§ When God explained to Joshua the reason for the Jewish people’s defeat at the city of Ai, He said: “Israel has sinned” (Joshua 7:11). Rabbi Abba bar Zavda says: From here it may be inferred that even when the Jewish people have sinned, they are still called “Israel.” Rabbi Abba says: This is in accordance with the adage that people say: Even when a myrtle is found among thorns, its name is myrtle and people call it myrtle.
ואמר רבי אילעא משום רבי יהודה בר מספרתא עכן מושך בערלתו היה כתיב הכא וגם עברו את בריתי וכתיב התם (בראשית יז, יד) את בריתי הפר
And Rabbi Ile’a says further in the name of Rabbi Yehuda bar Masparta: Achan, in addition to his other evil actions, would stretch his remaining foreskin in order to conceal the fact that he was circumcised. An allusion to this offense is found in the wording of this verse. Here, with regard to Achan, it is written: “They have also transgressed My covenant,” and there, with regard to circumcision, it is written: “He has violated My covenant” (Genesis 17:14).
(א) השיב רש"י: על היבמה שנפלה לפני יבם משומד צריכה חליצה. ואין חילוק בין שקדשה הבעל ואח"כ נשתמד בין שנשתמד לאחר [=קודם] קידושין, שהמשומד הרי הוא כישראל חשוד לכל דבר שנאמר חטא ישראל אעפ"י שחטא ישראל הוא. ואין לחלקו מידת ישראל אלא שאין נאמן באיסורין, הואיל וחשוד הוא עליהן, ויינו יין נסך הואיל וחשוד הוא לע"ז, וקידושיו קידושין וחליצתו חליצה. כללא של דבר הרי הוא כישראל חשוד.
(1) Rashi responded: A levirate widow (yevama) who is bound to an apostate brother-in-law requires levirate divorce (halitza). It makes no difference whether the husband betrothed her and then [the brother-in-law] apostatized, or whether he apostatized before the betrothal, because an apostate is a Jew, who is suspect on all matters. For it is stated: “‘Israel has sinned’—though he has sinned, he remains of Israel” (Sanhedrin 44a). He should not be excluded from the law of Israel, although he has no credibility vis-à-vis prohibitions, since he is suspected of violating them, and his wine is rendered libation wine (yeyn nesekh) since he is suspected of idolatry. Yet his betrothal is valid, and his halitza is valid. As a rule, he is considered a suspect Jew.
(ט) המחלל שבת בפרהסיא, בין להכעיס בין לתיאבון, והעובר על מצוה אחת ממצות התורה להכעיס, דשביק היתרא ואכיל איסורא, מותר להלוות לו מעות ברבית, שנאמר באיסור הרבית, וחי אחיך עמך, יצא זה שאינו אחיך במצות. וכ''ש שאם הוא כופר בעיקר, שמותר להלוותו ברבית. וכן אם המיר דתו לדת הנוצרים, או דת ישמעאל, שהוא כגוי לכל דבר, מותר להלוותו ברבית. ומ''מ אסור ללוות ברבית מן המומר, שאף על פי שחטא ישראל הוא (סנהדרין מד.), ולכן אסור להכשילו בעון רבית.
Whoever desecrates the Sabbath in public, whether out of spite or whether out of impulse, and one who transgresses one of the commandments of the Torah out of spite, such as a person who sets aside the permitted food and eats the forbidden food (Gittin 47a), it is permitted to lend him money on interest, as it is stated in the prohibition of interest, "Let him live by your side as your kinsman," (Leviticus 25:36) he has excluded himself and is not your kinsman in the commandments. And all the more so if he is a complete heretic, it is permitted to loan to him on interest. And if he converted to Christianity or Islam, so that he is a gentile in every respect, it is permissible to lend him with interest. However, it is forbidden to borrow with interest from the convert, for even when the Jewish people have sinned, they are still called “Israel,” (Sanhedrin 43a) and it is forbidden to lead him astray into the sin of interest.
