(טז) לֹא־תַסְגִּ֥יר עֶ֖בֶד אֶל־אֲדֹנָ֑יו אֲשֶׁר־יִנָּצֵ֥ל אֵלֶ֖יךָ מֵעִ֥ם אֲדֹנָֽיו׃ (יז) עִמְּךָ֞ יֵשֵׁ֣ב בְּקִרְבְּךָ֗ בַּמָּק֧וֹם אֲשֶׁר־יִבְחַ֛ר בְּאַחַ֥ד שְׁעָרֶ֖יךָ בַּטּ֣וֹב ל֑וֹ לֹ֖א תּוֹנֶֽנּוּ׃ (ס)
(16) Thou shalt not deliver unto his master a bondman that is escaped from his master unto thee; (17) he shall dwell with thee, in the midst of thee, in the place which he shall choose within one of thy gates, where it liketh him best; thou shalt not wrong him.
Hebrew Vocabulary: לא תוננו "Do not afflict him." From the root ענה meaning "to afflict, humble, mishandle. An עני is a poor or needy person.
(ו) עַמּוֹן וּמוֹאָב אֵין שׁוֹלְחִין לָהֶם לְשָׁלוֹם שֶׁנֶּאֱמַר (דברים כג, ז) "לֹא תִדְרשׁ שְׁלֹמָם וְטֹבָתָם כָּל יָמֶיךָ". אָמְרוּ חֲכָמִים לְפִי שֶׁנֶּאֱמַר (דברים כ, י) "וְקָרָאתָ אֵלֶיהָ לְשָׁלוֹם" יָכוֹל עַמּוֹן וּמוֹאָב כֵּן. תַּלְמוּד לוֹמַר לֹא תִדְרשׁ שְׁלֹמָם וְטֹבָתָם. לְפִי שֶׁנֶּאֱמַר (דברים כג, יז) "עִמְּךָ יֵשֵׁב בְּקִרְבְּךָ" (דברים כג, יז) "בַּטּוֹב לוֹ לֹא תּוֹנֶנּוּ". יָכוֹל עַמּוֹן וּמוֹאָב כֵּן תַּלְמוּד לוֹמַר וְטֹבָתָם. וְאַף עַל פִּי שֶׁאֵין שׁוֹאֲלִים בִּשְׁלוֹמָם אִם הִשְׁלִימוּ מֵעַצְמָם תְּחִלָּה מְקַבְּלִין אוֹתָן:
(6) When a city is sieged to be conquered, we do not surround the four sides of it , rather, only three, and a place is selected as a place where whoever wants to flee and save their lives can, as it is written: And they warred against Midian, as Hashem commanded Moshe (Num. 31:7) from the wording we understand that he was commanded.
(טז) לא תסגיר עבד. כתרגומו דבר אחר אפלו עבד כנעני של ישראל שברח מחוצה לארץ לארץ ישראל:
(16) לא תסגיר עבד You shall not deliver unto his master a servant who has escaped from his master to you. — Understand this as the Targum has it: [עבד עממין the servant of the gentiles.] Another explanation: [this includes] even a Canaanite servant from Israel, who fled from outside the Land (from a foreign country) to the Land of Israel (Gittin 45a).
(ו) ... ועם זה כשירבה להכותו עד שימיתהו יהרג עליו כשאר בני אדם. - ואמרו "לא תסגיר עבד אל אדוניו" עם היותו רחמנות יש בזאת המצוה תועלת גדולה והיא שנתנהג בזאת המידה הנכבדת והוא - שנעזור מי שיעזר בנו ונשמרהו ולא נסגירהו ביד מי שברח ממני. ולא די שתעזור מי שיעזר בך אלא שאתה חייב לעיין בתיקוניו ותיטיב לו ולא תכאיב לבבו בדברים - והוא אמרו ית' "עמך ישב בקרבך... באחד שעריך בטוב לו לא תוננו". ועוד שחיב זה הדין בפחות שבבני אדם והוא העבד - כל שכן אם יעזר בך איש נכבד שראוי לך לעשות מה שראוי לו. ונגד זה הענין ...
(6) ... If the master strikes the slave too hard and kills him, he is punished with death as for ordinary murder. Mercy is also the object of the law, "Thou shalt not deliver unto his master the servant that is escaped from his master" (Deut. 23:15); but it teaches besides a very useful lesson, namely, that we must always practise this virtue, help and protect those who seek our help, and not deliver them unto those from whom they flee; and it is not sufficient to give assistance to those who are in need of our help; we must look after their interests, be kind to them, and not hurt their feeling by words. Thus the Law says: "He shall dwell with thee, even among you, in that place which he shall choose in one of thy gates, where it liketh him best: thou shalt not vex him" (ibid. ver. 16).

(3) (Fol. 93b) We are taught (Deut. 23:16) Thou shalt not deliver unto his master a bondman. Rabbi said: The passage dealt with one who purchases a servant on condition to set him free. How is such a purchase to be made? R. Nachman b. Isaac said: He writes [in the slave's offer], 'After I shall have purchased you, you will thenceforth be bought to yourself.'"

As a hired man... (Deut 24:14) What is a hired man? "You must pay him his wages on the same day." So, this one, on that day, you must pay him"
As a sojourner: What is a "toshav?" (Sojourner?) Just as a sojourner (Deut. 23:17) "… You shall not oppress him," so, this one "… what is good for him; you shall not oppress him.
"[He] shall he be with you": "with you" in eating, "with you" in drinking, "with you" in covering — that you not eat a clean loaf and he eat a coarse loaf; that you (not) drink old wine and he drink new wine; that you (not) sleep on cotton and he sleep on straw. "Shall he work with you": that he (the master) should not engage him for his craft to another. So that if he (the servant) were formerly a public bath-house attendant, a barber to the public, or a baker to the public, he should not do this (as a servant). R. Yossi says: If this were his trade (before he became a servant) he should do it; but his master should not bid him to do so ab initio. ... (Lev. 25:41) ("Then he shall go out from you; and his children with him. And he shall return to his family, and to the holding of his fathers shall he return.") "Then he shall go out from you": (From this we may infer) that (the servant) should not be in the village and he in the city, or you in the city and he in the village.
"He and his children with him": (from which we may infer) Just as his master is obligated to feed him, so is he obligated to feed his wife and children.
(יא) וְהִקְרִיתֶ֤ם לָכֶם֙ עָרִ֔ים עָרֵ֥י מִקְלָ֖ט תִּהְיֶ֣ינָה לָכֶ֑ם וְנָ֥ס שָׁ֙מָּה֙ רֹצֵ֔חַ מַכֵּה־נֶ֖פֶשׁ בִּשְׁגָגָֽה׃ (יב) וְהָי֨וּ לָכֶ֧ם הֶעָרִ֛ים לְמִקְלָ֖ט מִגֹּאֵ֑ל וְלֹ֤א יָמוּת֙ הָרֹצֵ֔חַ עַד־עָמְד֛וֹ לִפְנֵ֥י הָעֵדָ֖ה לַמִּשְׁפָּֽט׃
(11) Then you shall appoint you cities to be cities of refuge for you, that the man slayer that kills any person through error may flee thither. (12) And the cities shall be unto you for refuge from the avenger, that the man slayer not die until he stands before the congregation for judgment.
Hebrew Vocabulary: ערי מקלט Cities of Refuge. קלט also means, "absorption." Literally, this means "absorption cities," cities that absorb or gather in those who flee (Kimhi). These cities would provide refuge because their inhabitants would have to protect [and judge] the accidental man slayer and keep the blood avenger from doing him harm. (Abarbanel)
Notice also בשגגה, meaning "mistake, error." What Yiddish word does this evoke?
(Numbers 35:12) "Untill he stands before a court for judgement" what is the Torah teaching us? Since it says (Numbers 35,27) "And the Goel Hadam will find the murderer" I might think that it means [he can kill him immediately] [therefore] the Torah teaches us "until he stand before a court for judgement"
