(א) כל רמש אשר הוא חי וגו'. יש לדעת למה לא הותר הבשר לאדם אלא לנח. ונראה כי נח משלו נתנו לו לג' סיבות,
הא' שבאמצעותו מצא ה' לקיים המין וזולתו לא היה מקיים מין הרמש בלא אדם ובזה זכה הוא בהם.
ב' שהוא טרח בהם ויגע בתיבה, וצא ולמד כמה יגיעות יגע בהם ועליו נאמר (תהלים קכ''ח) יגיע כפיך וגו'.
ג' שגרם באמצעות קרבנו שנתרצה ה' ונשבע שלא יכרת כל בשר וגו' לזה התיר לו ה' לאכול מפרי דרכו:
It behooves us to know, why meat was not permitted (in the time of Adam) and only (in the time of) Noah.
It seems that there were three things about Noah that may have permitted meat to him:
- It was only through Noah that God saw fit to keep these species alive, and without him these species would have perished - which was not the case with Adam - and he merited (consuming) their (flesh) in this way.
- He tirelessly toiled in the ark on their behalf - as it says in Psalms: "When you eat what you have worked for with your hands, you will be happy and you will prosper."
- The decision was effected though (Noah's) sacrifice, fulfilling God's command. God vowed at that moment not to wipe out all life, and for this reason God allowed Noah to eat of the fruit of his labors.
(ח) שאל עובד כוכבים אחד את רבן יוחנן בן זכאי: אילין עובדייא דאתון עבדין, נראין כמין כשפים, אתם מביאים פרה, ושורפין אותה, וכותשין אותה, ונוטלין את אפרה, ואחד מכם מטמא למת, מזין עליו ב' וג' טיפין, ואתם אומרים לו: טהרת?! ... אמרו לו תלמידיו: רבנו, לזה דחית בקנה, לנו מה אתה אומר? אמר להם: חייכם! לא המת מטמא, ולא המים מטהרין, אלא אמר הקב"ה: חקה חקקתי, גזירה גזרתי, אי אתה רשאי לעבור על גזרתי, דכתיב: זאת חוקת התורה.
(8) A pagan once asked Rabbi Yochanan ben Zakkai, "These rituals you do, they look like witchcraft! You bring a heifer, burn it, crush it up, and take its ashes. [If] one of you is impure by the dead [the highest type impurity], 2 or 3 drops are sprinkled on him, and you declare him pure?!" ...
After he left, our rabbi's students said, "You pushed him off with a reed. What will you say to us?" He said to them, "By your lives, a dead person doesn't make things impure, and the water doesn't make things pure. Rather, God said, 'I have engraved a rule, I have decreed a decree (chukah chakakti, gezeira gazarti), and you have no permission to transgress what I decreed, as it says "This is a chok (rule) of the Torah."
(א) אל כל עדת בני ישראל ... "קדושים תהיו" - הוו פרושים מן העריות ומן העבירה שכל מקום שאתה מוצא גדר ערוה אתה מוצא קדושה לשון רש"י
אבל בתורת כהנים (פרשה א ב) ראיתי סתם פרושים תהיו וכן שנו שם (שמיני פרק יב ג) והתקדשתם והייתם קדושים כי קדוש אני כשם שאני קדוש כך אתם תהיו קדושים כשם שאני פרוש כך אתם תהיו פרושים ולפי דעתי אין הפרישות הזו לפרוש מן העריות כדברי הרב
אבל הפרישות היא המוזכרת בכל מקום בתלמוד שבעליה נקראים פרושים והענין כי התורה הזהירה בעריות ובמאכלים האסורים והתירה הביאה איש באשתו ואכילת הבשר והיין א"כ ימצא בעל התאוה מקום להיות שטוף בזמת אשתו או נשיו הרבות ולהיות בסובאי יין בזוללי בשר למו וידבר כרצונו בכל הנבלות שלא הוזכר איסור זה בתורה והנה יהיה נבל ברשות התורה לפיכך בא הכתוב אחרי שפרט האיסורים שאסר אותם לגמרי
וצוה בדבר כללי שנהיה פרושים מן המותרות ימעט במשגל כענין שאמרו (ברכות כב) שלא יהיו תלמידי חכמים מצויין אצל נשותיהן כתרנגולין ולא ישמש אלא כפי הצריך בקיום המצוה ממנו ויקדש עצמו מן היין במיעוטו כמו שקרא הכתוב (במדבר ו ה) הנזיר קדוש ויזכור הרעות הנזכרות ממנו בתורה (בראשית ט כא) בנח ובלוט וכן יפריש עצמו מן הטומאה אע"פ שלא הוזהרנו ממנה בתורה כמו שהזכירו (חגיגה יח) בגדי עם הארץ מדרס לפרושים וכמו שנקרא הנזיר קדוש (במדבר ו ח) בשמרו מטומאת המת גם כן וגם ישמור פיו ולשונו מהתגאל ברבוי האכילה הגסה ומן הדבור הנמאס כענין שהזכיר הכתוב (ישעיהו ט טז) וכל פה דובר נבלה ויקדש עצמו בזה עד שיגיע לפרישות כמה שאמרו על רבי חייא שלא שח שיחה בטלה מימיו
Rashi understands this to mean that Israelites are to separate ourselves from (all the) forbidden sexual relationships (enumerated in the upcoming chapter). But in the Sifra, (where Rashi seems to) derive this comment, it simply says "be separate."
And similarly it says there, "Just as I am holy, you shall be holy, just as I am separate, you must be separate." And in my opinion this "separateness" doesn't refer to separating oneself from (the long list of) sexual transgressions (enumerated in Leviticus 18) as Rashi understands our text.
Rather the "separateness" referred to here (in the Midrash) pertains to the same "separateness" that appears throughout the Talmud, whose masters are known as "Pharisees/Perushim." What this matter is comes to teach is as follows: While the Torah bans some sexual relationships, and some food, and permits intercourse within a marital relationship, and eating (kosher) meat and drinking (kosher) wine. If this is read to literally, we'll find licentious men constantly in bed with their wives, and becoming among the "guzzlers of wine and gluttons for meat," and speakings crudely, as long as they are not explicitly banned in the Torah, and they will become a "Scoundrel in full permission of the Torah." Therefore our verse comes
after giving the details of things are are explicitly forbidden, and commands us in a general tone, that we should seperate ourselves (even from) that which is permitted, and restrain ourselves from a life of excess.
(א) כָּתוּב בַּתּוֹרָה: לֹא תְבַשֵּׁל גְּדִי בַּחֲלֵב אִמּוֹ (שְׁמוֹת כג, יט, לד, כו, דְּבָרִים יד, כא) ג' פְּעָמִים; אֶחָד לְאִסוּר בִּשּׁוּל, וְאֶחָד לְאִסוּר אֲכִילָה, וְאֶחָד לְאִסוּר הֲנָאָה. וְהוֹצִיא אֲכִילָה בִּלְשׁוֹן בִּשּׁוּל, לוֹמַר שֶׁאֵינוֹ אָסוּר מִן הַתּוֹרָה אֶלָּא דֶּרֶךְ בִּשּׁוּל, אֲבָל מִדְּרַבָּנָן אָסוּר בְּכָל עִנְיָן. כָּל בָּשָׂר בְּחָלָב שֶׁאֵינוֹ אָסוּר מִן הַתּוֹרָה, מֻתָּר בַּהֲנָאָה. (טוּר וְאָרֹךְ כְּלָל ל').
(ב) גְּדִי, לָאו דַּוְקָא, דְּהוּא הַדִּין שׁוֹר, שֶׂה וָעֵז. וְלֹא שְׁנָא בַּחֲלֵב אֵם, וְלֹא שְׁנָא בַּחֲלֵב אַחֶרֶת, אֶלָּא שֶׁדִּבֵּר הַכָּתוּב בַּהֹוֶה.
(ג) אֵינוֹ נוֹהֵג אֶלָּא בִּבְשַׂר בְּהֵמָה טְהוֹרָה בַּחֲלֵב בְּהֵמָה טְהוֹרָה, אֲבָל בְּשַׂר טְהוֹרָה בַּחֲלֵב טְמֵאָה, אוֹ בְּשַׂר טְמֵאָה בַּחֲלֵב טְהוֹרָה, מֻתָּרִים בְּבִשּׁוּל וּבַהֲנָאָה. וּבְשַׂר חַיָּה וָעוֹף, אֲפִלּוּ בַּחֲלֵב טְהוֹרָה, מֻתָּר בְּבִשּׁוּל, וּבַהֲנָאָה; וְאַף בַּאֲכִילָה אֵינוֹ אָסוּר, אֶלָּא מִדְּרַבָּנָן. אֲבָל דָּגִים וַחֲגָבִים, אֵין בָּהֶם אִסוּר, אֲפִלּוּ מִדְּרַבָּנָן. הַגָּה: וְנָהֲגוּ לַעֲשׂוֹת חָלָב מִשְּׁקֵדִים וּמַנִּיחִים בָּהּ בְּשַׂר עוֹף, הוֹאִיל וְאֵינוֹ רַק מִדְּרַבָּנָן. אֲבָל בְּשַׂר בְּהֵמָה, יֵשׁ לְהַנִּיחַ אֵצֶל הַחָלָב שְׁקֵדִים, מִשּׁוּם מַרְאִית הָעַיִן, כְּמוֹ שֶׁנִּתְבָּאֵר לְעֵיל סִימָן ס''ו לְעִנְיַן דָּם (ד''ע).
(1) It is written in the Torah: "you will not cook a kid in the milk of its mother" three times (Exodus 23:19; Exodus 34:26; Deuteronomy 14:21); once for the prohibition of cooking, once for the prohibition of eating, and once for the prohibition of receiving benefit [from the cooked meat and milk products]. The prohibition of eating is presented in the language of cooking, to say that there is no prohibition from the Torah [in regard to meat and milk] unless it is in a manner of cooking, but rabbinically it [the mixture of meat and milk] is forbidden in every way. All meat and milk [mixtures] that are not forbidden from the torah are permitted to benefit from.
(2) [The word] "kid", is not specific, it is the same rule with ox, sheep and goat. There is no difference if it is the milk of the mother, or of another [domesticated] animal. Rather, the verse refers to the common case.
(3) The law only applies with meat from a pure [kosher] animal and milk from a pure animal, but meat of a pure animal in milk that is impure, or meat from an impure animal in pure milk, is permitted to cook and benefit from. Meat of a wild animal and of fowl, even in milk which is pure, is permitted to cook and benefit from; and even eating is only prohibited rabbinically. Fish and grasshoppers are not prohibited [with milk] even rabbinically. We make milk from almonds and place bird meat in it, since [milk and bird meat] is only rabbinically [forbidden]. But with meat from a domesticated animal, place almonds next to the milk, so that people don't misunderstand. This is as we said above, in chapter 66.

בעא מיניה רב אסי מרבי יוחנן כמה ישהה בין בשר לגבינה
א"ל ולא כלום
איני?!?
והא אמר רב חסדא אכל בשר אסור לאכול גבינה גבינה מותר לאכול בשר
אלא כמה ישהה בין גבינה לבשר א"ל ולא כלום
גופא אמר רב חסדא אכל בשר אסור לאכול גבינה גבינה מותר לאכול בשר
אמר ליה רב אחא בר יוסף לרב חסדא בשר שבין השינים מהו קרי עליה (במדבר יא, לג) "הבשר עודנו בין שיניהם"
אמר מר עוקבא אנא להא מלתא חלא בר חמרא לגבי אבא דאילו אבא כי הוה אכיל בשרא האידנא, לא הוה אכל גבינה עד למחר עד השתא.
ואילו אנא בהא סעודתא הוא דלא אכילנא לסעודתא אחריתא אכילנא
(א) אָכַל בָּשָׂר, אֲפִלּוּ שֶׁל חַיָּה וָעוֹף, לֹא יֹאכַל גְּבִינָה אַחֲרָיו עַד שֶׁיִּשְׁהֶה שֵׁשׁ שָׁעוֹת. וַאֲפִלּוּ אִם שָׁהָה כַּשִּׁעוּר, אִם יֵשׁ בָּשָׂר בֵּין הַשִּׁנַּיִם, צָרִיךְ לַהֲסִירוֹ. וְהַלּוֹעֵס לְתִינוֹק, צָרִיךְ לְהַמְתִּין. הַגָּה: וְאִם מָצָא אַחַר כָּךְ בָּשָׂר שֶׁבֵּין הַשִּׁנַּיִם, וּמְסִירוֹ, צָרִיךְ לְהָדִיחַ פִּיו קֹדֶם שֶׁיֹּאכַל גְּבִינָה (הר''ן פכ''ה). וְיֵשׁ אוֹמְרִים דְּאֵין צְרִיכִין לְהַמְתִּין שֵׁשׁ שָׁעוֹת, רַק מִיָּד אִם סִלֵּק וּבֵרַךְ בִּרְכַת הַמָּזוֹן, מֻתָּר עַל יְדֵי קִנּוּחַ וַהֲדָחָה (תוס' וּמָרְדְּכַי פכ''ה וְהַגָּהוֹת אֲשֵׁרִ''י וְהג''ה מַיְמוֹנִי פ''ט דמ''א וְראבי''ה). וְהַמִּנְהָג הַפָּשׁוּט בִּמְדִינוֹת אֵלּוּ, לְהַמְתִּין אַחַר אֲכִילַת הַבָּשָׂר שָׁעָה אַחַת, וְאוֹכְלִין אַחַר כָּךְ גְּבִינָה. מִיהוּ צְרִיכִים לְבָרֵךְ גַּם כֵּן בִּרְכַת הַמָּזוֹן אַחַר הַבָּשָׂר (עַל פִּי הָאָרֹךְ וְהַגָּהוֹת ש''ד), דְּאָז הָוֵי כִּסְעֻדָּה אַחֶרֶת, דְּמֻתָּר לֶאֱכֹל לְדִבְרֵי הַמְקִלִּין. אֲבָל בְּלֹא בִּרְכַּת הַמָּזוֹן, לֹא מֵהָנֵי הַמְתָּנַת שָׁעָה. וְאֵין חִלּוּק אִם הִמְתִּין הַשָּׁעָה קֹדֶם בִּרְכַת הַמָּזוֹן, אוֹ אַחַר כָּךְ (ד''ע ממהרא''י וְלַאֲפוּקֵי או''ה). וְאִם מָצָא בָּשָׂר בֵּין שִׁנָּיו, אַחַר הַשָּׁעָה, צָרִיךְ לְנַקְּרוֹ וְלַהֲסִירוֹ (ד''ע מִמַּשְׁמָעוּת הר''ן הנ''ל). וְיֵשׁ אוֹמְרִים דְּאֵין לְבָרֵךְ בִּרְכַת הַמָּזוֹן עַל מְנַת לֶאֱכֹל גְּבִינָה (אָרֹךְ בְּשֵׁם מהר''ח), אֲבָל אֵין נִזְהָרִין בָּזֶה. וְיֵשׁ מְדַקְדְּקִים לְהַמְתִּין שֵׁשׁ שָׁעוֹת אַחַר אֲכִילַת בָּשָׂר לִגְבִינָה, וְכֵן נָכוֹן לַעֲשׂוֹת.
(1) One who eats meat, even of a wild animal or fowl, does not eat cheese afterwards until he waits six hours. Even if he waits that period, if he has meat between his teeth he has to remove it. One who chews food for a child has to wait. If afterwards he finds meat between his teeth and removes it, he has to wipe his mouth out before eating cheese (Ran chapter 25). There are those that says that he doesn't have to wait six hours, but rather immediately if he finishes the meal and says the concluding blessing, it is permissible after wiping and rinsing his mouth (Tosafot Hullin 105a - "At the next meal", Mordechai chapter 25, Haga'ot Ashri, Haga'ot Maimoniot chapter 9 of forbidden foods, and Ravya). The simple customer in our countries is to wait after eating meat one hour and to eat cheese afterwards, but you have to say the concluding blessing after the meat (HaAruch, Haga'ot Shaarei Dura) because then it's like a new meal and permissible to eat according to the lenient view. But with no blessing, waiting alone does not good. It doesn't matter if you waited before the blessing or afterwards (his own reasoning, from the Mahari, as opposed to the Issur v'Heter). If he finds meat between his teeth after the hour, he has to pull it out (his own reasoning, from the Ran above). And there are those that say not to say the concluding blessing in order to eat cheese (Aruch in the name of Maharach) but we're not careful about this. And some are careful to wait six hours after eating meat before eating cheese, and it's proper to do so.
(ד) ירך שנתבשל בה גיד הנשה, אם יש בה בנותן טעם, הרי זו אסורה. כיצד משערין אותה, כבשר בלפת.
(ה) גיד הנשה שנתבשל עם הגידים, בזמן שמכירו בנותן טעם,
ואם לאו כלן אסורים.
והרטב בנותן טעם.
וכן חתיכה של נבלה וכן חתיכה של דג טמא שנתבשלו עם החתיכות, בזמן שמכירן בנותן טעם, ואם לאו כלן אסורות.

(4) A thigh in which the sciatic nerve was cooked, if it has [enough] to give flavor [to the thigh], this [thigh] is forbidden. How do we measure it? Like meat [cooked] with a turnip.
(5) A sciatic nerve that was cooked with other nerves, at a time when one [still] recognizes it, [the standard for forbidding] is when it gives flavor. If [it is] not [recognized], all of it is forbidden. And [in] broth, when it gives flavor. And so too with a piece of a nevelah [an improperly slaughtered animal of a permitted species], and so too with a piece of prohibited fish which was cooked with [other] pieces: at a time when one recognized them, [the standard] is when it gives flavor; and if [it is] not [recognized], they are all forbidden. And for the broth [the standard] is when it gives flavor.
(ה) כָּל קְדֵרָה שֶׁאֵינָה בַּת יוֹמָא חֲשִׁיבָה טַעֲמָהּ לִפְגָם, וְאֵינָהּ אוֹסֶרֶת. וְנִקְרֵאת בַּת יוֹמָא כָּל זְמַן שֶׁלֹּא שָׁהֲתָה מֵעֵת לְעֵת אַחַר שֶׁנִּתְבַּשֵׁל בָּהּ הָאִסוּר, וְכֵיוָן שֶׁעָבַר עָלֶיהָ מֵעֵת לְעֵת אַחַר שֶׁנִּתְבַּשֵׁל בָּהּ הָאִסוּר אֵינָה נִקְרֵאת בַּת יוֹמָא. וְאִם בִּשֵּׁל בָּהּ כְּשֶׁאֵינָהּ בַּת יוֹמָא, הַתַּבְשִׁיל מֻתָּר דְּהָוֵי נוֹתֵן טַעַם לִפְגָם. וְהוּא שֶׁתִּהְיֶה מוּדַחַת שֶׁלֹּא יְהֵא שֻׁמָּן עַל פָּנֶיהָ, שֶׁאִם לֹא הֵדִיחָהּ, אוֹסֵר, וַהֲרֵי הִיא כַּחֲתִיכַת אִסוּר שֶׁלֹּא נִפְגְּמָה. וְיֵשׁ מַתִּירִין אֲפִלּוּ בִּשֵּׁל בָּהּ קֹדֶם שֶׁהֵדִיחָהּ. הַגָּה: וְאִם יֵשׁ ס' נֶגֶד מַה שֶּׁדָּבוּק עָלָיו, לְכֻלֵּי עָלְמָא שָׁרֵי מֵאַחַר דְּהַקְּדֵרָה אֵינָהּ בַּת יוֹמָא. וְהָכֵי נָהוּג (או''ה).
(5) Any cooking pot that has not been used within the day is considered to have a rancid taste and cannot render anything forbidden. And it is considered to have not been used for a day if 24 hours have passed since the forbidden substance was cooked. And once 24 hours pass from the time that the forbidden substance was cooked in the pot, it is no longer considered to have been used within a day. And if one cooks in that pot when it has not been used within the day the resulting food is permissible since the part imparted a rancid taste. And this is assuming that the pot was cleaned and there was no grease on its surface. For if it was not cleaned then it is forbidden for it is no different than a piece of forbidden food which is not rancid. And some permit even if the pot was cooked in before it was washed. REMA: And if there are 60 times the volume of whatever is stuck to the surface of the pot then all agree that it is permissible since the pot itself has not been used within 24 hours and this is how we practice.
