(יא) וַתִּשָּׁחֵ֥ת הָאָ֖רֶץ לִפְנֵ֣י הָֽאֱלֹהִ֑ים וַתִּמָּלֵ֥א הָאָ֖רֶץ חָמָֽס׃ (יב) וַיַּ֧רְא אֱלֹהִ֛ים אֶת־הָאָ֖רֶץ וְהִנֵּ֣ה נִשְׁחָ֑תָה כִּֽי־הִשְׁחִ֧ית כָּל־בָּשָׂ֛ר אֶת־דַּרְכּ֖וֹ עַל־הָאָֽרֶץ׃ (ס) (יג) וַיֹּ֨אמֶר אֱלֹהִ֜ים לְנֹ֗חַ קֵ֤ץ כָּל־בָּשָׂר֙ בָּ֣א לְפָנַ֔י כִּֽי־מָלְאָ֥ה הָאָ֛רֶץ חָמָ֖ס מִפְּנֵיהֶ֑ם וְהִנְנִ֥י מַשְׁחִיתָ֖ם אֶת־הָאָֽרֶץ׃

(11) And the earth was corrupt before God, and the earth was filled with violence. (12) And God saw the earth, and, behold, it was corrupt; for all flesh had corrupted their way upon the earth. . (13) And God said unto Noah: ‘The end of all flesh is come before Me; for the earth is filled with violence through them; and, behold, I will destroy them with the earth.

ותמלא הארץ חמס. גזל:

כי מלאה הארץ חמס. לא נחתם גזר דינם אלא על הגזל:

and the earth became full of violence: Heb. חָמָס, robbery. (other editions add: as it is said (Jonah 3:8): “and of the dishonest gain (הֶחָמָס) which is in their hands.”) - [Sanh. 108a]

for the earth has become full of violence: Their verdict was sealed only because of robbery. — [from Sanh. 108a]

Rabbi Samson Raphael Hirsch on Genesis 6:11-13

The Midrash teaches that they stole from one another in petty ways that were not subject to the authority of the courts. Though this not the gravest kind of sin, it is morally damaging in the extreme, because thievery within the letter of the law weakens the conscience and corrupts the social fabric.

אסור לו לאדם שיהנה מן העוה"ז בלא ברכה וכל הנהנה מן העוה"ז בלא ברכה מעל.אמר רב יהודה אמר שמואל כל הנהנה מן העוה"ז בלא ברכה כאילו נהנה מקדשי שמים שנא' (תהלים כד, א) לה' הארץ ומלואה ר' לוי רמי כתיב לה' הארץ ומלואה וכתיב (תהלים קטו, טז) השמים שמים לה' והארץ נתן לבני אדם לא קשיא כאן קודם ברכה

A man is forbidden to enjoy anything of this world without a benediction, and whoever does so commits sacrilege. Rab Judah said in the name of Samuel : Whoever enjoys anything of this world without a benediction is as though he had partaken of the holy things of Heaven ; as it is said, "The earth is the Lord's, and the fulness thereof" (Ps. xxiv. 1). R. Levi asked : t is written, "The earth is the Lord's and the fulness thereof," and it is written, "The heavens are the heavens of the Lord, but the earth hath He given to the children of men" (ibid. cxv. 16)! There is no contradiction ; Here, the verse that says that the earth is the Lord's refers to the situation before a blessing is recited, and here, where it says that He gave the earth to mankind refers to after a blessing is recited.

(כ) וַיְדַבֵּ֥ר ה' אֶל־מֹשֶׁ֥ה לֵּאמֹֽר׃ (כא) נֶ֚פֶשׁ כִּ֣י תֶחֱטָ֔א וּמָעֲלָ֥ה מַ֖עַל בַּה' וְכִחֵ֨שׁ בַּעֲמִית֜וֹ בְּפִקָּד֗וֹן אֽוֹ־בִתְשׂ֤וּמֶת יָד֙ א֣וֹ בְגָזֵ֔ל א֖וֹ עָשַׁ֥ק אֶת־עֲמִיתֽוֹ׃ (כב) אֽוֹ־מָצָ֧א אֲבֵדָ֛ה וְכִ֥חֶשׁ בָּ֖הּ וְנִשְׁבַּ֣ע עַל־שָׁ֑קֶר עַל־אַחַ֗ת מִכֹּ֛ל אֲשֶׁר־יַעֲשֶׂ֥ה הָאָדָ֖ם לַחֲטֹ֥א בָהֵֽנָּה׃ (כג) וְהָיָה֮ כִּֽי־יֶחֱטָ֣א וְאָשֵׁם֒ וְהֵשִׁ֨יב אֶת־הַגְּזֵלָ֜ה אֲשֶׁ֣ר גָּזָ֗ל א֤וֹ אֶת־הָעֹ֙שֶׁק֙ אֲשֶׁ֣ר עָשָׁ֔ק א֚וֹ אֶת־הַפִּקָּד֔וֹן אֲשֶׁ֥ר הָפְקַ֖ד אִתּ֑וֹ א֥וֹ אֶת־הָאֲבֵדָ֖ה אֲשֶׁ֥ר מָצָֽא׃ (כד) א֠וֹ מִכֹּ֞ל אֲשֶׁר־יִשָּׁבַ֣ע עָלָיו֮ לַשֶּׁקֶר֒ וְשִׁלַּ֤ם אֹתוֹ֙ בְּרֹאשׁ֔וֹ וַחֲמִשִׁתָ֖יו יֹסֵ֣ף עָלָ֑יו לַאֲשֶׁ֨ר ה֥וּא ל֛וֹ יִתְּנֶ֖נּוּ בְּי֥וֹם אַשְׁמָתֽוֹ׃
(20) And the LORD spoke unto Moses, saying: (21) If any one sin, and commit a trespass against the LORD, and deal falsely with his neighbour in a matter of deposit, or of pledge, or of robbery, or have oppressed his neighbour; (22) or have found that which was lost, and deal falsely therein, and swear to a lie; in any of all these that a man doeth, sinning therein; (23) then it shall be, if he hath sinned, and is guilty, that he shall restore that which he took by robbery, or the thing which he hath gotten by oppression, or the deposit which was deposited with him, or the lost thing which he found, (24) or any thing about which he hath sworn falsely, he shall even restore it in full, and shall add the fifth part more thereto; unto him to whom it appertaineth shall he give it, in the day of his being guilty.

מתני׳ הגוזל עצים ועשאן כלים ,צמר ועשאן בגדים משלם כשעת הגזלה.

גזל פרה מעוברת וילדה, רחל טעונה וגזזה משלם דמי פרה העומדת לילד,דמי רחל העומדת ליגזז.

גזל פרה ונתעברה אצלו וילדה רחל ונטענה אצלו וגזזה משלם כשעת הגזלה .

זה הכלל כל הגזלנים משלמין כשעת הגזלה:

If one steals pieces of wood and makes them into utensils or pieces of wool and makes them into garments, he pays their value as of the time of the robbery.

If one stole a pregnant cow and it gave birth, or a wool-laden ewe and he sheared it, he pays the value of a cow that stands to give birth or the value of a ewe that stands to be shorn.

If one stole a cow and it became pregnant while it was being held by him and it gave birth, he pays the value of the time of the robbery.

This is the rule: All robbers pay the value as of the time of the robbery.
