Does the Gamara answer the original question? Does it end with an answer? How do you know
The Gamara doesn't answer the original question, but instead has the תיקו, which indicates that the discussion is over even when the question is not fully answered.
What is the issue on how someone should be paid, and how would someone who is deaf be paid?
The issue is how someone be paid if they were injured and when deafened, should they be paid for each limb and then for the dead payment or for all of them at once? Someone who is deaf would be paid for worth of his entire body because he is unable to work anymore.
How does the משנה say you should view the injured when assessing for compensation.
Answer: as a שומר קישואים--cucumber watcher
What is Rabba's question?
Answer: The injurer damaged the injured many times but the injured wasn't assessed after each damage/injurer didn't pay him after each damage--he cut off his hand, broke his leg, blinded him, and in the end he deafened him (basically he isn't capable of working anymore). So now what? Rabba's question is does the injurer pay for just the deafness (which is really paying for the whole body), or does he pay for each damage individually, and the difference would be that he would receive compensation for the pain and disgrace of each injury separately?
Thought Questions
What do you think should be the answer to Rabba's question? Do you think the injurer should pay the total of the damges as one (deafness) or for each one individually? What do you think is more fair for a ethical justice system?
Answer: I think that the injurer should have to pay for each one individually. Each damage caused a lot of pain and suffering to the injured, and it's not enough to just give the total and be done--you must do each one individually according to the pain and disgrace of each. This way the injurer realizes the effect and impact of each damage he caused, and perhaps he will be more cautious next time
How would the topic in the Gamara apply if you damaged someone who did't work What if you damage someone who was already deaf?
If you damaged someone who was already deaf you would probably wouldn't pay for the work that they are missing since people that time who were deaf didn't work. If you damaged someone who didn't work you would assess them at there potential, would they have been able to work even if they were not currently.
