(נא) אֵ֗לֶּה פְּקוּדֵי֙ בְּנֵ֣י יִשְׂרָאֵ֔ל שֵׁשׁ־מֵא֥וֹת אֶ֖לֶף וָאָ֑לֶף שְׁבַ֥ע מֵא֖וֹת וּשְׁלֹשִֽׁים׃ (פ) (נב) וַיְדַבֵּ֥ר יְהוָ֖ה אֶל־מֹשֶׁ֥ה לֵּאמֹֽר׃ (נג) לָאֵ֗לֶּה תֵּחָלֵ֥ק הָאָ֛רֶץ בְּנַחֲלָ֖ה בְּמִסְפַּ֥ר שֵׁמֽוֹת׃ (נד) לָרַ֗ב תַּרְבֶּה֙ נַחֲלָת֔וֹ וְלַמְעַ֕ט תַּמְעִ֖יט נַחֲלָת֑וֹ אִ֚ישׁ לְפִ֣י פְקֻדָ֔יו יֻתַּ֖ן נַחֲלָתֽוֹ׃ (נה) אַךְ־בְּגוֹרָ֕ל יֵחָלֵ֖ק אֶת־הָאָ֑רֶץ לִשְׁמ֥וֹת מַטּוֹת־אֲבֹתָ֖ם יִנְחָֽלוּ׃ (נו) עַל־פִּי֙ הַגּוֹרָ֔ל תֵּחָלֵ֖ק נַחֲלָת֑וֹ בֵּ֥ין רַ֖ב לִמְעָֽט׃ (ס)
(51) These are they that were numbered of the children of Israel, six hundred thousand and a thousand and seven hundred and thirty. (52) And the LORD spoke unto Moses, saying: (53) ’Unto these the land shall be divided for an inheritance according to the number of names. (54) To the more thou shalt give the more inheritance, and to the fewer thou shalt give the less inheritance; to each one according to those that were numbered of it shall its inheritance be given. (55) Notwithstanding the land shall be divided by lot; according to the names of the tribes of their fathers they shall inherit. (56) According to the lot shall their inheritance be divided between the more and the fewer.’
Daughters of Zelophehad
(א) וַתִּקְרַ֜בְנָה בְּנ֣וֹת צְלָפְחָ֗ד בֶּן־חֵ֤פֶר בֶּן־גִּלְעָד֙ בֶּן־מָכִ֣יר בֶּן־מְנַשֶּׁ֔ה לְמִשְׁפְּחֹ֖ת מְנַשֶּׁ֣ה בֶן־יוֹסֵ֑ף וְאֵ֙לֶּה֙ שְׁמ֣וֹת בְּנֹתָ֔יו מַחְלָ֣ה נֹעָ֔ה וְחָגְלָ֥ה וּמִלְכָּ֖ה וְתִרְצָֽה׃ (ב) וַֽתַּעֲמֹ֜דְנָה לִפְנֵ֣י מֹשֶׁ֗ה וְלִפְנֵי֙ אֶלְעָזָ֣ר הַכֹּהֵ֔ן וְלִפְנֵ֥י הַנְּשִׂיאִ֖ם וְכָל־הָעֵדָ֑ה פֶּ֥תַח אֹֽהֶל־מוֹעֵ֖ד לֵאמֹֽר׃ (ג) אָבִינוּ֮ מֵ֣ת בַּמִּדְבָּר֒ וְה֨וּא לֹא־הָיָ֜ה בְּת֣וֹךְ הָעֵדָ֗ה הַנּוֹעָדִ֛ים עַל־יְהוָ֖ה בַּעֲדַת־קֹ֑רַח כִּֽי־בְחֶטְא֣וֹ מֵ֔ת וּבָנִ֖ים לֹא־הָ֥יוּ לֽוֹ׃ (ד) לָ֣מָּה יִגָּרַ֤ע שֵׁם־אָבִ֙ינוּ֙ מִתּ֣וֹךְ מִשְׁפַּחְתּ֔וֹ כִּ֛י אֵ֥ין ל֖וֹ בֵּ֑ן תְּנָה־לָּ֣נוּ אֲחֻזָּ֔ה בְּת֖וֹךְ אֲחֵ֥י אָבִֽינוּ׃ (ה) וַיַּקְרֵ֥ב מֹשֶׁ֛ה אֶת־מִשְׁפָּטָ֖ן לִפְנֵ֥י יְהוָֽה׃ (ס) (ו) וַיֹּ֥אמֶר יְהוָ֖ה אֶל־מֹשֶׁ֥ה לֵּאמֹֽר׃ (ז) כֵּ֗ן בְּנ֣וֹת צְלָפְחָד֮ דֹּבְרֹת֒ נָתֹ֨ן תִּתֵּ֤ן לָהֶם֙ אֲחֻזַּ֣ת נַחֲלָ֔ה בְּת֖וֹךְ אֲחֵ֣י אֲבִיהֶ֑ם וְהַֽעֲבַרְתָּ֛ אֶת־נַחֲלַ֥ת אֲבִיהֶ֖ן לָהֶֽן׃ (ח) וְאֶל־בְּנֵ֥י יִשְׂרָאֵ֖ל תְּדַבֵּ֣ר לֵאמֹ֑ר אִ֣ישׁ כִּֽי־יָמ֗וּת וּבֵן֙ אֵ֣ין ל֔וֹ וְהַֽעֲבַרְתֶּ֥ם אֶת־נַחֲלָת֖וֹ לְבִתּֽוֹ׃ (ט) וְאִם־אֵ֥ין ל֖וֹ בַּ֑ת וּנְתַתֶּ֥ם אֶת־נַחֲלָת֖וֹ לְאֶחָיו׃ (י) וְאִם־אֵ֥ין ל֖וֹ אַחִ֑ים וּנְתַתֶּ֥ם אֶת־נַחֲלָת֖וֹ לַאֲחֵ֥י אָבִֽיו׃ (יא) וְאִם־אֵ֣ין אַחִים֮ לְאָבִיו֒ וּנְתַתֶּ֣ם אֶת־נַחֲלָת֗וֹ לִשְׁאֵר֞וֹ הַקָּרֹ֥ב אֵלָ֛יו מִמִּשְׁפַּחְתּ֖וֹ וְיָרַ֣שׁ אֹתָ֑הּ וְֽהָ֨יְתָ֜ה לִבְנֵ֤י יִשְׂרָאֵל֙ לְחֻקַּ֣ת מִשְׁפָּ֔ט כַּאֲשֶׁ֛ר צִוָּ֥ה יְהוָ֖ה אֶת־מֹשֶֽׁה׃ (ס)
(1) Then drew near the daughters of Zelophehad, the son of Hepher, the son of Gilead, the son of Machir, the son of Manasseh, of the families of Manasseh the son of Joseph; and these are the names of his daughters: Mahlah, Noah, and Hoglah, and Milcah, and Tirzah. (2) And they stood before Moses, and before Eleazar the priest, and before the princes and all the congregation, at the door of the tent of meeting, saying: (3) ’Our father died in the wilderness, and he was not among the company of them that gathered themselves together against the LORD in the company of Korah, but he died in his own sin; and he had no sons. (4) Why should the name of our father be done away from among his family, because he had no son? Give unto us a possession among the brethren of our father.’ (5) And Moses brought their cause before the LORD. (6) And the LORD spoke unto Moses, saying: (7) ’The daughters of Zelophehad speak right: thou shalt surely give them a possession of an inheritance among their father’s brethren; and thou shalt cause the inheritance of their father to pass unto them. (8) And thou shalt speak unto the children of Israel, saying: If a man die, and have no son, then ye shall cause his inheritance to pass unto his daughter. (9) And if he have no daughter, then ye shall give his inheritance unto his brethren. (10) And if he have no brethren, then ye shall give his inheritance unto his father’s brethren. (11) And if his father have no brethren, then ye shall give his inheritance unto his kinsman that is next to him of his family, and he shall possess it. And it shall be unto the children of Israel a statute of judgment, as the LORD commanded Moses.’

(1) And the heads of the fathers’houses of the family of the children of Gilead, the son of Machir, the son of Manasseh, of the families of the sons of Joseph, came near, and spoke before Moses, and before the princes, the heads of the fathers’houses of the children of Israel; (2) and they said: ‘The LORD commanded my lord to give the land for inheritance by lot to the children of Israel; and my lord was commanded by the LORD to give the inheritance of Zelophehad our brother unto his daughters. (3) And if they be married to any of the sons of the other tribes of the children of Israel, then will their inheritance be taken away from the inheritance of our fathers, and will be added to the inheritance of the tribe whereunto they shall belong; so will it be taken away from the lot of our inheritance. (4) And when the jubilee of the children of Israel shall be, then will their inheritance be added unto the inheritance of the tribe whereunto they shall belong; so will their inheritance be taken away from the inheritance of the tribe of our fathers.’ (5) And Moses commanded the children of Israel according to the word of the LORD, saying: ‘The tribe of the sons of Joseph speaketh right. (6) This is the thing which the LORD hath commanded concerning the daughters of Zelophehad, saying: Let them be married to whom they think best; only into the family of the tribe of their father shall they be married. (7) So shall no inheritance of the children of Israel remove from tribe to tribe; for the children of Israel shall cleave every one to the inheritance of the tribe of his fathers. (8) And every daughter, that possesseth an inheritance in any tribe of the children of Israel, shall be wife unto one of the family of the tribe of her father, that the children of Israel may possess every man the inheritance of his fathers. (9) So shall no inheritance remove from one tribe to another tribe; for the tribes of the children of Israel shall cleave each one to its own inheritance.’ (10) Even as the LORD commanded Moses, so did the daughters of Zelophehad. (11) For Mahlah, Tirzah, and Hoglah, and Milcah, and Noah, the daughters of Zelophehad, were married unto their father’s brothers’sons. (12) They were married into the families of the sons of Manasseh the son of Joseph, and their inheritance remained in the tribe of the family of their father.

Genesis Rabbah 96

Another interpretation of, And Jacob called unto his sons. Scripture says, I will cry unto God most High; unto God that accomplished it for me (Psalm 58:3). R. Joshua b. Levi said: Three things did the earthly court decree, and the Holy One, blessed be He, approved their decrees from above. And these are they: One in the days of Ezra. when they returned from Babylon the Holy One, blessed be He, wished to free them of tithes. What did the Israelites do? They went and decreed that they should tithe, for so it says, And that we should bring the first of our dough, and our heave offerings, and the fruit of all manner of trees, and the wine and the oil (Neh. 10:38) What did they do? They recorded it in a document, sealed it, and deposited it in the Temple, and on the morrow they entered and found it sealed. And how do we know that God approved their action? And yet for all this we make a sure covenant and subscribe what is already sealed. (ibd .1)

Another was in the days of Mordecai and Esther as it says, The Jews ordained, and took upon them, (Esther 9:27). And how do we know that God approved their action? Because the Jews...took upon them is written in the plural not the singular.

The Third was in the days of Joshua. When Israel entered the Land Joshua said to them, And the city shall be devoted (Josh 6:17), and you do not find that God had bidden him this, but he had acted of his own accord. And how do we know that God agreed with him? Because it says, Israel has sinned; yea, they have even transgressed My covenant...yea, they have even taken of the devoted thing (ib 7:11), from which we learn that God agreed with them. This corroborates with the text, "I will cry unto God Most High".

The Torah is not in Heaven

חתכו חוליות ונתן חול בין חוליא לחוליא ר"א מטהר וחכמים מטמאין

If he cut it into sections (lit. vertebrae), and placed sand between every section, Rabbi Eliezer rules it pure and the Sages rule it impure.

This is the “oven of Achnai.” What is Achnai? Said Rabbi Yehudah in the name of Shmuel: That they surrounded it with words [of debate] like an Achnai snake, and declared it impure. It was taught: On that day R. Eliezer answered all the answers on earth and they did not accept it from him. He said, “If the law is like me, the carob tree will prove it”; the carob tree was uprooted from its place one hundred Amah, some say four hundred Amah. They said: “We do not bring proof from a carob tree.”... He went and said “If the law is like me the water channel will prove it”; the water channel flowed in reverse direction. They said: “We do not bring proof from a water channel.” He went and said “If the law is as I say the walls of the House of Study will prove it”; the walls of the House of Study inclined to fall. R. Yehoshua protested at them, saying to them “If scholars defeat each other in the law, how does it better you?” They did not fall because of the honor of R.Yehoshua and they did not straighten, because of the honor of R. Eliezer, and they still incline and stand.... [R. Eliezer] went and said, “If the law is like me, from Heaven they will prove it”; a heavenly voice came out and said, “What have you with R. Eliezer, who the law is like him in every place?” R. Yehoshua stood on his feet and said “[The Torah] is not in heaven,” (Deuteronomy 30:12). What does "[The Torah] is not in heaven" mean? R. Yirmiyah said: “That the Torah was already given at Sinai, we do not pay attention to a heavenly voice, since You already wrote at Sinai in the Torah, “After the majority to incline,” (Exodus 23:2). R. Natan met the prophet Elijah and said to him, “What did the Holy One Blessed be He do in that hour?” He said to him: “He smiled and said, “My sons have defeated Me, My sons have defeated Me.”

Sifting through words of Torah
(קהלת יב, יא) דברי חכמים כדרבונות וכמסמרות נטועים בעלי אסופות נתנו מרועה אחד למה נמשלו דברי תורה לדרבן לומר לך מה דרבן זה מכוין את הפרה לתלמיה להוציא חיים לעולם אף דברי תורה מכוונין את לומדיהן מדרכי מיתה לדרכי חיים אי מה דרבן זה מטלטל אף דברי תורה מטלטלין ת"ל מסמרות אי מה מסמר זה חסר ולא יתר אף דברי תורה חסירין ולא יתירין ת"ל נטועים מה נטיעה זו פרה ורבה אף דברי תורה פרין ורבין בעלי אסופות אלו תלמידי חכמים שיושבין אסופות אסופות ועוסקין בתורה הללו מטמאין והללו מטהרין הללו אוסרין והללו מתירין הללו פוסלין והללו מכשירין שמא יאמר אדם היאך אני למד תורה מעתה תלמוד לומר כולם נתנו מרועה אחד אל אחד נתנן פרנס אחד אמרן מפי אדון כל המעשים ברוך הוא דכתיב (שמות כ, א) וידבר אלהים את כל הדברים האלה אף אתה עשה אזניך כאפרכסת וקנה לך לב מבין לשמוע את דברי מטמאים ואת דברי מטהרים את דברי אוסרין ואת דברי מתירין את דברי פוסלין ואת דברי מכשירין
(Ecclesiastes 12:11) "The words of the wise are like staffs, and as nails planted are the words of the masters of assemblies, which are given from one shepherd." Why are the words of the Torah likened to a staff? It is to tell you, Just as a staff is what direct the heifer in her furrows, so as to produce sustenance for the world, so too the words of the Torah direct the learners of them from paths of death to the paths of life. If you say, that just as a staff is what moves, so the words of the Torah will move; the text teaches "nails." If you say, that just as a nail is a thing which diminishes and does not add, so too the words of the Torah diminish and do not add, the text teaches "planted." Just as planting is a thing which is fruitful and multiplies, so too the words of the Torah are fruitful and multiply. ‘The masters of assemblies’: these are the disciples of the wise, who sit in manifold assemblies and occupy themselves with the Torah, some pronouncing unclean and others pronouncing clean, some prohibiting and others permitting, some disqualifying and others declaring fit. Should a man say: How in these circumstances shall I learn Torah? Therefore the text says: ‘All of them are given from one Shepherd’. One God gave them; one leader uttered them from the mouth of the Lord of all creation, blessed be He; for it is written: (Exodus 20:1) ‘And God spoke all these words’. Also make your ear as the upper millstone, and acquire for yourself an understanding heart to hear the words of those who declare unclean and the words of those who declare clean, the words of those who forbid and the words of those who permit, the words of those who disqualify and the words of those who pronounce ceremonially pure.
