תנן התם חתכו חוליות ונתן חול בין חוליא לחוליא ר"א מטהר וחכמים מטמאין
We taught there (Kelim 5:10): [If] one cut segments, and placed sand between each segment -- Rabbi Eliezer [ruled it] ritually pure and the Rabbis [ruled it] ritually impure.
And this is the oven of 'akhnai (snake). What is 'akhnai? Rav Yehuda said that Shmuel said: For they surrounded it with their statements like this snake and [ruled] it impure. One taught: On that day, Rabbi Eli'ezer answered all the answers in the world but they did not accept from him.
אמר להם אם הלכה כמותי חרוב זה יוכיח נעקר חרוב ממקומו מאה אמה ואמרי לה ארבע מאות אמה אמרו לו אין מביאין ראיה מן החרוב חזר ואמר להם אם הלכה כמותי אמת המים יוכיחו חזרו אמת המים לאחוריהם אמרו לו אין מביאין ראיה מאמת המים חזר ואמר להם אם הלכה כמותי כותלי בית המדרש יוכיחו הטו כותלי בית המדרש ליפול גער בהם רבי יהושע אמר להם אם תלמידי חכמים מנצחים זה את זה בהלכה אתם מה טיבכם לא נפלו מפני כבודו של רבי יהושע ולא זקפו מפני כבודו של ר"א ועדיין מטין ועומדין חזר ואמר להם אם הלכה כמותי מן השמים יוכיחו יצאתה בת קול ואמרה מה לכם אצל ר"א שהלכה כמותו בכ"מ עמד רבי יהושע על רגליו ואמר (דברים ל, יב) לא בשמים היא מאי לא בשמים היא אמר רבי ירמיה שכבר נתנה תורה מהר סיני אין אנו משגיחין בבת קול שכבר כתבת בהר סיני בתורה (שמות כג, ב) אחרי רבים להטות אשכחיה רבי נתן לאליהו א"ל מאי עביד קוב"ה בההיא שעתא א"ל קא חייך ואמר נצחוני בני נצחוני בני
He said to them: If the halakhah is according to me, this carob tree will prove it. The carob tree was uprooted from its place one hundred cubits, and some say four hundred cubits. They said to him: One does not bring evidence from a carob tree. He further said to them: If the halakhah is according to me, the canal will prove it. The canal turned backward. They said to him: One does not bring evidence from a stream. He further said to them: If the halakhah is according to me, the walls of the study hall will prove it. The walls of the study hall leaned to fall. Rabbi Yehoshua' scolded them and said to them: If scholars prevail over each other in halakhah, what are you?! They did not fall out of respect to Rabbi Yehoshua' and they did not stand straight out of respect to Rabbi Eli'ezer, and they still stand leaning. He further said to them: If the halakhah If the halakhah is according to me, Heaven will prove it. A Divine Voice emerged and said: What to you with Rabbi Eli'ezer, as the halakhah is according to him in every case? Rabbi Yehoshua' stood up and said: “It is not in heaven” (Deuteronomy 30:12). What is “It is not in heaven”? Rabbi Yirmiya said: Since Torah was already given at Mount Sinai, we do not regard a Divine Voice, for You already wrote at Mount Sinai, in the Torah: “After a majority to incline” (Exodus 23:2). Rabbi Natan encountered Elijah said to him: What did the Holy Blessed One do at that moment? He said to him: He laughed and said: My children have prevailed over Me, my children have prevailed over Me!
(11) For this mitzvah with which I charge you this day is not too wondrous for you nor is it distant. (12) It is not in the heavens, that you should say, “Who among us can go up to the heavens and get it for us and impart it to us, that we may observe it?” (13) Neither is it beyond the sea, that you should say, “Who among us can cross to the other side of the sea and get it for us and impart it to us, that we may observe it?”
(2) You shall neither side with the mighty to do wrong—you shall not give perverse testimony in a dispute so as to pervert it in favor of the mighty (alt. to incline after the majority) — (3) nor shall you show deference to a poor man in his dispute.
אמרו אותו היום הביאו כל טהרות שטיהר ר"א ושרפום באש ונמנו עליו וברכוהו ואמרו מי ילך ויודיעו אמר להם ר"ע אני אלך שמא ילך אדם שאינו הגון ויודיעו ונמצא מחריב את כל העולם כולו מה עשה ר"ע לבש שחורים ונתעטף שחורים וישב לפניו ברחוק ארבע אמות אמר לו ר"א עקיבא מה יום מיומים אמר לו רבי כמדומה לי שחבירים בדילים ממך אף הוא קרע בגדיו וחלץ מנעליו ונשמט וישב על גבי קרקע זלגו עיניו דמעות לקה העולם שליש בזיתים ושליש בחטים ושליש בשעורים ויש אומרים אף בצק שבידי אשה טפח תנא אך גדול היה באותו היום שבכל מקום שנתן בו עיניו ר"א נשרף
They said: On that day, they brought all the ritually pure items ruled pure by Rabbi Eli'ezer and burned them in fire, and they reached a consensus over him and blessed him. And they said: Who will go and inform him? Rabbi 'Akiva said to them: I will go, lest an unseemly person go and inform him and thereby destroy the entire world. What did Rabbi 'Akiva do? He wore black and wrapped himself in black and sat before him at a distance of four cubits. Rabbi Eli'ezer said to him: 'Akiva, what today from other days? He said to him: My rabbi, it appears to me that friends are distancing themselves from you. He, too, rent his garments and removed his shoes and he slid and sat on the ground. His eyes shed tears. The world was afflicted: one-third of the olives and one-third of the wheat, and one-third of the barley. And some say that even dough in a woman’s hands spoiled. One taught: There was a greater [plague] on that day, as any place that Rabbi Eliezer set his eyes was burned.
ואף ר"ג היה בא בספינה עמד עליו נחשול לטבעו אמר כמדומה לי שאין זה אלא בשביל ר"א בן הורקנוס עמד על רגליו ואמר רבונו של עולם גלוי וידוע לפניך שלא לכבודי עשיתי ולא לכבוד בית אבא עשיתי אלא לכבודך שלא ירבו מחלוקות בישראל נח הים מזעפו
And even Rabban Gamliel was coming on a boat. A gale came over him to drown him. He said: It seems to me that this is only for the sake of Rabbi Eli'ezer ben Hyrcanus. He stood on his feet and said: Master of the Universe, it is revealed and known before You that neither was it for my honor that I acted nor was it for the honor of the house of my father that I acted; rather, it was for Your honor, so that disputes will not proliferate in Israel. The sea calmed from its raging.
