(לב) וְעַתָּ֖ה אִם־תִּשָּׂ֣א חַטָּאתָ֑ם וְאִם־אַ֕יִן מְחֵ֣נִי נָ֔א מִֽסִּפְרְךָ֖ אֲשֶׁ֥ר כָּתָֽבְתָּ׃

(לג) וַיֹּ֥אמֶר ה' אֶל־מֹשֶׁ֑ה מִ֚י אֲשֶׁ֣ר חָֽטָא־לִ֔י אֶמְחֶ֖נּוּ מִסִּפְרִֽי׃

(32) Now, if You will forgive their sin [well and good]; but if not, erase me from the record which You have written!”

(33) But the LORD said to Moses, “He who has sinned against Me, him only will I erase from My record.

(י) וְלֹֽא־קָ֨ם נָבִ֥יא ע֛וֹד בְּיִשְׂרָאֵ֖ל כְּמֹשֶׁ֑ה אֲשֶׁר֙ יְדָע֣וֹ ה' פָּנִ֖ים אֶל־פָּנִֽים׃ (יא) לְכָל־הָ֨אֹת֜וֹת וְהַמּוֹפְתִ֗ים אֲשֶׁ֤ר שְׁלָחוֹ֙ ה' לַעֲשׂ֖וֹת בְּאֶ֣רֶץ מִצְרָ֑יִם לְפַרְעֹ֥ה וּלְכָל־עֲבָדָ֖יו וּלְכָל־אַרְצֽוֹ׃ (יב) וּלְכֹל֙ הַיָּ֣ד הַחֲזָקָ֔ה וּלְכֹ֖ל הַמּוֹרָ֣א הַגָּד֑וֹל אֲשֶׁר֙ עָשָׂ֣ה מֹשֶׁ֔ה לְעֵינֵ֖י כָּל־יִשְׂרָאֵֽל׃

(10) Never again did there arise in Israel a prophet like Moses—whom the LORD singled out, face to face, (11) for the various signs and portents that the LORD sent him to display in the land of Egypt, against Pharaoh and all his courtiers and his whole country, (12) and for all the great might and awesome power that Moses displayed before all Israel.

(יב) ולכל היד החזקה. שקבל את התורה בלוחות בידיו: (יג) ולכל המורא הגדול. נסים וגבורות שבמדבר הגדול והנורא: (יד) לעיני כל ישראל. שנשאו לבו לשבור הלוחות לעיניהם, שנאמר (לעיל ט, יז) ואשברם לעיניכם, והסכימה דעת הקדוש ברוך הוא לדעתו, שנאמר אשר שברת, יישר כחך ששברת (שמות לד, א) :

(12) ולכל היד החזקה AND IN ALL THAT STRONG HAND — this refers to the fact that he received the Torah that was on the Tablets, in his hands. (13) ולכל המורא הגדול AND IN ALL THAT GREAT TERRIBLENESS — the miracles and mighty deeds that were wrought in the great and terrible wilderness (cf. Siphre). (14) לעיני כל ישראל [WHICH MOSES SHOWED] BEFORE THE EYES OF ALL ISRAEL — This refers to the fact that his heart inspired him to shatter the Tablets before their eyes, as it is said, (Deuteronomy 9:17) “And I broke them before your eyes”, and the opinion of the Holy One, blessed be He, regarding this action agreed with his opinion, as it is stated that God said of the Tablets, (Exodus 34:1) אשר שברת "Which you have broken", [which implies] "May your strength be fitting (יישר; an expression of thanks and congratulation) because you have broken them" (Yevamot 62a; Shabbat 87a).

(טו) הַמּוֹלִ֨יכֲךָ֜ בַּמִּדְבָּ֣ר ׀ הַגָּדֹ֣ל וְהַנּוֹרָ֗א נָחָ֤שׁ ׀ שָׂרָף֙ וְעַקְרָ֔ב וְצִמָּא֖וֹן אֲשֶׁ֣ר אֵֽין־מָ֑יִם הַמּוֹצִ֤יא לְךָ֙ מַ֔יִם מִצּ֖וּר הַֽחַלָּמִֽישׁ׃

(15) who led you through the great and terrible wilderness with its seraph serpents and scorpions, a parched land with no water in it, who brought forth water for you from the flinty rock;

(יז) וָאֶתְפֹּשׂ֙ בִּשְׁנֵ֣י הַלֻּחֹ֔ת וָֽאַשְׁלִכֵ֔ם מֵעַ֖ל שְׁתֵּ֣י יָדָ֑י וָאֲשַׁבְּרֵ֖ם לְעֵינֵיכֶֽם׃
(17) Thereupon I gripped the two tablets and flung them away with both my hands, smashing them before your eyes.
(א) וַיֹּ֤אמֶר ה' אֶל־מֹשֶׁ֔ה פְּסָל־לְךָ֛ שְׁנֵֽי־לֻחֹ֥ת אֲבָנִ֖ים כָּרִאשֹׁנִ֑ים וְכָתַבְתִּי֙ עַל־הַלֻּחֹ֔ת אֶת־הַדְּבָרִ֔ים אֲשֶׁ֥ר הָי֛וּ עַל־הַלֻּחֹ֥ת הָרִאשֹׁנִ֖ים אֲשֶׁ֥ר שִׁבַּֽרְתָּ׃
(1) The LORD said to Moses: “Carve two tablets of stone like the first, and I will inscribe upon the tablets the words that were on the first tablets, which you shattered.
שבר את הלוחות מאי דריש אמר ומה פסח שהוא אחד מתרי"ג מצות אמרה תורה (שמות יב, מג) וכל בן נכר לא יאכל בו התורה כולה [כאן] וישראל מומרים על אחת כמה וכמה ומנלן דהסכים הקב"ה על ידו שנאמר (שמות לד, א) אשר שברת ואמר ר"ל יישר כחך ששיברת
And he broke the tablets following the sin of the Golden Calf. What source did he interpret that led him to do so? Moses said: With regard to the Paschal lamb, which is only one of six hundred and thirteen mitzvot, the Torah stated: “And the Lord said unto Moses and Aaron: This is the ordinance of the Paschal offering; no alien shall eat of it” (Exodus 12:43), referring not only to gentiles, but to apostate Jews as well. Regarding the tablets, which represented the entire Torah, and Israel at that moment were apostates, as they were worshipping the calf, all the more so are they not worthy of receiving the Torah. And from where do we derive that the Holy One, Blessed be He, agreed with his reasoning? As it is stated: “The first tablets which you broke [asher shibarta]” (Exodus 34:1), and Reish Lakish said: The word asher is an allusion to the phrase: May your strength be true [yishar koḥakha] due to the fact that you broke the tablets.
וא"ר (אליעזר) מאי דכתיב (שמות לב, טז) חרות על הלוחות אלמלי לא נשתברו לוחות הראשונות לא נשתכחה תורה מישראל רב אחא בר יעקב אמר אין כל אומה ולשון שולטת בהן שנאמר חרות אל תיקרי חרות אלא חירות
And, lastly, Rabbi Eliezer said: What is the meaning of that which is written: “And the tablets were the work of God, and the writing was the writing of God, engraved upon the tablets” (Exodus 32:16)? This teaches that had the first tablets, the subject of this verse, not been broken, the Torah would never have been forgotten from the Jewish people, as the Torah would have been engraved upon their hearts. Rav Aḥa bar Ya’akov said: Had the tablets not been broken, no nation or tongue would ever have ruled over them, as it is stated: “Engraved”; do not read it engraved [ḥarut] but rather freedom [ḥeirut].

ומה ראה משה לשבר את הלוחות. משל למלך שהלך למדינת הים, והניח אשתו עם השפחות. ומתוך שהיתה עמהם, יצא עליה שם רע. שמע המלך ובא ובקש להורגה. שמע שושבינה, עמד וקרע כתובתה. אמר, אם יאמר המלך כך וכך עשתה אשתי, נאמר לו, עדיין אינה אשתך. בדק המלך אחריה ולא מצא בה ערות דבר אלא השפחות הם היו שקלקלו. מיד נתרצה לה. אמר לו שושבינה, מרי, עשה לה כתובה אחרת שנתקרעה הראשונה. אמר לו, אתה קרעת אותה, לך והביא את הנייר משלך ואני כותב כתב ידי.

Midrash Tanchuma Ki Tissa:30

Once there was a king who went off on a distant journey and left his bride with her maidservants. Because of the [promiscuity of the] maidservants, rumors began circulating about the king’s bride. The king heard of this and wished to kill her. The bride’s guardian heard of this, so he went ahead and tore up her marriage contract, saying: “Should the king say, `My wife did such and such,’ we shall say to him, `She’s not your wife yet.’ “ The king subsequently investigated and found that there was nothing promiscuous in his bride’s behavior, that only the maidservants were corrupt, and was reconciled to her. Said the bride’s guardian to the king: “Sir, make her another marriage contract, for the first one was torn up.” Said the king to him: “You tore it up, so you supply the paper and I shall write on it with my hand” … Thus, when G-d forgave [the Jewish people], He said to Moses: “Carve for yourself, two tablets of stone [like the first ones, and I shall write on these tablets what was on the first tablets, which you broke].”

(כב) זִכְר֕וּ תּוֹרַ֖ת מֹשֶׁ֣ה עַבְדִּ֑י אֲשֶׁר֩ צִוִּ֨יתִי אוֹת֤וֹ בְחֹרֵב֙ עַל־כָּל־יִשְׂרָאֵ֔ל חֻקִּ֖ים וּמִשְׁפָּטִֽים׃
(22) Be mindful of the Teaching of My servant Moses, whom I charged at Horeb with laws and rules for all Israel.
