ֑נָּה כְּמִשְׁפַּ֥ט הַבָּנ֖וֹת יַעֲשֶׂה־לָּֽהּ׃
(1) These are the rules that you shall set before them: (2) When you acquire a Hebrew slave, he shall serve six years; in the seventh year he shall go free, without payment.

(7) When a man sells his daughter as a slave, she shall not be freed as male slaves are. (8) If she proves to be displeasing to her master, who designated her for himself, he must let her be redeemed; he shall not have the right to sell her to outsiders, since he broke faith with her. (9) And if he designated her for his son, he shall deal with her as is the practice with free maidens.
(כ) וְגֵ֥ר לֹא־תוֹנֶ֖ה וְלֹ֣א תִלְחָצֶ֑נּוּ כִּֽי־גֵרִ֥ים הֱיִיתֶ֖ם בְּאֶ֥רֶץ מִצְרָֽיִם׃ (כא) כָּל־אַלְמָנָ֥ה וְיָת֖וֹם לֹ֥א תְעַנּֽוּן׃ (כב) אִם־עַנֵּ֥ה תְעַנֶּ֖ה אֹת֑וֹ כִּ֣י אִם־צָעֹ֤ק יִצְעַק֙ אֵלַ֔י שָׁמֹ֥עַ אֶשְׁמַ֖ע צַעֲקָתֽוֹ׃ (כג) וְחָרָ֣ה אַפִּ֔י וְהָרַגְתִּ֥י אֶתְכֶ֖ם בֶּחָ֑רֶב וְהָי֤וּ נְשֵׁיכֶם֙ אַלְמָנ֔וֹת וּבְנֵיכֶ֖ם יְתֹמִֽים׃

(כ) וַיֹּ֣אמֶר יקוק זַעֲקַ֛ת סְדֹ֥ם וַעֲמֹרָ֖ה כִּי־רָ֑בָּה וְחַ֨טָּאתָ֔ם כִּ֥י כָבְדָ֖ה מְאֹֽד׃ (כא) אֵֽרֲדָה־נָּ֣א וְאֶרְאֶ֔ה הַכְּצַעֲקָתָ֛הּ הַבָּ֥אָה אֵלַ֖י עָשׂ֣וּ ׀ כָּלָ֑ה וְאִם־לֹ֖א אֵדָֽעָה׃

(ז) וְחֵ֣יל מֶֽלֶךְ־בָּבֶ֗ל נִלְחָמִים֙ עַל־יְר֣וּשָׁלִַ֔ם וְעַ֛ל כָּל־עָרֵ֥י יְהוּדָ֖ה הַנּֽוֹתָר֑וֹת אֶל־לָכִישׁ֙ וְאֶל־עֲזֵקָ֔ה כִּ֣י הֵ֗נָּה נִשְׁאֲר֛וּ בְּעָרֵ֥י יְהוּדָ֖ה עָרֵ֥י מִבְצָֽר׃ (פ) (ח) הַדָּבָ֛ר אֲשֶׁר־הָיָ֥ה אֶֽל־יִרְמְיָ֖הוּ מֵאֵ֣ת יקוק אַחֲרֵ֡י כְּרֹת֩ הַמֶּ֨לֶךְ צִדְקִיָּ֜הוּ בְּרִ֗ית אֶת־כָּל־הָעָם֙ אֲשֶׁ֣ר בִּירֽוּשָׁלִַ֔ם לִקְרֹ֥א לָהֶ֖ם דְּרֽוֹר׃ (ט) לְ֠שַׁלַּח אִ֣ישׁ אֶת־עַבְדּ֞וֹ וְאִ֧ישׁ אֶת־שִׁפְחָת֛וֹ הָעִבְרִ֥י וְהָעִבְרִיָּ֖ה חָפְשִׁ֑ים לְבִלְתִּ֧י עֲבָד־בָּ֛ם בִּיהוּדִ֥י אָחִ֖יהוּ אִֽישׁ׃
(ה) וְעַתָּ֗ה כִּבְשַׂ֤ר אַחֵ֙ינוּ֙ בְּשָׂרֵ֔נוּ כִּבְנֵיהֶ֖ם בָּנֵ֑ינוּ וְהִנֵּ֣ה אֲנַ֣חְנוּ כֹ֠בְשִׁים אֶת־בָּנֵ֨ינוּ וְאֶת־בְּנֹתֵ֜ינוּ לַעֲבָדִ֗ים וְיֵ֨שׁ מִבְּנֹתֵ֤ינוּ נִכְבָּשׁוֹת֙ וְאֵ֣ין לְאֵ֣ל יָדֵ֔נוּ וּשְׂדֹתֵ֥ינוּ וּכְרָמֵ֖ינוּ לַאֲחֵרִֽים׃ (ו) וַיִּ֥חַר לִ֖י מְאֹ֑ד כַּאֲשֶׁ֤ר שָׁמַ֙עְתִּי֙ אֶת־זַֽעֲקָתָ֔ם וְאֵ֖ת הַדְּבָרִ֥ים הָאֵֽלֶּה׃
(ו) דָּבָר אַחֵר, וַיְדַבֵּר אֱלֹקִים אֵת כָּל הַדְּבָרִים הָאֵלֶּה לֵאמֹר, אָמַר רַבִּי יִצְחָק, מַה שֶּׁהַנְּבִיאִים עֲתִידִים לְהִתְנַבְּאוֹת בְּכָל דּוֹר וָדוֹר קִבְּלוּ מֵהַר סִינַי, שֶׁכֵּן משֶׁה אוֹמֵר לָהֶם לְיִשְׂרָאֵל (דברים כט, יד): כִּי אֶת אֲשֶׁר יֶשְׁנוֹ פֹּה עִמָּנוּ עֹמֵד הַיּוֹם וְאֵת אֲשֶׁר אֵינֶנּוּ פֹּה עִמָּנוּ הַיּוֹם, עִמָּנוּ עוֹמֵד הַיּוֹם, אֵין כְּתִיב כָּאן, אֶלָּא עִמָּנוּ הַיּוֹם, אֵלּוּ הַנְּשָׁמוֹת הָעֲתִידוֹת לְהִבָּרְאוֹת שֶׁאֵין בָּהֶם מַמָּשׁ, שֶׁלֹא נֶאֶמְרָה בָּהֶם עֲמִידָה, שֶׁאַף עַל פִּי שֶׁלֹא הָיוּ בְּאוֹתָהּ שָׁעָה, כָּל אֶחָד וְאֶחָד קִבֵּל אֶת שֶׁלּוֹ. וְכֵן הוּא אוֹמֵר (מלאכי א, א): מַשָֹּׂא דְּבַר יקוק אֶל יִשְׂרָאֵל בְּיַד מַלְאָכִי, בִּימֵי מַלְאָכִי לֹא נֶאֱמַר, אֶלָּא בְּיַד מַלְאָכִי, שֶׁכְּבָר הָיְתָה הַנְּבוּאָה בְּיָדוֹ מֵהַר סִינַי, וְעַד אוֹתָהּ שָׁעָה לֹא נִתְּנָה לוֹ רְשׁוּת לְהִתְנַבְּאוֹת. וְכֵן יְשַׁעְיָה אָמַר (ישעיה מח, טז): מֵעֵת הֱיוֹתָהּ שָׁם אָנִי, אָמַר יְשַׁעְיָה מִיּוֹם שֶׁנִּתְּנָה תּוֹרָה בְּסִינַי שָׁם הָיִיתִי וְקִבַּלְתִּי אֶת הַנְּבוּאָה הַזֹּאת, אֶלָּא (ישעיה מח, טז): וְעַתָּה אדושם אֱלֹקִים שְׁלָחַנִּי וְרוּחוֹ, עַד עַכְשָׁיו לֹא נִתַּן לוֹ רְשׁוּת לְהִתְנַבְּאוֹת.
(6) Another explanation: "And God said all of these things, saying" - Rabbi Yitzchak said, What the prophets were to prophesy in the future in each generation, they received from Mount Sinai. As Moshe said to Israel (Deuteronomy 29:14), "But with those here with us standing today and with those not here with us today." It does not say [at the end of the verse], "with us standing today," but rather, "with us today"; these are the souls that will be created in the future, who do not have substance, about whom "standing" is not mentioned. For even though they did not exist at that time, each one received that which was his. And so [too], it states (Malachi 1:1), "The burden that God spoke to Israel by ['in the hand of'] Malachi" - it does not state, "in the days of Malachi," but rather "in the hand of Malachi," as the prophecy was already in his hand from Mount Sinai, but until that time, he was not given permission to prophesy. Likewise Yeshayahu said (Isaiah 48:16), "from the time it was, was I there." Yeshayahu said, "From the time the Torah was given at Sinai, I was there and received this prophecy, except [only] 'now did God send me and His spirit'" - until now, he was not given permission to prophesy.
