וַתִּקַּח֩ מִרְיָ֨ם הַנְּבִיאָ֜ה אֲח֧וֹת אַהֲרֹ֛ן אֶת־הַתֹּ֖ף בְּיָדָ֑הּ וַתֵּצֶ֤אןָ כׇֽל־הַנָּשִׁים֙ אַחֲרֶ֔יהָ בְּתֻפִּ֖ים וּבִמְחֹלֹֽת׃

Then Miriam the prophet, Aaron’s sister, picked up a hand-drum, and all the women went out after her in dance with hand-drums.

אָ֚ז יָשִׁ֣יר יִשְׂרָאֵ֔ל אֶת־הַשִּׁירָ֖ה הַזֹּ֑את עֲלִ֥י בְאֵ֖ר עֱנוּ־לָֽהּ׃

Then Israel sang this song:Spring up, O well—sing to it—

וְכׇל־יִשְׂרָאֵ֗ל מַֽעֲלִים֙ אֶת־אֲר֣וֹן בְּרִית־ה׳ בִּתְרוּעָה֙ וּבְק֣וֹל שׁוֹפָ֔ר וּבַחֲצֹצְר֖וֹת וּבִמְצִלְתָּ֑יִם מַשְׁמִעִ֕ים בִּנְבָלִ֖ים וְכִנֹּרֽוֹת׃

All Israel brought up the Ark of the Covenant of the LORD with shouts and with blasts of the horn, with trumpets and cymbals, playing on harps and lyres.

עַ֥ל נַהֲר֨וֹת ׀ בָּבֶ֗ל שָׁ֣ם יָ֭שַׁבְנוּ גַּם־בָּכִ֑ינוּ בְּ֝זׇכְרֵ֗נוּ אֶת־צִיּֽוֹן׃

By the rivers of Babylon,there we sat,sat and wept,as we thought of Zion.

עַֽל־עֲרָבִ֥ים בְּתוֹכָ֑הּ תָּ֝לִ֗ינוּ כִּנֹּרוֹתֵֽינוּ׃

There on the poplarswe hung up our lyres,

כִּ֤י שָׁ֨ם שְֽׁאֵל֪וּנוּ שׁוֹבֵ֡ינוּ דִּבְרֵי־שִׁ֭יר וְתוֹלָלֵ֣ינוּ שִׂמְחָ֑ה שִׁ֥ירוּ לָ֝֗נוּ מִשִּׁ֥יר צִיּֽוֹן׃

for our captors asked us there for songs,our tormentors, for amusement:“Sing us one of the songs of Zion.”

אֵ֗יךְ נָשִׁ֥יר אֶת־שִׁיר־ה׳ עַ֝֗ל אַדְמַ֥ת נֵכָֽר׃

How can we sing a song of the LORDon alien soil?

אִֽם־אֶשְׁכָּחֵ֥ךְ יְֽרוּשָׁלָ֗͏ִם תִּשְׁכַּ֥ח יְמִינִֽי׃

If I forget you, O Jerusalem,let my right hand wither;

יֹֽאמַר־נָ֤א אֲדֹנֵ֙נוּ֙ עֲבָדֶ֣יךָ לְפָנֶ֔יךָ יְבַקְשׁ֕וּ אִ֕ישׁ יֹדֵ֖עַ מְנַגֵּ֣ן בַּכִּנּ֑וֹר וְהָיָ֗ה בִּֽהְי֨וֹת עָלֶ֤יךָ רֽוּחַ־אֱלֹקִים֙ רָעָ֔ה וְנִגֵּ֥ן בְּיָד֖וֹ וְט֥וֹב לָֽךְ׃ {פ}

Let our lord give the order [and] the courtiers in attendance on you will look for someone who is skilled at playing the lyre; whenever the evil spirit of God comes over you, he will play it and you will feel better.”

הֶחָלִיל חֲמִשָּׁה וְשִׁשָּׁה. זֶהוּ הֶחָלִיל שֶׁל בֵּית הַשּׁוֹאֵבָה, שֶׁאֵינָה דּוֹחָה לֹא אֶת הַשַּׁבָּת וְלֹא אֶת יוֹם טוֹב. אָמְרוּ, כָּל מִי שֶׁלֹּא רָאָה שִׂמְחַת בֵּית הַשּׁוֹאֵבָה, לֹא רָאָה שִׂמְחָה מִיָּמָיו:

The flute is played on the festival of Sukkot for five or six days. This is the flute of the Place of the Drawing of the Water, whose playing overrides neither Shabbat nor the Festival. Therefore, if the first Festival day occurred on Shabbat, they would play the flute for six days that year. However, if Shabbat coincided with one of the intermediate days of the Festival, they would play the flute for only five days. One who did not see the Celebration of the Place of the Drawing of the Water never saw celebration in his days.

וְאָמַר רַבִּי שְׁפַטְיָה אָמַר רַבִּי יוֹחָנָן: כׇּל הַקּוֹרֵא בְּלֹא נְעִימָה וְשׁוֹנֶה בְּלֹא זִמְרָה, עָלָיו הַכָּתוּב אוֹמֵר: ״וְגַם אֲנִי נָתַתִּי לָהֶם חוּקִּים לֹא טוֹבִים וְגוֹ׳״.

And Rabbi Shefatya said that Rabbi Yoḥanan said: Concerning anyone who reads from the Torah without a melody or studies the Mishna without a song, the verse states: “So too I gave them statutes that were not good, and judgments whereby they should not live” (Ezekiel 20:25), as one who studies Torah through song demonstrates that he is fond of his learning. Furthermore, the tune helps him remember what he has learned.

זמר בכל יום - היה מסדר למודך אע"פ שסדור בפיך כזמר והוא יגרום לך שתהא לעולם הבא בשמחה ובשירים:

וַתֵּ֥לֶד עָדָ֖ה אֶת־יָבָ֑ל ה֣וּא הָיָ֔ה אֲבִ֕י יֹשֵׁ֥ב אֹ֖הֶל וּמִקְנֶֽה׃

Adah bore Jabal; he was the ancestor of those who dwell in tents and amidst herds.

וְשֵׁ֥ם אָחִ֖יו יוּבָ֑ל ה֣וּא הָיָ֔ה אֲבִ֕י כׇּל־תֹּפֵ֥שׂ כִּנּ֖וֹר וְעוּגָֽב׃

And the name of his brother was Jubal; he was the ancestor of all who play the lyre and the pipe.

וְצִלָּ֣ה גַם־הִ֗וא יָֽלְדָה֙ אֶת־תּ֣וּבַל קַ֔יִן לֹטֵ֕שׁ כׇּל־חֹרֵ֥שׁ נְחֹ֖שֶׁת וּבַרְזֶ֑ל וַֽאֲח֥וֹת תּֽוּבַל־קַ֖יִן נַֽעֲמָֽה׃

As for Zillah, she bore Tubal-cain, who forged all implements of copper and iron. And the sister of Tubal-cain was Naamah.

״וְשִׁבַּחְתִּי אֲנִי אֶת הַשִּׂמְחָה״ — שִׂמְחָה שֶׁל מִצְוָה. ״וּלְשִׂמְחָה מַה זֹּה עוֹשָׂה״ — זוֹ שִׂמְחָה שֶׁאֵינָהּ שֶׁל מִצְוָה. לְלַמֶּדְךָ שֶׁאֵין שְׁכִינָה שׁוֹרָה לֹא מִתּוֹךְ עַצְבוּת וְלֹא מִתּוֹךְ עַצְלוּת וְלֹא מִתּוֹךְ שְׂחוֹק וְלֹא מִתּוֹךְ קַלּוּת רֹאשׁ וְלֹא מִתּוֹךְ שִׂיחָה וְלֹא מִתּוֹךְ דְּבָרִים בְּטֵלִים, אֶלָּא מִתּוֹךְ דְּבַר שִׂמְחָה שֶׁל מִצְוָה, שֶׁנֶּאֱמַר: ״וְעַתָּה קְחוּ לִי מְנַגֵּן וְהָיָה כְּנַגֵּן הַמְנַגֵּן וַתְּהִי עָלָיו יַד ה׳״. אָמַר רַב יְהוּדָה: וְכֵן לִדְבַר הֲלָכָה. אָמַר רָבָא: וְכֵן לַחֲלוֹם טוֹב.

Similarly, “So I commended mirth,” that is the joy of a mitzva. “And of mirth: What does it accomplish?” that is joy that is not the joy of a mitzva. The praise of joy mentioned here is to teach you that the Divine Presence rests upon an individual neither from an atmosphere of sadness, nor from an atmosphere of laziness, nor from an atmosphere of laughter, nor from an atmosphere of frivolity, nor from an atmosphere of idle conversation, nor from an atmosphere of idle chatter, but rather from an atmosphere imbued with the joy of a mitzva. As it was stated with regard to Elisha that after he became angry at the king of Israel, his prophetic spirit left him until he requested: “But now bring me a minstrel; and it came to pass, when the minstrel played, that the hand of the Lord came upon him” (II Kings 3:15). Rav Yehuda said: And, so too, one should be joyful before stating a matter of halakha. Rava said: And, so too, one should be joyful before going to sleep in order to have a good dream.

אין פוחתין משני נבלים ולא מוסיפין על ששה אין פוחתין משני חלילין ולא מוסיפין על שנים עשר ובשנים עשר יום בשנה החליל מכה לפני המזבח בשחיטת פסח ראשון ובשחיטת פסח שני ויום טוב הראשון של פסח וביום טוב של עצרת ובשמונת ימי החג ולא היה מכה באבוב של נחשת אלא באבוב של קנה מפני שקולו ערב ולא היה מחלק אלא באבוב יחידי מפני שהוא מחליק יפה

When accompanying their song with instruments, the Levites do not use fewer than two lyres and do not use more than six. When flutes are played, they do not use fewer than two flutes and do not use more than twelve. And there are twelve days during the year when the flute plays before the altar: At the time of the slaughter of the first Paschal offering, on the fourteenth of Nisan; and at the time of the slaughter of the second Paschal offering, on the fourteenth of Iyyar; and on the first festival day of Passover; and on the festival of Shavuot; and on all eight days of the festival of Sukkot. And one would not play with a copper flute; rather, one would play with a flute of reed, because its sound is more pleasant. And one would conclude the music only with a single flute, because it concludes the music nicely.

וכן גזרו שלא לנגן בכלי שיר וכל מיני זמר וכל משמיעי קול של שיר לשמח בהם: הגה ויש אומרים דוקא מי שרגיל בהם כגון המלכים שעומדים ושוכבים בכלי שיר או בבית המשתה [טור] ואסור לשומעם מפני החורבן ואפי' שיר בפה על היין אסורה שנא' בשיר לא ישתו יין וכבר נהגו כל ישראל לומר דברי תשבחות או שיר של הודאות וזכרון חסדי הקדוש ברוך הוא על היין: הגה וכן לצורך מצוה כגון בבית חתן וכלה הכל שרי [תוס' וסמ"ג והגהות מיימוני]:

Similarly they decreed not to play [music] with instruments, and musical devices, and all things that make music to rejoice with them. There are those who say, [the prohibition is] specifically for those whom they regularly play them, like for kings who stand and rest to instruments or in the house of a feast. (Tur) It is forbidden to make them heard because of the destruction, and even song by mouth over wine is forbidden, as it says: "In song one may not drink wine" (Isiah 24:9). And all of Israel is already accustomed to saying words of praise or songs of thanks and remembering the goodnes of the holy one blessed be he over wine. Similarly for the need of a Mitzvah, like for house of a Groom and Bride, all this is permitted. (Tosefot, Smug, and Hagehot Maymoni)

אמר רב יהודה אמר שמואל מנין לעיקר שירה מן התורה שנאמר (דברים יח, ז) ושרת בשם ה׳ אלקיו איזהו שירות שבשם הוי אומר זה שירה

Rav Yehuda said that Shmuel said: From where is it derived that the basic requirement to accompany communal offerings with song applies by Torah law? As it is stated with regard to a Levite who serves in the Temple: “Then he shall serve with the name of the Lord his God” (Deuteronomy 18:7). What is this service that is performed with the name of God? You must say that this is the song, in which the Levites mention and praise the name of God.

אַחֵר מַאי — זֶמֶר יְווֹנִי לָא פְּסַק מִפּוּמֵּיהּ. אָמְרוּ עָלָיו עַל אַחֵר: בְּשָׁעָה שֶׁהָיָה עוֹמֵד מִבֵּית הַמִּדְרָשׁ, הַרְבֵּה סִפְרֵי מִינִין נוֹשְׁרִין מֵחֵיקוֹ.

The Gemara explains: Aḥer, what was his failing? Greek tunes never ceased from his mouth. He would constantly hum Greek songs, even when he was among the Sages. This shows that from the outset he was drawn to gentile culture and beliefs. Similarly, they said about Aḥer: When he would stand after learning in the study hall, many heretical books, which he had been reading, would fall from his lap. Therefore, he was somewhat unsound even when among the Sages.
