I must inform the Knesset that not long ago the security services found one of the great Nazi war criminals: Adolf Eichmann, who was responsible, along with other Nazi leaders, for what they called the Final Solution to the Jewish problem - that is, the extermination of six million Jews in Europe. Adolf Eichmann is already under arrest in Israel and will soon face trial in Israel, in keeping with the laws governing justice for the Nazis and their helpers.!

(ב) מִצְוָה בְּיַד גּוֹאֵל הַדָּם [לַהֲרֹג אֶת הָרוֹצֵחַ] שֶׁנֶּאֱמַר (במדבר לה יט) "גֹּאֵל הַדָּם הוּא יָמִית אֶת הָרֹצֵחַ". וְכָל הָרָאוּי לִירֻשָּׁה הוּא גּוֹאֵל הַדָּם. לֹא רָצָה גּוֹאֵל הַדָּם אוֹ שֶׁלֹּא הָיָה יָכוֹל לַהֲמִיתוֹ אוֹ שֶׁאֵין לוֹ גּוֹאֵל דָּם בֵּית דִּין מְמִיתִין אֶת הָרוֹצֵחַ בְּסַיִף:
(2) It is a mitzvah for the blood redeemer to kill the murderer, as Numbers 35:19 states: "The blood redeemer shall put the murderer to death." Whoever is fit to inherit the victim's estate becomes the redeemer of his blood.If the blood redeemer did not desire - or was unable - to kill the murderer, or if the victim did not have a relative to redeem his blood, the court executes the murderer by decapitation.
He quotes Rabbeinu Nissim of Girona (or Ran; 1320-1376), who writes: "It is a commandment for the goel hadam to prosecute the murderer of his relative before the courts. If there is no goel hadam, then the courts must appoint an alternate prosecutor to speak on behalf of the victim."11 Therefore, concludes Rabbi Federbush, appointing the country's head prosecutor to speak on behalf of the millions who perished in the Holocaust was correct.
(ד) בֶּן נֹחַ שֶׁהָרַג נֶפֶשׁ אֲפִלּוּ עֵבָּר בִּמְעֵי אִמּוֹ נֶהֱרָג עָלָיו. וְכֵן אִם הָרַג טְרֵפָה אוֹ שֶׁכְּפָתוֹ וּנְתָנוֹ לִפְנֵי אֲרִי אוֹ שֶׁהִנִּיחוֹ בָּרָעָב עַד שֶׁמֵּת. הוֹאִיל וְהֵמִית מִכָּל מָקוֹם נֶהֱרָג. וְכֵן אִם הָרַג רוֹדֵף שֶׁיָּכוֹל לְהַצִּילוֹ בְּאֶחָד מֵאֵיבָרָיו נֶהֱרָג עָלָיו. מַה שֶּׁאֵין כֵּן בְּיִשְׂרָאֵל:
(4) A Noachide who slays any soul, even a fetus in its mother's womb, should be executed in retribution for its death. Similarly, if he slew a person who would have otherwise died in the near future, placed a person before a lion, or starved a person to death, he should be executed for through one manner or other, he killed.Similarly, one should be executed if he killed a pursuer when he could have saved the latter's potential victim by maiming one of the pursuer's limbs. These laws do not apply with regard to Jews.
וְהָדְתַנְיָא: שָׁלִיחַ שֶׁלֹּא עָשָׂה שְׁלִיחוּתוֹ – שָׁלִיחַ מָעַל, עָשָׂה שְׁלִיחוּתוֹ – בַּעַל הַבַּיִת מָעַל. כִּי עָשָׂה שְׁלִיחוּתוֹ דְּבַעַל הַבַּיִת – בַּעַל הַבַּיִת מִיהָא מָעַל. אַמַּאי? נֵימָא: אֵין שָׁלִיחַ לִדְבַר עֲבֵירָה!
The Gemara comments: And there is a difficulty from that which is taught in a baraita with regard to the halakhot of misuse of consecrated property: In the case of an agent who did not perform his agency but deviated from the instructions of the one who appointed him and made use of consecrated property, the agent has misused consecrated property and is liable to bring the guilt-offering for that sin. In the case of an agent who performed his agency, the owner has misused consecrated property and is liable to bring the offering. The Gemara asks: The baraita states that when the agent performed the agency of the owner, the owner has in any event misused consecrated property. Why? Let us say that there is no agency for transgression.

(10) This mishna continues to discuss the matter of testimony in the case of one who is liable to be executed. Concerning one whose verdict was delivered and he was sentenced to death and he fled, and he then came before the same court that sentenced him, they do not overturn his verdict and retry him. Rather, the court administers the previous verdict. Consequently, in any place where two witnesses will stand and say: We testify with regard to a man called so-and-so that his verdict was delivered and he was sentenced to death in the court of so-and-so, and so-and-so and so-and-so were his witnesses, that person shall be executed on the basis of that testimony. The mishna continues: The mitzva to establish a Sanhedrin with the authority to administer capital punishments is in effect both in Eretz Yisrael and outside Eretz Yisrael. A Sanhedrin that executes a transgressor once in seven years is characterized as a destructive tribunal. Since the Sanhedrin would subject the testimony to exacting scrutiny, it was extremely rare for a defendant to be executed. Rabbi Elazar ben Azarya says: This categorization applies to a Sanhedrin that executes a transgressor once in seventy years. Rabbi Tarfon and Rabbi Akiva say: If we had been members of the Sanhedrin, we would have conducted trials in a manner whereby no person would have ever been executed. Rabban Shimon ben Gamliel says: In adopting that approach, they too would increase the number of murderers among the Jewish people. The death penalty would lose its deterrent value, as all potential murderers would know that no one is ever executed.
(ד) וְכָל אֵלּוּ הָרַצְחָנִים וְכַיּוֹצֵא בָּהֶן שֶׁאֵינָן מְחֻיָּבִין מִיתַת בֵּית דִּין. אִם רָצָה מֶלֶךְ יִשְׂרָאֵל לְהָרְגָם בְּדִין הַמַּלְכוּת וְתַקָּנַת הָעוֹלָם הָרְשׁוּת בְּיָדוֹ. וְכֵן אִם רָאוּ בֵּית דִּין לְהָרְגָם בְּהוֹרָאַת שָׁעָה אִם הָיְתָה הַשָּׁעָה צְרִיכָה לְכָךְ יֵשׁ לָהֶם רְשׁוּת כְּפִי מַה שֶּׁיִּרְאוּ:
(4) When a Jewish king desires to slay any of these murderers and the like - who are not liable for execution by the court - by virtue of his regal authority, in order to perfect society, he has the license.Similarly, if the court desires to execute them as a result of a immediate fiat, because this was required at the time, they have the license to do as they see fit.
