About This Text

Author: Moses ben Nachman (Ramban)
Composed:  c.1225 – c.1265 CE
Dina DeGarmei (“The Law of Those Who Cause,” a talmudic phrase) is a short 13th-century treatise by Ramban about the complex topic of indirect damages. In it, Nachmanides surveys the talmudic passages that address different forms of indirect damages as well as the positions of earlier authorities and advances his own argument about what factors render a person liable for indirect damage. Since the subject is addressed in the second chapter of tractate Bava Batra, the treatise is often printed as an appendix to the author’s commentary on the tractate. It is considered a central work on the topic and has inspired several commentaries.
