(16) Thou shalt not go up and down as a talebearer among thy people; neither shalt thou stand idly by the blood of thy neighbour: I am the LORD.

(10) Tsaraat is a name given collectively to many different matters that are not similar to each other. As, behold, the whitening of a person's skin is called tsaraat and the falling out of a little bit of head or beard hair is [also] called tsaraat and [even] the change of the hue of clothing or houses is called tsaraat. This change mentioned with clothing and houses that the Torah collectively called tsaraat is not [like] the way of the world, but rather it is a sign and a wonder that [existed] in Israel to caution them about evil speech (lashon hara), such that the walls of the one that spoke evil speech would change [color]. If he repented, the house would become pure. [But] if he persisted in his evil until his house was broken down, the leather vessels that he would sit and recline upon would change [color]. If he repented, they would become pure. [But] if he persisted in his evil until they were burned, his skin would change [color] and he would become infested with tsaraat, and he would be isolated and [his condition would be] publicized until he would not be involved in the speech of the evildoers, which is mockery and evil speech. And about this matter the Torah cautions and says beware of the plague of tsaraat: "Remember that which the Lord, your God, did to Miriam on the way" (Deuteronomy 24:9). Behold, it is saying, "Reflect upon what happened to Miriam the prophetess, who spoke about her brother." She was older than him and raised him on her knees and endangered herself to save him at the sea, and she did not speak in his derision but rather erred in comparing him to other prophets - and he was not [even] exacting about all of these things, as it is stated (Numbers 12:3), "And the man, Moshe, was very humble." And nonetheless, she was immediately punished with tsaraat. All the more so is it with silly evil people who frequently speak boastfully and about [supposed] wonders. Therefore, it is fitting for the one who wants to guide his ways to distance himself from their gatherings and from speaking with them, so as not to be snagged by the net of evildoers and their foolishness. And this is the way of the gatherings of scoffers: At first, they speak much about useless things, as the matter is stated (Proverbs 5:2), "and the voice of a knave is with many words." And from this, they come to speak derisively about the righteous, as the matter is stated (Psalms 31:19), "Silence the lips of falsehood, that speak harshly about the righteous." And from this, they will be accustomed to speaking about prophets [derisively] and to cast a doubt upon their words, as the matter is stated (II Chronicles 36:16), "They would insult the messengers of God, and disgrace His words and confound His prophets." And from this, they come to speak [derisively] about God and denying a principle of faith, as the matter is stated (II Kings 17:9), "And the Children of Israel covered up things about the Lord, their God, that were not so." And behold, it states, (Psalms 73:9), "They have set their mouths against the heavens and their tongues walk upon the earth:" Who caused them to set against the heavens their mouths? Their tongue that first walked upon the earth - which is the conversation of the evildoers, which causes them to sit at corners and sit at the gatherings of ignoramuses and sit at parties with drinkers. But the conversation of the proper ones of Israel is only in the words of Torah and wisdom. Therefore, the Holy One, blessed be He, helps their hand and grants them merit in it, as it is stated (Malachi 3:16), "Then those that fear the Lord spoke, one man to his fellow; and the Lord listened and heard, and a book of remembrance was written in front of Him for those that feared the Lord and those that gave importance to His name." The Laws of Defilement by Leprosy have been completed.
(undefined) And now I shall begin, with the help of the Blessed Lrd to explain how many positive commandments one transgresses in speaking lashon hara and rechiluth, as we projected above.
(NaN) One who bears tales against his friend, aside from transgressing the negative commandments we mentioned above, also transgresses several positive commandments, which I shall explain, with the help of the Blessed One, one by one.
(NaN) (1) He transgresses thereby (Devarim 24:9): "Remember what the Lrd your Gd did to Miriam on the way when you went out of Egypt." The Torah exhorted us hereby that we mention verbally, always, the great punishment [leprosy] that the Blessed Lrd brought upon the tzadeketh, Miriam the prophetess — who spoke only about her brother, whom she loved as her soul, whom she raised on her knees, and for whom she endangered her life, to rescue him from the Nile. And she did not speak in denigration of him, but only compared him to other prophets. And she did not speak so to his face to shame him, and not in public, but only to her brother Aaron, privately. And he [Moses] was not offended by all this, viz. (Bamidbar 12:3): "And the man Moses was extremely humble, more than any man on the face of the earth" — in spite of which all her good deeds did not avail her and she was punished with leprosy for this. How much more so will other people, the fools, who are prolix in speaking "great and awesome things" against their friends, be severely punished for this.
(א) (א) יֵשׁ דְּבָרִים שֶׁאֲסוּרִין מִטַּעַם אֲבַק לָשׁוֹן הָרָע, כְּגוֹן שֶׁאוֹמֵר, מִי הָיָה אוֹמֵר עַל פְּלוֹנִי, שֶׁיִּהְיֶה כְּמוֹ שֶׁהוּא עַתָּה אוֹ שֶׁאוֹמֵר, שִׁתְקוּ מִפְּלוֹנִי, (ב) אֵינִי רוֹצֶּה לְהוֹדִיעַ מָה אֵרַע וּמַה יִּהְיֶה, וְכַיּוֹצֵּא בִּדְבָרִים אֵלּוּ. וְכֵן הַמְסַפֵּר (ג) בְּשִׁבְחוֹ שֶׁל חֲבֵרוֹ בִּפְנִי שׂוֹנְאָיו, גַּם כֵּן בִּכְלַל אֲבַק לָשׁוֹן הָרָע הוּא, דְּזֶה גּוֹרֵם לָהֶם, שֶׁיְּסַפְּרוּ בִּגְנוּתוֹ* . וְאִם (ה) הוּא מַרְבֶּה לְסַפֵּר בְּשִׁבְחוֹ, אֲפִלּוּ שֶׁלֹּא בִּפְנֵי שׂוֹנְאָיו אָסוּר, כִּי עַל יְדֵי זֶה רָגִיל בְּעַצְמוֹ לְגַנּוֹתוֹ לְבַסוֹף לוֹמַר: חוּץ מִמִּדָּה רָעָה זוֹ שֶׁיֵּשׁ לוֹ, אוֹ שֶׁהַשּׁוֹמְעִין יְשִׁיבוּהוּ: לָמָּה אַתָּה מַרְבֶּה בְּשִׁבְחוֹ וַהֲלֹא מִדַּת כָּךְ וְכָךְ בְּיָדוֹ?
(1) There are things which are forbidden because of the "dust" of lashon hara. As when one says about another: "Who would have said about Ploni that he would be the way he is now!" or "Don't talk about Ploni. I don't want to talk about what happened or what will happen," and the like. Also in the category of the "dust" of lashon hara is speaking in one's praise before his enemies; for this will cause them to speak demeaningly of him. And it is forbidden to be profuse in praise of him, even if not before his enemies; for through this he will come to demean him in the end, saying: "except for this one bad trait that he has." Or the listeners will say: "Why do you speak so much in his praise? Does he not have this and this trait?"
(א) אָסוּר לְקַבֵּל לָשׁוֹן הָרָע מִן הַתּוֹרָה, בֵּין שֶׁהוּא מֵהַדְּבָרִים, שֶׁבֵּין אָדָם לַמָּקוֹם, אוֹ מֵהדְּבָרִים, שֶׁבֵּין אָדָם לַחֲבֵרוֹ, דְּהַיְנוּ (א) שֶׁלֹּא נַאֲמִין בְּלִבֵּנוּ שֶׁהַסִפּוּר הוּא אֱמֶת, כִּי עַל יְדֵי זֶה יְבֻזֶּה בְּעֵינֵינוּ, מִי שֶׁנֶּאֱמַר עָלָיו. וַאֲפִלּוּ אִם לֹא יַסְכִּים לוֹ בְּפֵרוּשׁ לְסִפּוּרוֹ, דְּאִי לָאו הָכִי, הְרֵי הוּא שׁוֹנֶה אֶת הֶעָוֹן בְּכִפְלַיִם, שֶׁהוּא מְסַפֵּר וּמְקַבֵּל. וְהַמְקַבֵּל עוֹבֵר בְּלֹא תַעֲשֶׂה, שֶׁנֶּאֱמַר: "לֹא תִשָּׂא שֵׁמַע שָׁוְא". וְאָמְרוּ חְכָמֵּינוּ זַ"ל בִּמְכִילְתָּא, שֶׁזּוֹ הִיא אַזְהָרָה לַמְקַּבֵּל לָשׁוֹן הָרָע, וּלְבַד שְׁאָר לָאוִין וַעֲשִׂין הַמִּצְטָרְפִים לָזֶה, כְּמוֹ שֶׁכָּתוּב לְעֵיל בַּפְּתִיחָה, עַיֵּן שָׁם. וְאָמְרוּ חֲזַ"ל, שֶׁכָּל הַמְקַבֵּל לָשׁוֹן הָרָע, רָאוּי לְהשְׁלִיכוֹ לַכְּלָבִים, שֶׁנֶּאֱמַּר "לֹא תִשָּׂא שֵׁמַע שָׁוְא" וּסְמִיךְ לֵה "לַכֶּלֶב תַּשְׁלִיכוּן אוֹתוֹ". עוֹד אָמְרוּ, שֶׁגָּדוֹל עֹנְשׁ המְקַבְּלוֹ יוֹתֵר מִן הָאוֹמְרוֹ.
(1) It is forbidden to accept lashon hara according to the Torah, both in things "between man and his Maker" and things "between man and his neighbor." That is, we may not believe in our hearts that what is said is true. For, if we do, we will look down upon the one spoken of. And [this applies] even if he [the hearer] explicitly disagrees with what is said. For if not, he doubles the sin — speaking [(by being an accessory to the speaker)] and accepting. And the accepter transgresses (Shemoth 23:1): "You shall not bear a false report," concerning which Chazal have said in the Mechilta, that this is an exhortation against accepting lashon hara, aside from the other negative commandments and positive commandments adjoined to this, as we have written in the introduction. And Chazal have said (Pesachim 118a) that all who accept lashon hara deserve to be cast to the dogs, it being written "You shall not bear a false report," preceded by (Ibid 22:30): "To the dog shall you cast it." And they have also said (Rambam, Hilchoth Deoth 7:13): "The punishment of the accepter is grater than that of the teller."
(א) כַּמָּה גָּדוֹל אִסוּר לָשׁוֹן הָרָע, שֶׁאְסַרְתּוֹ הַתּוֹרָה אֲפִלּוּ עַל אֱמֶת וּבְכָל גַּוְנֵי, דְּלֹא מִּבָּעֵי אִם הוּא שׁוֹמֵר אֶת עַצְמוֹ לְסַפֵּר עָלָיו בַּסֵתֶר וּמַקְפִּיד עַל זֶה שֶׁלֹּא יִתְגַּלֶּה לוֹ דְּאָסוּר, שֶׁעַל יְדֵי זֶה מְקַבֵּל עַל עַצְּמוֹ גַּם כֵּן אָרוּר, כְּמָה דִכְתִיב "אָרוּר מַכֶּה רֵעֵהוּ בַּסָתֶר", אֶלָּא אֲפִלּוּ אִם הוּא מְשַׁעֵר בְּעַצְּמוֹ, (א) שֶׁהָיָה אוֹמֵר דָּבָר זֶה אַךְ בְּפָנָיו, אוֹ שֶׁהוּא מְסַפֵּר לָשׁוֹן הָרָע על חֲבֵרוֹ בְּפָנָיו מַמָּשׁ, גַּם בֵּן אָסוּר וְלָשׁוֹן הָרָע מִקְרֵי, וּבְצַּד אֶחָד גָּדוֹל אִסוּרוֹ בְּפָנָיו מִשֶּׁלֹּא בְּפָנָיו, דִּבְפָנָיו, לְבַד אִסוּר לָשׁוֹן הָרָע, הוּא מַלְבִּישׁ אֶת עַצְּמוֹ עַל יְדֵי זֶה בְּמִדַּת הָעַזּוּת וְהַחֻצְפָּה וְהוּא מְעוֹרֵר יוֹתֵר מְדָנִים עַל יְדֵי זֶה, וְכַמָּה פְּעָמִים בָּא עַל יְדֵי זֶה גַּם כֵּן לִידֵי הַלְבָּנַת פָּנִים, וּכְמוֹ שֶׁהֶאֱרַכְנוּ לְעֵיל בַּפְּתִיחָה בְּלָאו דְּ"לֹא תִשָּׂא עָלָיו חֵטְא". עַיֵּן שָׁם.
(1) How great is the issur of lashon hara, which the Torah has forbidden even if true and in all modes. For not alone if he is careful to speak it only in private and to insist that it not be revealed to him [who is spoken about] is it forbidden, [for through this he also brings a curse upon himself, viz. (Devarim 27:24): "Cursed be he who smites his neighbor in secret"], but even if he knows that he would speak it even to his face, or actually speaks lashon hara to his face, even so it is forbidden and called "lashon hara." And in one respect, the issur is greater "to his face" than not to his face." For in his presence, aside from the issur of lashon hara, he [the speaker] clothes himself with the trait of brazenness and audacity, and arouses more strife thereby. And very often this leads also to the "whitening of (the other's) face (in shame)," as we have enlarged upon in the introduction concerning the negative commandment of (Vayikra 19:17): "Do not bear sin because of him."
(ג) משפטים — אבל כל אלה יש להם ערכם עליך, אם תחיה באמת על פי מושגיך אלה, בעולם ה', בכחות ה' ובתכונת איש ישראל. חובתך הראשונה: "הצדק!" כי תכבד כל יצור מסביב לך ובך, בתור יציר ה' אלהיך, תביט על כל אשר לו, כי מתנת ה' המה לו או כל אשר רכש לו עפ"י מדת הצדק מה', להניח זאת בידו ולתת לו כל דבר, אשר הצדק אתו לקרוא אותו בשם "שלו" — אל תביא קללה בעולם! ראשית חובתך, לחשוב כל אדם כי הוא דומה לך ולכבד את עצמותו הנסתרת בגופו ובחייו. — בגופו המתפשט ע"י מעשה אנוש ותחבולותיו — בקנינו. בזכיותיו, כי קניניך יעברו ברשותו. ושלו תהיינה פעולות כחותיך. במדה ובמנין ובמשורה. — למלאות את החסרון באשר הזיק לו בגופו או בממונו. לכבדו בהיות לו הזכות על האמת. — על החופש, שמחת החיים ומנוחת הנפש. על הכבוד ועל השלום. לעולם אל תוציא לך תועלת ממום ורפיון גופו, רוחו ולבו. לעולם אל תשתמש להרע עם השלטון והמשפט אשר יש לך עליו.
(3) Mishpatim. — Judgments or Principles of Justice. — All these ideal theories have only value, however, if thou really livest, as thou hast gained the conception, in a Divine world, with Divine powers, man-Israel. The first requisite is, Justice! Respect every being around thee and all that is in thee as the creation of thy God; everything belonging to them as given them by God or in accordance with law which He has sanctioned. Leave willingly to each being that which it is justly entitled to call its own. Be not as regards aught a curse. Especially honor every human being as thy equal, regard him in his essence, that is to say, in his invisible personality, in his bodily envelope and in his life. Extend the same regard to his artificially enlarged body, his property; to the demands which he may be entitled to make upon you for assistance by grants of property or acts of physical strength; in measure and number; in recompense of injury to his person or possessions. Have regard, also, to his rightful claim of truth; of liberty, happiness, and peace of mind, of honor and undisturbed tranquillity. Do not abuse his weakness of heart, mind, or body; do not unjustly employ thy legal power over him.
(א) שלא לרגל - שנמנענו מרכילות, שנאמר (ויקרא יט טז) לא תלך רכיל. והענין הוא, שאם נשמע אדם מדבר רע בחברו, שלא נלך אליו ונספר לו פלוני מדבר כך וכך, אלא אם כן תהיה כונתנו לסלק הנזקין ולהשבית ריב. ואמרו זכרונם לברכה (כתובות מו, א) בפרוש רכיל רך לזה וקשה לזה, דבר אחר לא תהא כרוכל, מטעין דברים והולך.
(ב) משרשי המצוה. כי השם חפץ בטובת הבריות אשר ברא וצונו בזה כדי להיות שלום בינינו כי הרכילות מביא לריב ומצה.
(ג) פרטי המצוה ורב האזהרות שהזהירונו זכרונם לברכה על הרכילות ועל לשון הרע שתפו, יתבארו במקומות מהתלמוד ובמדרשות בפזור [ה' דעות פ''ז]. ובפרוש אמרו (ערכין טו ב) בלשון הרע. שממית האומרו והמקבלו [ו] שנאמר עליו, והמקבלו יותר מכלן, והזהירו הרבה עליו עד שאמרו דרך משל (ב''מ נט ב): מאן דאית [ליה] זקיפא בדקתיה, לא לימא זקוף ביניתא. ואמרו (ערכין טז א) כי בכלל אבק לשון הרע הוא המשבח חברו בפני שונאו, שנאמר (משלי כז יד) מברך רעהו וגו'.
(ד) ונוהגת בכל מקום ובכל זמן בזכרים ונקבות, והעובר עליה ורגל על לשונו עובר על לאו, והוא כעובר על מצות מלך, ואין בו מלקות, לפי שהוא לאו שאין בו מעשה, וכמה שלוחים למקום להלקות מלבד רצועה של עגל ושל פרות. ואף על פי שאין בלאו הזה מלקות לפי שאין בו מעשה, פעמים שיש בו אפילו חיוב מיתה, כידוע בדין מוסר. וזה הדין התירו חכמים לעשות אפילו בחוצה לארץ לתקון העולם, מוטב ימות איש אחד ולא יזיק ויאבד לרבים גופם או אפילו ממונם.
(ה) ואכתב לך בני מעט ממה שיש בגמרא בענין זה, ואם תזכה לדעת תראה הכל במקומו. גרסינן בפרק הגוזל בתרא (ב''ק קטז ב) ההוא גברא דאחוי כריא דחטי דבי ריש גלותא, חיביה רב נחמן לשלומה, וטעמא משום דינא דגרמי (שם קיז ב). ודוקא שהראה מעצמו אבל מתוך האנס, פטור, וכדתניא (שם קיז, א) ישראל שאנסוהו גוים והראה ממון חברו פטור. ופרשו מורינו זכרונם לברכה, דלא סוף דבר אנסוהו בגופו אלא אפילו אנסוהו בממון שיקחו לו ממון אם לא יראה ממון חברו והראהו פטור, דכל מראה על ידי אנס פטור ואינו חיב אלא במראה מעצמו. וכן כתב הרב רבי אברהם בר רבי דוד זכרונו לברכה. ואם נשא ונתן ביד חיב, ואפילו על ידי אנס נפשות. ואם תאמר אין לך דבר שעומד בפני פקוח נפש, יש לומר מי אמרינן ליה ימות? יתן וישלם קאמרינן ליה, ולא יציל עצמו בממון חברו, ואפילו בנרדף שהיה בורח מפני רודף ושבר כלים חיב, ואף על פי שלא שברן בכונה אלא בלא כונה, ובשעה שהיה בורח להנצל, וכל שכן נשא ונתן ביד שחיב בתשלומין.
(ו) ואם לאחר שהראה מתוך האנס נשא ונתן ביד, משעה שהראה רואין את הדבר כאלו נשרף ושוב אינו מתחיב עליו משום נשא ונתן, ומשום שהראה נמי אינו חיב כיון שהראה מתוך האנס כדכתיבנא. והכי אמרינן התם ההוא גברא דאחוי חמרא דרב מרי ורב פנחס בני דרב פפא, פרוש מתוך האנס. אמרי ליה דרי ואמטי, דרא ואמטי. ואסיקנא, דכיון דאוקמינהו עלויה, מקלא קליא ושוב אינו מתחיב עליו. והיכא דהראה מעצמו בלא טענת אנס חיב מיתה ותשלומין, דגרסינן התם ההוא גברא דהוה בעי דנחוי בי תבנא דחבריה אתא לקמיה דרב, אמר ליה רב לא תעבד הכי כלומר התרה בו לא הוה צאית הוה יתיב רב כהנא קמיה דרב, קם רב כהנא שמטיה לקועיה כלומר הרגו והכי מוכח הא דאמר ליה רב לרב כהנא האידנא מלכותא דפרסאי היא וקפדי אשפיכות דמים. ואמרינן נמי בגמרא (שם קיט א), גבי מאן דאבעיא לן ממון מוסד אם מתר לאבדו, ומהדרינן ליה, לא יהא ממונו חמור מגופו, אלמא דגופו מתר לאבדו, מיהו דוקא בשעת מעשה ועל ידי התראה, וכמעשה דרב כהנא, ואינו צריך שיקבל עליו התראה כשאר חיבי מיתות. ומי שמחזק למסר, נראה שהוא כמתרה ועומד, ומתר להרגו בכל שעה.
(ז) ודעת הרמב''ם זכרונו לברכה (חובל ומזיק ח י יא), שכתב בדין מוסר כך הוא, כיון שאמר הריני מוסר פלוני בגופו או בממונו ואפילו ממון קל הרי זה התיר עצמו למיתה, ומתרין בו ואומרים לו אל תמסר, אם העיז פניו ואמר לא כי אלא אמסר מצוה להרגו, וכל הקודם להרגו זכה. עשה המוסר אשר זמם ומסר, יראה לי שאסור להרגו, אלא אם כן החזק למסר הרי זה יהרג שמא ימסר אחרים, עד כאן לשון הרב. הצריך התראה למי שאינו מחזק למסר ושיקבל התראה, ולמי שהוא מחזק למסר נראה מתוך דבריו שאינו צריך התראה. ואין המוסר יכול לומר בשביל שפלוני מצר לי אני מוסרו ביד גוים, שאין זה פוטרו מענשו, אבל המצר לצבור, מתר לצבור למסרו ביד גוים, וכן כתב הרמב''ם זכרונו לברכה (שם הי''א). ואסור לאבד ממון מוסר, משום (איוב כז יז) רשע יכין וצדיק ילבש. כדאסיקנא בפרק הגוזל (קיט א).
