The Solution: Putting Women Back into the Text

לבית יעקב. אֵלּוּ הַנָּשִׁים, תֹּאמַר לָהֶן בְּלָשׁוֹן רַכָּה (מכילתא):

ותגיד לבני ישראל. עֳנָשִׁין וְדִקְדּוּקִים פָּרֵשׁ לַזְּכָרִים, דְּבָרִים הַקָּשִׁין כְּגִידִין (שבת פ"ז):

לבית יעקב TO THE HOUSE OF JACOB — This denotes the women — to them you shall speak in gentle language (Mekhilta d'Rabbi Yishmael 19:3).

ותגיד לבני ישראל AND TELL THE CHILDREN (lit., the sons) OF ISRAEL — explain to the men the punishments and the details of the commandments in words that are as hard (distasteful) as wormwood (גידין) (cf. Shabbat 87a; Midrash לקח טוב‎).

Ladies First

(ב) כֹּה תֹאמַר לְבֵית יַעֲקֹב, אֵלּוּ הַנָּשִׁים, אָמַר לוֹ אֱמֹר לָהֶם רָאשֵׁי דְבָרִים שֶׁהֵם יְכוֹלוֹת לִשְׁמֹעַ, וְתַגֵּיד לִבְנֵי יִשְׂרָאֵל, אֵלּוּ הָאֲנָשִׁים, אָמַר לוֹ אֱמֹר לָהֶם דִּקְדּוּקֵי דְּבָרִים שֶׁהֵם יְכוֹלִים לִשְׁמֹעַ.

דָּבָר אַחֵר, לָמָּה לַנָּשִׁים תְּחִלָּה, שֶׁהֵן מִזְדָּרְזוֹת בְּמִצְווֹת.

דָּבָר אַחֵר, כְּדֵי שֶׁיְהוּ מַנְהִיגוֹת אֶת בְּנֵיהֶן לַתּוֹרָה.

(2) So you shall say to the house of Jacob" (Exodus 19:3) -- these are the women. God said to Moshe, speak to them generally, so that they can understand. "And tell to the children of Israel" (Exodus 19:3) -- these are the men. God said to Moshe, say to them the particulars, so that they can understand.

Another explanation: why were the women first? Since they are keen with mitzvot.

Another explanation, so that they could accustom their children to Torah.

First Commandment: No Difference
(ב) אָֽנֹכִ֖י֙ יקוק אֱלֹקֶ֑֔יךָ אֲשֶׁ֧ר הוֹצֵאתִ֛יךָ מֵאֶ֥רֶץ מִצְרַ֖יִם מִבֵּ֣֥ית עֲבָדִֽ֑ים׃
(2) I the LORD am your God who brought you out of the land of Egypt, the house of bondage:
(ו) אָֽנֹכִי֙ יקוק אֱלֹקֶ֔יךָ אֲשֶׁ֧ר הוֹצֵאתִ֛יךָ מֵאֶ֥רֶץ מִצְרַ֖יִם מִבֵּ֣֥ית עֲבָדִֽ֑ים׃
(6) I the LORD am your God who brought you out of the land of Egypt, the house of bondage:
Second Commandment

(ג) לֹֽ֣א יִהְיֶֽה־לְךָ֛֩ אֱלֹקִ֥֨ים אֲחֵרִ֖֜ים עַל־פָּנָֽ֗יַ׃

(3) You shall have no other gods besides Me.

(ז) לֹ֣א יִהְיֶ֥ה־לְךָ֛֩ אֱלֹקִ֥֨ים אֲחֵרִ֖֜ים עַל־פָּנָֽ֗יַ׃

(7) You shall have no other gods beside Me.

(ד) לֹֽ֣א תַֽעֲשֶׂ֨ה־לְךָ֥֣ פֶ֣֙סֶל֙ ׀ וְכָל־תְּמוּנָ֡֔ה אֲשֶׁ֤֣ר בַּשָּׁמַ֣֙יִם֙ ׀ מִמַּ֡֔עַל וַֽאֲשֶׁ֥ר֩ בָּאָ֖֨רֶץ מִתַָּ֑֜חַת וַאֲשֶׁ֥֣ר בַּמַּ֖֣יִם ׀ מִתַּ֥֣חַת לָאָֽ֗רֶץ׃

(ה) לֹֽא־תִשְׁתַּחְוֶ֥֣ה לָהֶ֖ם֮ וְלֹ֣א תָעָבְדֵ֑ם֒ כִּ֣י אָֽנֹכִ֞י יקוק אֱלֹקֶ֙יךָ֙ אֵ֣ל קַנָּ֔א פֹּ֠קֵד עֲוֺ֨ן אָבֹ֧ת עַל־בָּנִ֛ים עַל־שִׁלֵּשִׁ֥ים וְעַל־רִבֵּעִ֖ים לְשֹׂנְאָֽ֑י׃

(ו) וְעֹ֥֤שֶׂה חֶ֖֙סֶד֙ לַאֲלָפִ֑֔ים לְאֹהֲבַ֖י וּלְשֹׁמְרֵ֥י מִצְוֺתָֽי׃

(4) You shall not make for yourself a sculptured image, or any likeness of what is in the heavens above, or on the earth below, or in the waters under the earth.

(5) You shall not bow down to them or serve them. For I the LORD your God am an impassioned God, visiting the guilt of the parents upon the children, upon the third and upon the fourth generations of those who reject Me,

(6) but showing kindness to the thousandth generation of those who love Me and keep My commandments.

Third Commandment

(ח) לֹֽ֣א־תַעֲשֶׂ֥ה־לְךָ֥֣ פֶ֣֙סֶל֙ ׀ כָּל־תְּמוּנָ֔֡ה אֲשֶׁ֤֣ר בַּשָּׁמַ֣֙יִם֙ ׀ מִמַּ֔֡עַל וַאֲשֶׁ֥ר֩ בָּאָ֖֨רֶץ מִתָּ֑֜חַת וַאֲשֶׁ֥ר בַּמַּ֖֣יִם ׀ מִתַּ֥֣חַת לָאָֽ֗רֶץ׃

(ט) לֹא־תִשְׁתַּחֲוֶ֥֣ה לָהֶ֖ם֮ וְלֹ֣א תָעָבְדֵ֑ם֒ כִּ֣י אָנֹכִ֞י יקוק אֱלֹקֶ֙יךָ֙ אֵ֣ל קַנָּ֔א פֹּ֠קֵד עֲוֺ֨ן אָב֧וֹת עַל־בָּנִ֛ים וְעַל־שִׁלֵּשִׁ֥ים וְעַל־רִבֵּעִ֖ים לְשֹׂנְאָֽ֑י׃

(י) וְעֹ֤֥שֶׂה חֶ֖֙סֶד֙ לַֽאֲלָפִ֑֔ים לְאֹהֲבַ֖י וּלְשֹׁמְרֵ֥י מצותו [מִצְוֺתָֽי׃]

(יא) לֹ֥א תִשָּׂ֛א אֶת־שֵֽׁם־יקוק אֱלֹקֶ֖יךָ לַשָּׁ֑וְא כִּ֣י לֹ֤א יְנַקֶּה֙ יקוק אֵ֛ת אֲשֶׁר־יִשָּׂ֥א אֶת־שְׁמ֖וֹ לַשָּֽׁוְא׃ (ס)

Fourth Commandment

(ח) זָכ֛וֹר֩ אֶת־י֥֨וֹם הַשַּׁבָּ֖֜ת לְקַדְּשֽׁ֗וֹ׃

(8) Remember the sabbath day and keep it holy.

(יב) שָׁמ֣֛וֹר אֶת־י֥וֹם֩ הַשַׁבָּ֖֨ת לְקַדְּשׁ֑֜וֹ כַּאֲשֶׁ֥ר צִוְּךָ֖֣ ׀ יקוק אֱלֹקֶֽ֗יךָ׃

(12) Guard the sabbath day and keep it holy, as the LORD your God has commanded you.

(א)...ואמר זכור את יום השבת לקדשו ובמשנה תורה (דברים ה יב) כתוב שמור את יום השבת לקדשו. ורבותינו אמרו בזה (ר''ה כז.) זכור ושמור בדבור אחד נאמרו, ולא הקפידו בלשונות אחרים שנתחלפו להם. והכונה להם ז''ל, כי ''זכור'' מצות עשה, צוה שנזכור יום השבת לקדשו ולא נשכחהו, ו''שמור'' אצלם מצות לא תעשה, שכל מקום שנאמר השמר פן ואל אינו אלא לא תעשה (עירובין צו.), יזהיר שנשמור אותו לקדשו שלא נחללהו

(1) ...And it is written "Remember the Sabbath day to sanctify it," while Deutoronomy (5:12) has "Guard the Sabbath day to sanctify it." Our sages comment on this (TB R"H 27a): "'Remember' and 'Guard' were said simultaneously." They were not concerned about other linguistic changes between the commandments in Exodus & Deutoronomy. Our Sages of blessed memory explained this one, because "remember" is a positive commandment -- that we are to remember the Sabbath day and sanctify it without forgetting it -- but they interpret "guard" as a negative commandment; since the biblical words "guard," "lest," and "don't" always imply a negative commandment (TB Eruvin 96a). ["Guard" instructs us to] be careful to observe it and sanctify it, that we do not desecrate it.

(ט) שֵׁ֤֣שֶׁת יָמִ֣ים֙ תַּֽעֲבֹ֔ד֮ וְעָשִׂ֖֣יתָ כָּל־מְלַאכְתֶּֽךָ֒׃

(9) Six days you shall labor and do all your work,

(יג) שֵׁ֤֣שֶׁת יָמִ֣ים֙ תַּֽעֲבֹ֔ד֮ וְעָשִׂ֖֣יתָ כָּֿל־מְלַאכְתֶּֽךָ֒׃

(13) Six days you shall labor and do all your work,

(י) וְי֙וֹם֙ הַשְּׁבִיעִ֔֜י שַׁבָּ֖֣ת ׀ לַיקוק אֱלֹקֶ֑֗יךָ לֹֽ֣א־תַעֲשֶׂ֣֨ה כָל־מְלָאכָ֡֜ה אַתָּ֣ה ׀ וּבִנְךָֽ֣־וּ֠בִתֶּ֗ךָ עַבְדְּךָ֤֨ וַאֲמָֽתְךָ֜֙ וּבְהֶמְתֶּ֔֗ךָ וְגֵרְךָ֖֙ אֲשֶׁ֥֣ר בִּשְׁעָרֶֽ֔יךָ׃

(יא) כִּ֣י שֵֽׁשֶׁת־יָמִים֩ עָשָׂ֨ה יקוק אֶת־הַשָּׁמַ֣יִם וְאֶת־הָאָ֗רֶץ אֶת־הַיָּם֙ וְאֶת־כָּל־אֲשֶׁר־בָּ֔ם וַיָּ֖נַח בַּיּ֣וֹם הַשְּׁבִיעִ֑י עַל־כֵּ֗ן בֵּרַ֧ךְ יקוק אֶת־י֥וֹם הַשַּׁבָּ֖ת וַֽיְקַדְּשֵֽׁהוּ׃

(10) but the seventh day is a sabbath of the LORD your God: you shall not do any work—you, your son or daughter, your male or female slave, or your cattle, or the stranger who is within your settlements.

(11) For in six days the LORD made heaven and earth and sea, and all that is in them, and He rested on the seventh day; therefore the LORD blessed the sabbath day and hallowed it.

(יד) וְי֙וֹם֙ הַשְּׁבִיעִ֜֔י שַׁבָּ֖֣ת ׀ לַיקוק אֱלֹקֶ֑֗יךָ לֹ֣א תַעֲשֶׂ֣ה כָל־מְלָאכָ֡ה אַתָּ֣ה וּבִנְךָֽ־וּבִתֶּ֣ךָ וְעַבְדְּךָֽ־וַ֠אֲמָתֶךָ וְשׁוֹרְךָ֨ וַחֲמֹֽרְךָ֜ וְכָל־בְּהֶמְתֶּ֗ךָ וְגֵֽרְךָ֙ אֲשֶׁ֣ר בִּשְׁעָרֶ֔יךָ לְמַ֗עַן יָנ֛וּחַ עַבְדְּךָ֥ וַאֲמָתְךָ֖ כָּמֽ֑וֹךָ׃

(טו) וְזָכַרְתָּ֞֗ כִּ֣י־עֶ֤֥בֶד הָיִ֣֙יתָ֙ ׀ בְּאֶ֣רֶץ מִצְרַ֔֗יִם וַיֹּצִ֨אֲךָ֜֩ יקוק אֱלֹקֶ֤֙יךָ֙ מִשָּׁ֔ם֙ בְּיָ֤֥ד חֲזָקָ֖ה֙ וּבִזְרֹ֣עַ נְטוּיָ֑֔ה עַל־כֵּ֗ן צִוְּךָ֙ יקוק אֱלֹקֶ֔יךָ לַעֲשׂ֖וֹת אֶת־י֥וֹם הַשַׁבָּֽת׃ (ס)

(14) but the seventh day is a sabbath of the LORD your God; you shall not do any work—you, your son or your daughter, or your male or female slave, your ox or your donkey, or any of your cattle, or the stranger in your settlements, so that your male and female slave may rest as you do.

(15) Remember that you were a slave in the land of Egypt and the LORD your God freed you from there with a mighty hand and an outstretched arm; therefore the LORD your God has commanded you to observe the sabbath day.

Fifth Commandment

כַּבֵּ֥ד אֶת־אָבִ֖יךָ וְאֶת־אִמֶּ֑ךָ לְמַ֙עַן֙ יַאֲרִכ֣וּן יָמֶ֔יךָ עַ֚ל הָאֲדָמָ֔ה אֲשֶׁר־יקוק אֱלֹקֶ֖יךָ נֹתֵ֥ן לָֽךְ׃ (ס)

Honor your father and your mother, that you may live long on the land that the LORD your God is assigning to you.

כַּבֵּ֤ד אֶת־אָבִ֙יךָ֙ וְאֶת־אִמֶּ֔ךָ כַּאֲשֶׁ֥ר צִוְּךָ֖ יקוק אֱלֹקֶ֑יךָ לְמַ֣עַן ׀ יַאֲרִיכֻ֣ן יָמֶ֗יךָ וּלְמַ֙עַן֙ יִ֣יטַב לָ֔ךְ עַ֚ל הָֽאֲדָמָ֔ה אֲשֶׁר־יקוק אֱלֹקֶ֖יךָ נֹתֵ֥ן לָֽךְ׃ (ס)

Honor your father and your mother, as the LORD your God has commanded you, that your days will be lengthened may be long endure, and that you may fare well, in the land that the LORD your God is assigning to you.

Sixth, Seventh, Eighth and Ninth Commandments

לֹ֥֖א תִּֿרְצָֽ֖ח׃ (ס) לֹ֣֖א תִּֿנְאָֽ֑ף׃ (ס) לֹ֣֖א תִּֿגְנֹֽ֔ב׃ (ס) לֹֽא־תַעֲנֶ֥ה בְרֵעֲךָ֖ עֵ֥ד שָֽׁקֶר׃ (ס)

You shall not murder. You shall not commit adultery. You shall not steal. You shall not bear false witness against your neighbor.

לֹ֥֖א תִּֿרְצָֽח׃ (ס) וְלֹ֖֣א תִּֿנְאָֽ֑ף׃ (ס) וְלֹ֖֣א תִּֿגְנֹֽ֔ב׃ (ס) וְלֹֽא־תַעֲנֶ֥ה בְרֵֽעֲךָ֖ עֵ֥ד שָֽׁוְא׃ (ס)

לֹ֥א תַחְמֹ֖ד בֵּ֣ית רֵעֶ֑ךָ לֹֽא־תַחְמֹ֞ד אֵ֣שֶׁת רֵעֶ֗ךָ וְעַבְדּ֤וֹ וַאֲמָתוֹ֙ וְשׁוֹר֣וֹ וַחֲמֹר֔וֹ וְכֹ֖ל אֲשֶׁ֥ר לְרֵעֶֽךָ׃ (פ)

You shall not covet your neighbor’s house: you shall not covet your neighbor’s wife, or his male or female slave, or his ox or his ass, or anything that is your neighbor’s.

וְלֹ֥א תַחְמֹ֖ד אֵ֣שֶׁת רֵעֶ֑ךָ (ס) וְלֹ֨א תִתְאַוֶּ֜ה בֵּ֣ית רֵעֶ֗ךָ שָׂדֵ֜הוּ וְעַבְדּ֤וֹ וַאֲמָתוֹ֙ שׁוֹר֣וֹ וַחֲמֹר֔וֹ וְכֹ֖ל אֲשֶׁ֥ר לְרֵעֶֽךָ׃ (ס)

You shall not covet your neighbor’s wife. You shall not crave your neighbor’s house, or his field, or his male or female slave, or his ox, or his ass, or anything that is your neighbor’s.

אָמַר רַבִּי תַּחְלִיפָא דְּקֵיסָרִין, אָמַר הַקָּדוֹשׁ בָּרוּךְ הוּא כְּשֶׁבָּרָאתִי אֶת הָעוֹלָם, לֹא צִוִּיתִי אֶלָּא לְאָדָם הָרִאשׁוֹן, וְאַחַר כָּךְ נִצְטַוֵּית חַוָּה וְעָבְרָה וְקִלְקְלָה אֶת הָעוֹלָם, עַכְשָׁיו אִם אֵינִי קוֹרֵא לַנָּשִׁים תְּחִלָּה, הֵן מְבַטְּלוֹת אֶת הַתּוֹרָה, לְכָךְ נֶאֱמַר: כֹּה תֹאמַר לְבֵית יַעֲקֹב.

Rabbi Tachlifa Dekeisarin ["kingmaker"?] said, the Holy Blessed One said 'When I created the world, I commanded only the First Man; and after that Chava was commanded, and she transgressed and corrupted the world. Now, if I do not call to the women first, they will nullify the Torah.' So it says, "So say to the House of Jacob".
