(י) כִּֽי־תֵצֵ֥א לַמִּלְחָמָ֖ה עַל־אֹיְבֶ֑יךָ וּנְתָנ֞וֹ יקוק אֱלֹהֶ֛יךָ בְּיָדֶ֖ךָ וְשָׁבִ֥יתָ שִׁבְיֽוֹ׃ (יא) וְרָאִיתָ֙ בַּשִּׁבְיָ֔ה אֵ֖שֶׁת יְפַת־תֹּ֑אַר וְחָשַׁקְתָּ֣ בָ֔הּ וְלָקַחְתָּ֥ לְךָ֖ לְאִשָּֽׁה׃ (יב) וַהֲבֵאתָ֖הּ אֶל־תּ֣וֹךְ בֵּיתֶ֑ךָ וְגִלְּחָה֙ אֶת־רֹאשָׁ֔הּ וְעָשְׂתָ֖ה אֶת־צִפָּרְנֶֽיהָ׃ (יג) וְהֵסִ֩ירָה֩ אֶת־שִׂמְלַ֨ת שִׁבְיָ֜הּ מֵעָלֶ֗יהָ וְיָֽשְׁבָה֙ בְּבֵיתֶ֔ךָ וּבָֽכְתָ֛ה אֶת־אָבִ֥יהָ וְאֶת־אִמָּ֖הּ יֶ֣רַח יָמִ֑ים וְאַ֨חַר כֵּ֜ן תָּב֤וֹא אֵלֶ֙יהָ֙ וּבְעַלְתָּ֔הּ וְהָיְתָ֥ה לְךָ֖ לְאִשָּֽׁה׃ (יד) וְהָיָ֞ה אִם־לֹ֧א חָפַ֣צְתָּ בָּ֗הּ וְשִׁלַּחְתָּהּ֙ לְנַפְשָׁ֔הּ וּמָכֹ֥ר לֹא־תִמְכְּרֶ֖נָּה בַּכָּ֑סֶף לֹא־תִתְעַמֵּ֣ר בָּ֔הּ תַּ֖חַת אֲשֶׁ֥ר עִנִּיתָֽהּ׃ (ס)

(10) When thou goest forth to battle against thine enemies, and the LORD thy God delivereth them into thy hands, and thou carriest them away captive, (11) and seest among the captives a woman of goodly form, and thou hast a desire unto her, and wouldest take her to thee to wife; (12) then thou shalt bring her home to thy house; and she shall shave her head, and pare her nails; (13) and she shall put the raiment of her captivity from off her, and shall remain in thy house, and bewail her father and her mother a full month; and after that thou mayest go in unto her, and be her husband, and she shall be thy wife. (14) And it shall be, if thou have no delight in her, then thou shalt let her go whither she will; but thou shalt not sell her at all for money, thou shalt not deal with her as a slave, because thou hast humbled her.

(ב) ולקחת לך לאשה. לא דברה תורה אלא כנגד יצר הרע שאם אין הקדוש ברוך הוא מתירה, ישאנה באסור. אבל אם נשאה, סופו להיות שונאה, שנאמר אחריו (פסוק טו) כי תהיין לאיש וגו' וסופו להוליד ממנה בן סורר ומורה, לכך נסמכו פרשיות הללו:

(2) You may take her as your wife: The Torah speaks only in deference to the wicked inclination, for if God would not permit her [to him], he would take her illicitly. However, if he does marry her, he will ultimately come to hate her, as it says afterwards, "If a man has [two wives]" and ultimately he will father from her a wayward rebellious son. This is why these topics are placed one after the other.

Kiddushin 21b

The Torah permits this only as a concession to the evil inclination. [It is analogous to another case:] It is preferable that Israelites should eat the flesh of animals that were on the point of death but nevertheless were ritually slaughtered, than that they eat the flesh of unslaughtered carcasses.

Rambam's Guide of the Perplexed (3:41):

We already know the statement of the Sages that "the Torah permits this only as a concession to the evil inclination." At the same time, this mitzva is included among the lofty attributes that are worthy for the pious to follow. What I shall testify concerning this is that he, although his desire overcame him and he was unable to control himself – he is still obligated to take her to a secluded place, as it is written, "into your home," and it is forbidden for him to take her in the midst of the battlefield, as our Sages explained, and likewise it is forbidden for him to be intimate with her for a second time until her mourning and her sorrow are relieved, and she is not to be prevented from mourning and from appearing unattractive and from crying, as the text teaches, "And she shall cry for her father and her mother…," for mourners find comfort in their weeping and the stimulation of their mourning until their physical strength is exhausted from the suffering of that psychological event – just as a celebrant has enjoyment from different types of entertainment, and therefore THE TORAH HAD MERCY ON HER and permitted her this until her weeping and mourning are over.

David Brooks New York Times "When ISIS Rapists Win" 8/28/15

The ISIS atrocities have descended like distant nightmares upon the numbed conscious of the world. The first beheadings of Americans had the power to shock, but since then there has been a steady barrage of inhumanity: mass executions of Christians and others, throwing gay men from rooftops, the destruction of ancient archaeological treasures, the routine use of poison gas. Even the recent reports in The Times about the Islamic State’s highly structured rape program have produced shock but barely a ripple of action. And yet something bigger is going on. It’s as if some secret wormhole into a different historical epoch has been discovered and the knowledge of centuries is being unlearned. This is happening in the moral sphere. State-sponsored slavery seemed like a thing of the past, but now ISIS is an unapologetic slave state. Yazidi women are carefully cataloged, warehoused and bid upon. The rapes are theocratized. The rapists pray devoutly before and after the act. The religious leader’s handbook governing the rape program has a handy Frequently Asked Questions section for the young rapists: “Question 12: May a man kiss the female slave of another, with the owner’s permission? “A man may not kiss the female slave of another, for kissing [involves] pleasure, and pleasure is prohibited unless [the man] owns [the slave] exclusively. “Question 13: Is it permissible to have intercourse with a female slave who hasn’t reached puberty? “It is permissible to have intercourse with the female slave who hasn’t reached puberty if she is fit for intercourse; however, if she is not fit for intercourse it is enough to enjoy her without intercourse.”
