Daughters of Zelophehad Episode V: The Patriarchy Strikes Back Parashat Matot-Masei 7/18/20
When last we met our heroines, Mahlah, Noah, Hoglah, Milcah, and Tirzah, they had come before Moses and all of Israel to plead their case, and had won a victory for women in the Tribes of Israel...

(א) וַתִּקְרַ֜בְנָה בְּנ֣וֹת צְלָפְחָ֗ד בֶּן־חֵ֤פֶר בֶּן־גִּלְעָד֙ בֶּן־מָכִ֣יר בֶּן־מְנַשֶּׁ֔ה לְמִשְׁפְּחֹ֖ת מְנַשֶּׁ֣ה בֶן־יוֹסֵ֑ף וְאֵ֙לֶּה֙ שְׁמ֣וֹת בְּנֹתָ֔יו מַחְלָ֣ה נֹעָ֔ה וְחָגְלָ֥ה וּמִלְכָּ֖ה וְתִרְצָֽה׃ (ב) וַֽתַּעֲמֹ֜דְנָה לִפְנֵ֣י מֹשֶׁ֗ה וְלִפְנֵי֙ אֶלְעָזָ֣ר הַכֹּהֵ֔ן וְלִפְנֵ֥י הַנְּשִׂיאִ֖ם וְכָל־הָעֵדָ֑ה פֶּ֥תַח אֹֽהֶל־מוֹעֵ֖ד לֵאמֹֽר׃ (ג) אָבִינוּ֮ מֵ֣ת בַּמִּדְבָּר֒ וְה֨וּא לֹא־הָיָ֜ה בְּת֣וֹךְ הָעֵדָ֗ה הַנּוֹעָדִ֛ים עַל־יְהוָ֖ה בַּעֲדַת־קֹ֑רַח כִּֽי־בְחֶטְא֣וֹ מֵ֔ת וּבָנִ֖ים לֹא־הָ֥יוּ לֽוֹ׃ (ד) לָ֣מָּה יִגָּרַ֤ע שֵׁם־אָבִ֙ינוּ֙ מִתּ֣וֹךְ מִשְׁפַּחְתּ֔וֹ כִּ֛י אֵ֥ין ל֖וֹ בֵּ֑ן תְּנָה־לָּ֣נוּ אֲחֻזָּ֔ה בְּת֖וֹךְ אֲחֵ֥י אָבִֽינוּ׃ (ה) וַיַּקְרֵ֥ב מֹשֶׁ֛ה אֶת־מִשְׁפָּטָ֖ן לִפְנֵ֥י יְהוָֽה׃ (ס) (ו) וַיֹּ֥אמֶר יְהוָ֖ה אֶל־מֹשֶׁ֥ה לֵּאמֹֽר׃ (ז) כֵּ֗ן בְּנ֣וֹת צְלָפְחָד֮ דֹּבְרֹת֒ נָתֹ֨ן תִּתֵּ֤ן לָהֶם֙ אֲחֻזַּ֣ת נַחֲלָ֔ה בְּת֖וֹךְ אֲחֵ֣י אֲבִיהֶ֑ם וְהַֽעֲבַרְתָּ֛ אֶת־נַחֲלַ֥ת אֲבִיהֶ֖ן לָהֶֽן׃ (ח) וְאֶל־בְּנֵ֥י יִשְׂרָאֵ֖ל תְּדַבֵּ֣ר לֵאמֹ֑ר אִ֣ישׁ כִּֽי־יָמ֗וּת וּבֵן֙ אֵ֣ין ל֔וֹ וְהַֽעֲבַרְתֶּ֥ם אֶת־נַחֲלָת֖וֹ לְבִתּֽוֹ׃

(1) The daughters of Zelophehad, of Manassite family—son of Hepher son of Gilead son of Machir son of Manasseh son of Joseph—came forward. The names of the daughters were Mahlah, Noah, Hoglah, Milcah, and Tirzah. (2) They stood before Moses, Eleazar the priest, the chieftains, and the whole assembly, at the entrance of the Tent of Meeting, and they said, (3) “Our father died in the wilderness. He was not one of the faction, Korah’s faction, which banded together against the LORD, but died for his own sin; and he has left no sons. (4) Let not our father’s name be lost to his clan just because he had no son! Give us a holding among our father’s kinsmen!” (5) Moses brought their case before the LORD. (6) And the LORD said to Moses, (7) “The plea of Zelophehad’s daughters is just: you should give them a hereditary holding among their father’s kinsmen; transfer their father’s share to them. (8) “Further, speak to the Israelite people as follows: ‘If a man dies without leaving a son, you shall transfer his property to his daughter.

But now, as we reach the very end of the book of Bamidbar and the Israelites’ time in the wilderness, a new challenge has arisen ... the male relatives of their tribe have also brought a grievance to Moses...

(א) וַֽיִּקְרְב֞וּ רָאשֵׁ֣י הָֽאָב֗וֹת לְמִשְׁפַּ֤חַת בְּנֵֽי־גִלְעָד֙ בֶּן־מָכִ֣יר בֶּן־מְנַשֶּׁ֔ה מִֽמִּשְׁפְּחֹ֖ת בְּנֵ֣י יוֹסֵ֑ף וַֽיְדַבְּר֞וּ לִפְנֵ֤י מֹשֶׁה֙ וְלִפְנֵ֣י הַנְּשִׂאִ֔ים רָאשֵׁ֥י אָב֖וֹת לִבְנֵ֥י יִשְׂרָאֵֽל׃ (ב) וַיֹּאמְר֗וּ אֶת־אֲדֹנִי֙ צִוָּ֣ה יְהוָ֔ה לָתֵ֨ת אֶת־הָאָ֧רֶץ בְּנַחֲלָ֛ה בְּגוֹרָ֖ל לִבְנֵ֣י יִשְׂרָאֵ֑ל וַֽאדֹנִי֙ צֻוָּ֣ה בַֽיהוָ֔ה לָתֵ֗ת אֶֽת־נַחֲלַ֛ת צְלָפְחָ֥ד אָחִ֖ינוּ לִבְנֹתָֽיו׃ (ג) וְ֠הָיוּ לְאֶחָ֞ד מִבְּנֵ֨י שִׁבְטֵ֥י בְנֵֽי־יִשְׂרָאֵל֮ לְנָשִׁים֒ וְנִגְרְעָ֤ה נַחֲלָתָן֙ מִנַּחֲלַ֣ת אֲבֹתֵ֔ינוּ וְנוֹסַ֕ף עַ֚ל נַחֲלַ֣ת הַמַּטֶּ֔ה אֲשֶׁ֥ר תִּהְיֶ֖ינָה לָהֶ֑ם וּמִגֹּרַ֥ל נַחֲלָתֵ֖נוּ יִגָּרֵֽעַ׃ (ד) וְאִם־יִהְיֶ֣ה הַיֹּבֵל֮ לִבְנֵ֣י יִשְׂרָאֵל֒ וְנֽוֹסְפָה֙ נַחֲלָתָ֔ן עַ֚ל נַחֲלַ֣ת הַמַּטֶּ֔ה אֲשֶׁ֥ר תִּהְיֶ֖ינָה לָהֶ֑ם וּמִֽנַּחֲלַת֙ מַטֵּ֣ה אֲבֹתֵ֔ינוּ יִגָּרַ֖ע נַחֲלָתָֽן׃ (ה) וַיְצַ֤ו מֹשֶׁה֙ אֶת־בְּנֵ֣י יִשְׂרָאֵ֔ל עַל־פִּ֥י יְהוָ֖ה לֵאמֹ֑ר כֵּ֛ן מַטֵּ֥ה בְנֵֽי־יוֹסֵ֖ף דֹּבְרִֽים׃ (ו) זֶ֣ה הַדָּבָ֞ר אֲשֶׁר־צִוָּ֣ה יְהוָ֗ה לִבְנ֤וֹת צְלָפְחָד֙ לֵאמֹ֔ר לַטּ֥וֹב בְּעֵינֵיהֶ֖ם תִּהְיֶ֣ינָה לְנָשִׁ֑ים אַ֗ךְ לְמִשְׁפַּ֛חַת מַטֵּ֥ה אֲבִיהֶ֖ם תִּהְיֶ֥ינָה לְנָשִֽׁים׃ (ז) וְלֹֽא־תִסֹּ֤ב נַחֲלָה֙ לִבְנֵ֣י יִשְׂרָאֵ֔ל מִמַּטֶּ֖ה אֶל־מַטֶּ֑ה כִּ֣י אִ֗ישׁ בְּנַחֲלַת֙ מַטֵּ֣ה אֲבֹתָ֔יו יִדְבְּק֖וּ בְּנֵ֥י יִשְׂרָאֵֽל׃ (ח) וְכָל־בַּ֞ת יֹרֶ֣שֶׁת נַחֲלָ֗ה מִמַּטּוֹת֮ בְּנֵ֣י יִשְׂרָאֵל֒ לְאֶחָ֗ד מִמִּשְׁפַּ֛חַת מַטֵּ֥ה אָבִ֖יהָ תִּהְיֶ֣ה לְאִשָּׁ֑ה לְמַ֗עַן יִֽירְשׁוּ֙ בְּנֵ֣י יִשְׂרָאֵ֔ל אִ֖ישׁ נַחֲלַ֥ת אֲבֹתָֽיו׃ (ט) וְלֹֽא־תִסֹּ֧ב נַחֲלָ֛ה מִמַּטֶּ֖ה לְמַטֶּ֣ה אַחֵ֑ר כִּי־אִישׁ֙ בְּנַ֣חֲלָת֔וֹ יִדְבְּק֕וּ מַטּ֖וֹת בְּנֵ֥י יִשְׂרָאֵֽל׃ (י) כַּאֲשֶׁ֛ר צִוָּ֥ה יְהוָ֖ה אֶת־מֹשֶׁ֑ה כֵּ֥ן עָשׂ֖וּ בְּנ֥וֹת צְלָפְחָֽד׃ (יא) וַתִּהְיֶ֜ינָה מַחְלָ֣ה תִרְצָ֗ה וְחָגְלָ֧ה וּמִלְכָּ֛ה וְנֹעָ֖ה בְּנ֣וֹת צְלָפְחָ֑ד לִבְנֵ֥י דֹדֵיהֶ֖ן לְנָשִֽׁים׃ (יב) מִֽמִּשְׁפְּחֹ֛ת בְּנֵֽי־מְנַשֶּׁ֥ה בֶן־יוֹסֵ֖ף הָי֣וּ לְנָשִׁ֑ים וַתְּהִי֙ נַחֲלָתָ֔ן עַל־מַטֵּ֖ה מִשְׁפַּ֥חַת אֲבִיהֶֽן׃ (יג) אֵ֣לֶּה הַמִּצְוֺ֞ת וְהַמִּשְׁפָּטִ֗ים אֲשֶׁ֨ר צִוָּ֧ה יְהוָ֛ה בְּיַד־מֹשֶׁ֖ה אֶל־בְּנֵ֣י יִשְׂרָאֵ֑ל בְּעַֽרְבֹ֣ת מוֹאָ֔ב עַ֖ל יַרְדֵּ֥ן יְרֵחֽוֹ׃

(1) The family heads in the clan of the descendants of Gilead son of Machir son of Manasseh, one of the Josephite clans, came forward and appealed to Moses and the chieftains, family heads of the Israelites. (2) They said, “The LORD commanded my lord to assign the land to the Israelites as shares by lot, and my lord was further commanded by the LORD to assign the share of our kinsman Zelophehad to his daughters. (3) Now, if they marry persons from another Israelite tribe, their share will be cut off from our ancestral portion and be added to the portion of the tribe into which they marry; thus our allotted portion will be diminished. (4) And even when the Israelites observe the jubilee, their share will be added to that of the tribe into which they marry, and their share will be cut off from the ancestral portion of our tribe.” (5) So Moses, at the LORD’s bidding, instructed the Israelites, saying: “The plea of the Josephite tribe is just. (6) This is what the LORD has commanded concerning the daughters of Zelophehad: They may marry anyone they wish, provided they marry into a clan of their father’s tribe. (7) No inheritance of the Israelites may pass over from one tribe to another, but the Israelites must remain bound each to the ancestral portion of his tribe. (8) Every daughter among the Israelite tribes who inherits a share must marry someone from a clan of her father’s tribe, in order that every Israelite may keep his ancestral share. (9) Thus no inheritance shall pass over from one tribe to another, but the Israelite tribes shall remain bound each to its portion.” (10) The daughters of Zelophehad did as the LORD had commanded Moses: (11) Mahlah, Tirzah, Hoglah, Milcah, and Noah, Zelophehad’s daughters, were married to sons of their uncles, (12) marrying into clans of descendants of Manasseh son of Joseph; and so their share remained in the tribe of their father’s clan. (13) These are the commandments and regulations that the LORD enjoined upon the Israelites, through Moses, on the steppes of Moab, at the Jordan near Jericho.

(ב) ד"א ויקרב משה את משפטן, אמר ר' שמעון בן לקיש יודע היה משה רבינו את הדין הזה, אלא באו לפני שרי עשרות תחלה, אמרו להן דין של נחלה הוא, ואין זו שלנו, אלא של גדולים ממנו, באו לפני שרי חמשים, ראו שכיבדו אותן שרי עשרות, אמרו שרי חמשים אף [אנו] יש (שם) גדולים ממנו, וכן לשרי מאות, וכן לשרי אלפים, וכן לנשיאים, השיבו להם כולם כענין הזה, שלא רצו לפתוח פה בפני מי שגדול מהם, אמר משה אם אומר להם את הדין, אטול את גדולתם, אמר להם אף אני יש גדול ממני, לפיכך ויקרב משה את משפטן, השיבו כן בנו צלפחד דוברות (שם שם ז), שהודה הקב"ה לדיבורן.

(2) Another interpretation (of Numb. 27:5:) MOSES BROUGHT THEIR CAUSE <BEFORE THE LORD>. R. Simeon ben Laqish said: Our Master Moses knew this judgment, but they first came before chiefs of tens.35Tanh., Numb. 8:9. They said to them: It is a judgment concerning inheritance, and this is not for us but for those greater than we. They came before the chiefs of fifties. <When> they saw that the chiefs of ten had shown them honor, the chiefs of fifty said: [In our case] also there are {there} those greater than we. So also <they came before> the chiefs of hundreds, the chiefs of thousands, and the princes. They all responded to them in a similar way, because they did not want to open their mouths before one who was greater than they. Moses said: If I tell them the decision, I shall be appropriating all their dignity. He said to them: In my case also there is one greater than I. Therefore (in Numb. 27:5): MOSES BROUGHT THEIR CAUSE <BEFORE THE LORD>. He answered him with a yes (in vs. 7): THE DAUGHTERS OF ZELOPHEHAD SPEAK WHAT IS RIGHT. Thus the Holy One acknowledged their utterance.

In this Midrash, the Daughters of Zelophehad take their case through multiple levels of judges before it gets to Moses, and from there to God. Can you think of other cases which went through multiple levels of courts before being decided? Does this lens on the process behind the first case change your thinking about the second?

(א) אתה מוצא סנחריב הגלה את ישראל שלש גליות, ראשונה הגלה לראובני ולגדי ולחצי שבט המנשי, השניה שבט זבולון ושבט נפתלי, שנאמר כעת הראשון הקל ארצה שבולון וארצה נפתלי (ישעיה ח כג), והשלישית הגלה לשאר השבטים, שנאמר והאחרון הכביד (שם), נבוכדנצר אף הוא הגלה שלש גליות מן שבט יהודה ובנימין, בראשונה הגלה יהויקים, בשניה יהויכין, מה עשה קשר אותו (בקרובין) [בקרוכין] ומוקר לו, שנאמר הנני משלחך כגבירה, מה הגבירה הזו אדם מיקר לה, כך עשה לו נבוזראדן והגלה לצדקיהו, הרי שלש גליות, אמר הקב"ה בעולם הזה על ידי עונות גלו ישראל, אבל לעתיד לבא אם יהיה נדחך בקצה השמים משם יקבצך ה' אלהיך ומשם יקחך (דברים ל ד), ואומר ונפוצות יהודה יקבץ וגו' (ישעיה יא יב), ואומר ופדויי ה' ישובון ובאו ציון ברנה ושמחת עולם על ראשם ששון ושמחה ישיגו ונסו יגון ואנחה (שם לה י), ואומר כי נחם ה' ציון נחם כל חרבותיה וישם מדברה כעדן וערבתה כגן ה', ששון ושמחה ימצא בה תודה וקול זמרה (שם נא ג).

(1) You find that Sennacherib exiled Israel in three exiles.43Tanh., Numb. 10:13; Numb. R. 23:14; cf. Lam. R. Proem 5. First, he exiled the Reubenites, the Gadites, and half the tribe of Manasseh. Second, <came> the tribe of Zebulon and the tribe of Naphtali, as stated (in Is. 8:23 [9:1]): IN THE FORMER TIME HE ABASED THE LAND OF ZEBULON AND THE LAND OF NAPHTALI. Third, he exiled the rest of the tribes, as stated (ibid., cont.): AND LATER HE AFFLICTED <THE WAY OF THE SEA, THE OTHER SIDE OF THE JORDAN, GALILEE OF THE GENTILES>.44Translations of this verse vary, but the translation given here fits the sense of the midrash. Nebuchadnezzar also carried out three exiles with the tribes of Judah and Benjamin. In the first he exiled Jehoiakim <and> in the second, Jehoiachin. What did he do? He bound him in his carriage45Lat.: carruca; Gk.: karrouchion. and <there> he became dear to him.46In note 65 Buber suggests a translation such as, “and it was his favorite.” Thus it is stated: Behold, I am sending you away like a queen mother.47The text is not in Scripture, but cf. Jer. 29:2. Just as one honors the queen mother, so did Nebuzaradan act toward him. Then Nebuzaradan exiled Zedekiah, for a total of three exiles. The Holy one said: In this world Israel has gone into exile because of iniquities, but in the age to come (according to Deut. 30:4): EVEN IF YOUR BANISHMENT IS TO THE END OF THE HEAVENS, FROM THERE WILL THE LORD YOUR GOD GATHER YOU, EVEN FROM THERE WILL HE BRING YOU BACK. It also says (in Is. 11:12): AND HE SHALL GATHER THE DISPERSED OF JUDAH…. And it says (in Is. 35:10): AND THE RANSOMED OF THE LORD SHALL SHALL RETURN AND COME TO ZION WITH SINGING. EVERLASTING JOY SHALL BE UPON THEIR HEADS, THEY SHALL OBTAIN JOY AND GLADNESS, WHILE SORROW AND SIGHING SHALL FLEE AWAY. And it says (in Is. 51:3): TRULY THE LORD HAS COMFORTED ZION; HE HAS COMFORTED ALL ITS RUINS. HE HAS ALSO MADE ITS DESERT LIKE EDEN AND ITS DRY PLAIN LIKE THE GARDEN OF THE LORD. JOY AND REJOICING SHALL BE FOUND IN IT, THANKSGIVING AND THE SOUND OF MUSIC.

We are currently in the "Three Weeks" period leading up the Tisha B'Av, the commemoration of the destruction of the first and second Temples. This midrash connects the Torah portion with the destruction of the first Temple and the Babylonian exile. What do you think is the significance of "half of the tribe of Manasseh?"
