What was the big change? Rabbi Eliezer taught that they made a balcony and had the women sit upstairs and the men down stairs. Our Sages taught: At the outset the women were inside and the men outside but they came to falter due to lightheadedness [kalut rosh]. They decreed that the women sat outside and the men inside but they still faltered due to lightheadedness. They decreed that the women sat above and the men below.

Whenever men and women assembled, for example at a lecture or a wedding, Abaye would set up a partition of jugs between them so that if anyone attempted to pass from the men's section to the women's section or vice versa, the jugs would rattle and alert everyone. It is right according to our Torah law to listen to the voice of a woman in shul, in a place that men congregate, and the women’s voice goes from the women’s section to the men’s section?
The reason for this, is that we believe that all prayer and praise and thanksgiving should not be mixed with improper thoughts. And because of this we separate the women from the men in shul, to make sure they do not come to think improper thoughts during the time of prayer. And we learn this from the water libation ceremony that is spoken about in Tractate Sukka where they made sure the women were above and the men below so they would not come to kalut rosh. And it is said there on 52a, as it says: “And the land shall mourn, every family apart: The family of the house of David apart, and their wives apart; the family of the house of Nathan apart, and their wives apart.” (Zecharia 12:12). And it is a kal v’chomer- here where they are talking about a eulogy where there is no evil inclination the Torah tells us that the men were separate, and here that we are talking about happiness, where there is an evil inclination, all the more so there should be a separation.

We are commanded to create a separation between the men’s section and the women’s section like there was in the Beit HaMikdash, where they had a separate space for men and a space for women....and before us we need to create a decree so that the men do not see the women because that brings them to have kalut rosh and other sins.
And look in the Tosfot Yom Tov about those who break this law, as one should not do this in shul, because it is seen as a mikdash miat (see Chatam Sofer, Orech Chaim 28).

א) בהא דשאילנא לבאר ענין המחיצה שצריך להיות בין אנשים לנשים בביהכ"נ וכמה הוא שיעור גובהה אליבא דהלכתא משום שיש מקומות במדינתנו זו שהתחילו לפרוץ בענין המחיצה שבין אנשים לנשים בביהכ"נ שנשאר לנו למקדש מעט ואפשר שאין חשודים שיעברו אדינא אלא מחסרון ידיעת חומר האיסור ולכן רוצה כתר"ה שאבאר מקור הדין וחומר האיסור ושיעור גובה המחוייב.

... וממילא חזינן מסוגיא דסוכה /נ"א/ דאף אם היתה מחיצה אבל כזו שאפשר לבא לידי קלות ראש יש עדיין אותו האיסור מדאורייתא, דהא אף בראשונה שהיו נשים מבפנים ואנשים מבחוץ פרש"י שהנשים היו בעזרת נשים והאנשים היו ברחבה של הר הבית ובחיל, שהיתה מחיצה גדולה ביניהם בדין מחיצה אבל כיון שהוצרכו לעמוד נגד השערים הפתוחים כדי לראות את השמחה ראו שבאו לידי קלות ראש ולא הועילה המחיצה וא"כ היה עדיין אסור מדאורייתא שלכן הותר לעשות הגזוזטרא שמזה ראיה שהוא מדאורייתא כדבארתי...

I have been asked to talk about the issue of mechitza that must be between men and women in shul, and how tall it must be according to halacha, because it seems that there are places in this country that are lax in the separation between men and women in shul, but it should stay a mikdash miat...
The law is that even if men are on one side and women are on another is it prohibited for them to be there without a mechitza, which according to my opinion is a Biblical law.
We can see in TB Sukkah 51a where they made a women’s section on the first day of Sukkot so that the women would be on top and the men on the bottom, and it is explicit that one can’t add something to the Temple. And according to Rashi this proves that it is necessary to separate men and women.
...And we can also learn from TB Sukkah that even if there is a mechitza but it is still possible to have kalut rosh (lightness of mind) there still is a biblical prohibition, because even in the first Temple women were inside and men were outside. According to Rashi this means that women were in the Ezrat Nashim (women’s courtyard) and the men were in the main courtyard on the Temple Mount; that there was a large separation between them because of the laws of separation. But since they needed to stand facing the gates in order to see the celebration, they noticed that they would have kalut rosh and they didn’t raise the divider. And if so, it was still biblically prohibited, and so to they allowed the balcony to be built to prevent this...
And so we need to say that the prohibition is about kalut rosh, and they thought in the beginning that they would have kalut rosh because the men would want to look at the women... and if they were looking in their
direction then it was a way that we were not worried that they would look for the purpose of pleasure which is prohibited... But when they saw that this brought about a lot of kalut rosh meaning that there were many conversations between the sexes, and touching of hands, etc. they made a decree that women would be behind or above so that the men would not be able to look at them (Tosfot TB Sanhedrin 20). But still they fell into kalut rosh because there was not a divided at the gates, and it was on the side of the women who were watching the men enter, and so to when we need a mechitza it must be a full divider...
And it seems that we would need a balcony according to the Torah, that the women would be upstairs and the men on the main floor, because this is the only way they would not interact...
And so in shuls that have both men and women, it is better that there is a balcony for the women. And if for some reason it is difficult to build a balcony there needs to be a real divider between the men and women, so they do not fall into having kalut rosh...
And so also with a mechitza of 20 tefachim (approx. 6 feet) is not sufficient for the reason of kalut rosh because they can still talk to one another and touch hands, and there is no greater kalut rosh than that, and they will think that they are actually interacting, which is a biblical prohibition...

והנה שאלת המחיצה כבר נתעוררה בדור הקודם ובספר לב העברי ח"ש נדפס פסק דין על כך אשר עליו חתומים למעלה משבעים גאונים ובראשם...אסור לעשות המחיצה המבדלת בין עזרת נשים ואנשים רק באופן אשר לא יוכל להסתכל אנשים בנשים, רק יעשו כנהוג בימי קדם, וכן אם כבר נעשה לא יכנסו בה עכ"ל...
בגדולה מזאת מצאתי בשו"ת מהר"ם שיק חאו"ח סי' ע"ז שנשאל מרב אחד על אודות כמה פריצי עם שמאיימים שאם לא יתנו להם להפיק זממם להרוס דבר המפסיק בין עזרת נשים לעזרת אנשים שלא תהא סגור לגמרי בקרשים רק בעמודים ויוכלו לראות ולהראות...חלילה לכם להכשרים לשתוק ע"ד הפריצות שעשו החצופים ההם כי מדינא אנו מחויבים לעשות הפסק בין עזרת אנשים לעזרת נשים כמו שהי' בבהמ"ק...
וזה שלא נזכר בשו"ע מדין עשיית מחיצה בין ביהכ"נ לעז"נ =בית הכנסת לעזרת נשים= הוא מפני שאז לא היתה קיימת בעיה כזאת בכלל, כי כל בתי הכנסיות היו עשוים באופן שכותל עב היה מפסיק בין ביהכ"נ לעז"נ והיתה מגעת מהרצפה ועד הגג וקול התפלה היה מגיע להם דרך חלונות קטנים או דרך חלולים חלולים, שהיו עשוים בכותל, ולא עלה על הדעת כי תתקיים בכלל בעיא כזאת אם צריכים מחיצה.
חושבני שמהאמור מספיק כבר להווכח על חומר החיוב של עשיית מחיצה מבדלת בין בית הכנסת לבין עזרת נשים באופן שהאנשים לא יוכלו לבוא לידי הסתכלות. אחיך אוהבך בלו"נ מברך אתכם בברכת כתיבה וחתימה טובה אליעזר יהודא וולדינברג.

And even though in chapter 8, halacha 12 of “The Laws of Lulav”, Rambam writes that the reason is so that the sexes do not mix. But in Perush HaMishna he says that the reason is so that the men would not look at the women, and it is only possible with a divider that is as tall as a person or curtains. It is also discussed in Tosfot Yom Tov in TB Sukkot, who brings the Rambam’s Perush al HaMishna and adds: when men look at women it brings them to have kalut rosh....
And here the question of the mechitza was already asked in the previous generation in the book Lev HaIvri where many great rabbis signed that is prohibited to make a mechitza that separates the women’s and men’s section just in a way that the men are not able to see the women, and if it was done that way then one should not enter...
I found in the Sh”ut Maharam Shick who was asked a question from those corrupt ones who want to break the separation between the women’s section and the men’s section, that it should not be fully closed by boards, but just having pillars that one can see through and been seen...God forbid that you would allow this to take place, because we say that it is obligatory to have a separation between men and women like there was in the Beit HaMikdash...
And the fact that the Shulchan Aruch doesn’t mention the law of putting up a mechitza in a shul, then they did not have these problems, because all shuls had a thick wall between the shul and the women’s section, and the women would hear from small windows in the wall, and so the question of a mechitza was never asked.
I think that it is obligatory to have a mechitza that separates the women and the men, in a way that the men will not come to see the women...

The separation of the sexes in the synagogue is a basic tenet of our faith. It dates back to the very dawn of our religious halakhic community and constitutes a Pentateuchic injunction (issur de-Oraita) which can never be abandoned by any legislative act on the part of a rabbinic or lay body, regardless of its numeric strength or social prominence. What was decreed by God can never be undone by human hand.

יוצא לנו שלפרה"מ בודאי היו הנשים נסתרות כולן מאחורי שקופים אטומים שהם שבכה לפי פרוש המאירי בדברי הרמב,ם. ואולם במשנה תורה לא הזכיר ענין זה... ולשון זה הוא ענין שנוי רשות ומחיצת י' טפחים... וכן בכל תפוסות ישראל בכל הדורות לא נמצאת עזרת נשים שלא היתה מובדלת ברשות מעזרת הגברים וברוב המקרים היו חדרים נפרדים לגמרי או עליות ולא עלה על דעת מישהו לאמר ששנוי רשות הוא ענין טפל ומניעת הסתכלות בלבד היא העיקר וכמו שכתבנו שעזרת נשים בביהמ"ק היתה בשנוי רשות מעזרת ישראל ומהחיל ומשם למדו לעיקר עזרת נשים בביהכ"נ....

And with this there is no surprise as the idea of mechitza was not mentioned in the writings of the Rishonim , and only in the past years are we really talking about the details of mechitza...
It seems that according to the Perush al HaMishna women were definitely hidden behind opaque curtains, as mentioned by the Meiri on Rambam. And even though in the Mishna Torah did not mention this law...this is about changing the height to be 10 tefachim (appox. 3 feet)... and so in all communities there was never found a women’s section that was not separated from the men’s, and in most situation there were different rooms completely or were in an upstairs balcony, and no one ever thought to say that the reason was only for lessening the looking, and like they wrote about the women’s section in the Beit HaMikdash there was a differentiation of space, and this is where we learn the reason for the women’s section in shul...

...ענין מחיצה הוא מדבריהם ושלא כמו שכתב בשו"ת אגרות משה חלק אורח חיים סימן ל"ט שהוא מדאורייתא... ויותר מזה יש לדעת שאפילו מדברי קבלה לא בעי מחיצה שהרי למדו מזכריה פרק י"ב וספדה הארץ משפחות משפחות לבד משפחת בית דוד לבד ונשיהם לבד וגו' עכ"ל ואין בלשון הכתוב זכר למחיצה ורק שלא יהיו בערבוביא ממש נשים בין אנשים אלא אלה בצד זה ואלה בצד זה... וכן מוכח מן התוספתא שבסוכה פרק ד' הלכה א' נשים יושבות ורואות בשמחת בית השואבה ולא היו מעעורבין עכ"ל וכלשון המשנה במדות פרק ב' התקינו שנשים יושבות מלמעלה ואנשים מלמטה ולא היו מעורבין עכ"ל...
והוצרכתי להאריך בזה מפני שראיתי באחרונים שמרהיטת לשונם משמע שענין מחיצה מפורש בכתוב ויש שכתבו שמן הכתוב משמע אפילו מניעת ההסתכלות...

...the issue of mechitza is a rabbinic decree and not like Igrat Moshe Orech Chaim 39 who says it is a biblical decree..and more than this it might be that according to Kabbala they don’t mention the mechitza, as we learned in Zecharia chapter 12 “And the land shall mourn, every family apart: The family of the house of David apart, and their wives apart; the family of the house of Nathan apart, and their wives apart.” The text does not mention a mechitza, rather just says that the men and women did not interact with each other...and this can be proved by the Tosphta Sukka 4:1 “women would sit and watch the water libation ceremony and would not interact” and like the Mishna Midot chapter 2, they made a decree that the women would sit upstairs and the men would sit below and would not intermingle...
I wanted to address this issue because I saw many scholars saying that the issue of mechitza is expressed in the Torah, and there are those who wrote that it was to prevent the genders from looking at each other...
