כי נפש הבשר בדם הוא ואני נתתיו לכם על המזבח משמעות הכתוב הזה שיאמר שיאסר לנו הדם מפני שנתנו לנו להיות על המזבח לכפר על נפשותינו והוא חלק השם כטעם החלב ואם נקשה למה אסר דם החיה והעוף אשר לא יקרב נדחה את השואל שרצה להרחיקנו מכל דם שלא נשגה בו אע"פ שלא עשה כן בחלב כי ניכר הוא והרב כתב במורה הנבוכים (ג מו) כי היו הכשדים מואסים הדם ויחשבוהו להם לטומאה אבל יאכלו ממנו הרוצים להתחבר לשדים ולהנבא מהם העתידות והתורה תכוין לעולם להרוס בניני סכלותם בהפוך מחשבותיהם ולכך אסרה הדם באכילה ובחרה בו להטהר בהזאות ולזרקו על המזבח לכפרה ולכך אמר (פסוק י) ונתתי פני בנפש האוכלת את הדם כמו שאמר בנותן מזרעו למולך (להלן כ ו) שהוא מביא למין ממיני ע"ז כי לא נאמר כן במצוה אחרת ואלו דברים מיושבים אבל הכתובים לא יורו כן שהם יאמרו תמיד בטעם האסור כי נפש כל בשר דמו בנפשו (פסוק יד) כי נפש הבשר בדם הוא (פסוק יא) והחזיר במשנה תורה (דברים יב כג) רק חזק לבלתי אכול הדם כי הדם הוא הנפש ולא תאכל הנפש עם הבשר והראוי שנפרש בטעם איסורו כי השם ברא כל הנבראים התחתונים לצורך האדם כי הוא לבדו בהם מכיר את בוראו ואף ע"פ כן לא התיר להם באכילה מתחילה רק הצומח לא בעלי הנפש כאשר בא בפרשת בראשית שנאמר (בראשית א כט) הנה נתתי לכם את כל עשב זורע זרע וגו' וכאשר היה במבול שנצולו בזכותו של נח והקריב מהם קרבן והיה לרצון לו התיר להם השחיטה כמו שאמר (שם ט ג) כל רמש אשר הוא חי לכם יהיה לאכלה כירק עשב נתתי לכם את כל כי חיותם בעבור האדם והנה התיר גופם אשר הוא חי בעבור האדם שיהיה להנאתו ולצרכו של אדם ושתהיה הנפש שבהם לכפרה לאדם בקרבים לפניו יתברך לא שיאכלוהו כי אין ראוי לבעל נפש שיאכל נפש כי הנפשות כולן לאל הנה כנפש האדם וכנפש הבהמה לו הנה ומקרה אחד להם כמות זה כן מות זה ורוח אחד לכל (קהלת ג יט) ועל הדרך שיראוהו חוקרי היונים מן השכל הפועל התנוצץ זיו וזוהר צח מאד ובהיר וממנו יצא נצוץ נפש הבהמה והנה היא נפש גמורה בצד מן הפנים ולכך יש בה דעת לברוח מן הנזק וללכת אחרי הנאות לה והיכר ברגילים ואהבה להם כאהבת הכלבים לבעליהן והיכר מופלא באנשי בית בעליהם וכן ליונים דעת והכרה מן הידוע עוד כי הנאכל ישוב בגוף האוכל והיו לבשר אחד ואם יאכל אדם נפש כל בשר והוא יתחבר בדמו והיו לאחדים בלב תהיה עובי וגסות בנפש האדם ותשוב קרוב לטבע הנפש הבהמית אשר בנאכל כי הדם לא יצטרך עכול כשאר הנאכלים שישתנו בעכולם ויתלה בו נפש האדם בדם בהמה והכתוב אומר (שם שם כא) מי יודע רוח בני האדם העולה היא למעלה ורוח הבהמה היורדת היא למטה לארץ ולכך אמר (פסוק יד) כי נפש כל בשר דמו בנפשו הוא כי לכל בשר באדם ובבהמה נפש בדם ואין ראוי לערב הנפש הנכרתת בנפש הקיימת אבל תהיה לה כפרה על המזבח לרצון לפני ה' וזה טעם על כן אמרתי לבני ישראל בעבור שהדם הוא הנפש ואין ראוי שתאכל הנפש את הנפש ואני חמלתי על נפש האדם ונתתיו להם על המזבח שתהיה נפש הבהמה מכפרת על נפשו ושנו בספרי (ראה עו) רק חזק לבלתי אכול הדם (דברים יב כג) רבי יהודה אומר מגיד שהיו שטופים בדם וכו' כי הדם הוא הנפש (שם) להגיד מה גרם ולא תאכל הנפש עם הבשר (שם) זה אבר מן החי זה רמז וראיה למה שפירשנו ולכך צוה עוד (בפסוק יג) לכסות כל דם בחיה ובעוף כי לא יתקרב דמם על המזבח כי גם בעופות לא יקרב מהם רק שני מינין בלבד וגם הם אינם נשחטים אבל בבהמות רוב המצויים נשחטים לשם הנכבד ודמם לכפר ואין ראוי לכסותו ולא חשש לכסות דם החולין בבהמה כי אין חולין במדבר וגם אחרי כן על הרוב יצוה

וַיְדַבֵּר ה' אֶל מֹשֶׁה לֵאמֹר, זֹאת הַחַיָּה אֲשֶׁר תֹּאכְלוּ. יְלַמְּדֵנוּ רַבֵּנוּ, כַּמָּה בְּהֵמוֹת טְהוֹרוֹת יֵשׁ בָּעוֹלָם. כָּךְ שָׁנוּ רַבּוֹתֵינוּ, עֶשֶׂר בְּהֵמוֹת הֵן, אַיָּל וּצְבִי וְיַחְמוּר וְאַקּוֹ וְדִישׁוֹן וּתְאוֹ וָזָמֶר (דברים יד, ה), שׁוֹר שֵׂה כְשָׂבִים וְשֵׂה עִזִּים (דברים יד, ד). יוֹתֵר מֵאֵלֶּה אֵין בָּעוֹלָם. אָמַר הַקָּדוֹשׁ בָּרוּךְ הוּא לְיִשְׂרָאֵל, הִזָּהֲרוּ עַצְמְכֶם שֶׁלֹּא לְשַׁקֵּץ אֶת עַצְמְכֶם בִּבְהֵמָה טְמֵאָה וּבְשֶׁרֶץ טָמֵא. כָּךְ אָמַר דָּוִד, הָאֵל תָּמִים דַּרְכּוֹ אִמְרַת ה' צְרוּפָה (תהלים יח, לא), בִּשְׁבִיל לְצָרֵף בְּרִיּוֹתָיו. אָמַר לוֹ: רַבִּי, מָה אִכְפַּת לוֹ לְהַקָּדוֹשׁ בָּרוּךְ הוּא שֶׁיֹּאכְלוּ יִשְׂרָאֵל בְּלֹא שְׁחִיטָה, שֶׁיְּהֵא יִשְׂרָאֵל נוֹחֵר וְאוֹכֵל וְשׁוֹחֵט מִן הַצַּוָּאר מִן הַיֶּרֶךְ. תֵּדַע, שֶׁלֹּא נִצְטַוָּה הַשְּׁחִיטָה הַזּוֹ אֶלָּא כְּדֵי לְצָרֵף אֶת יִשְׂרָאֵל, כִּי לֶעָתִיד לָבֹא עוֹשֶׂה סְעוּדָה לַצַּדִּיקִים מִן הַבְּהֵמָה וְלִוְיָתָן וְאֵין שָׁם שְׁחִיטָה. תֵּדַע לְךָ, לִוְיָתָן בְּרִיָּה מְשֻׁנָּה הוּא, וְהַמַּלְאָכִים יָגוּרוּ מִמֶּנּוּ, שֶׁנֶּאֱמַר: מִשֵּׂתוֹ יָגוּרוּ אֵלִים (איוב מא, יז). וְאִם הֵם זוֹרְקִין עָלָיו כַּמָּה רְמָחִים שֶׁל בַּרְזֶל, כְּתֶבֶן הוּא חוֹשְׁבָן, שֶׁנֶּאֱמַר: יַחְשֹׁב לְתֶבֶן בַּרְזֶל (איוב מא, יט). וְכֵן בְּהֵמוֹת שָׂדַי קָשֶׁה, שֶׁהוּא רוֹבֵץ עַל אֶלֶף הָרִים, שֶׁנֶּאֱמַר: בְּהֵמוֹת בְּהַרְרֵי אֶלֶף (תהלים נ, י). וְהֵיכָן הֵן נִשְׁחָטִין. אֶלָּא זֶה לָזֶה מִזְדַּוְגִין שְׁנֵיהֶם, שֶׁנֶּאֱמַר: אֶחָד בָּאֶחָד יִגָּשׁוּ (איוב מא, ח). בְּהֵמוֹת יִגַּשׁ בַּלִּוְיָתָן וְאוֹחֵז בְּקַרְנָיו וּבוֹקֵעַ. וְלִוְיָתָן הֵפֶךְ יִהְיֶה מִיתָתוֹ, שֶׁמַּכֶּה אוֹתוֹ בִּזְנָבוֹ וְהוֹרְגוֹ, וְהַצַּדִּיקִים הוֹלְכִין וְנוֹטְלִין מָנוֹת מָנוֹת. מִכָּאן שְׁחִיטָה. אֶלָּא בִּשְׁבִיל לִבְדֹּק וּלְצָרֵף אֶת יִשְׂרָאֵל.
ו ע"י מעשה באו מאי היא דההוא עגלא דהוו קא ממטו ליה לשחיטה אזל תליא לרישיה בכנפיה דרבי וקא בכי אמר ליה זיל לכך נוצרת אמרי הואיל ולא קא מרחם ליתו עליה יסורין
‘They came to him through a certain incident.’ What is it? — A calf was being taken to the slaughter, when it broke away, hid his head under Rebbi's skirts, and lowed [in terror]. ‘Go’, said he, ‘for this wast thou created.’ Thereupon they said [in Heaven], ‘Since he has no pity, let us bring suffering upon him.’
One who was born under the influence of the sun will be a radiant person; he will eat from his own resources and drink from his own resources, and his secrets will be exposed. If he steals he will not succeed, because he will be like the sun that shines and is revealed to all.
One who was born under the influence of Venus will be a rich and promiscuous person. What is the reason for this? Because fire was born during the hour of Venus, he will be subject the fire of the evil inclination, which burns perpetually.
One who was born under the influence of Mercury will be an enlightened and expert man, because Mercury is the sun’s scribe, as it is closest to the sun.
One who was born under the influence of the moon will be a man who suffers pains, who builds and destroys, and destroys and builds. He will be a man who eats not from his own resources and drinks not from his own resources, and whose secrets are hidden. If he steals he will succeed, as he is like the moon that constantly changes form, whose light is not its own, and who is at times exposed and at times hidden.

One who was born under the influence of Jupiter [tzedek] will be a just person [tzadkan]. Rav Naḥman bar Yitzḥak said: And just in this context means just in the performance of mitzvot.
One who was born under the influence of Mars will be one who spills blood. Rav Ashi said: He will be either a blood letter, or a thief, or a slaughterer of animals, or a circumciser. Rabba said: I was born under the influence of Mars and I do not perform any of those activities. Abaye said: My Master also punishes and kills as a judge.

(א) לרחם על כל הנבראים: עוֹד צָרִיךְ לִהְיוֹת רַחֲמָיו פְּרוּשִׂים עַל כָּל הַנִּבְרָאִים, לֹא יְבַזֵּם וְלֹא יְאַבְּדֵם. שֶׁהֲרֵי הַחָכְמָה הָעֶלְיוֹנָה הִיא פְרוּשָׂה עַל כָּל הַנִּבְרָאִים דּוֹמֵם וְצוֹמֵחַ וְחַי וּמְדַבֵּר. וּמִטַּעַם זֶה הֻזְהַרְנוּ מִבִּזּוּי אוֹכְלִים. וְעַל דָּבָר זֶה רָאוּי, שֶׁכְּמוֹ שֶׁהַחָכְמָה הָעֶלְיוֹנָה אֵינָהּ מְבַזָּה שׁוּם נִמְצָא וְהַכֹּל נַעֲשָׂה מִשָּׁם כְּדִכְתִיב "כֻּלָּם בְּחָכְמָה עָשִׂיתָ" , כֵּן יִהְיֶה רַחֲמֵי הָאָדָם עַל כָּל מַעֲשָׂיו יִתְבָּרַךְ. וּמִטַּעַם זֶה הָיָה עֹנֶשׁ רַבֵּינוּ הַקָּדוֹשׁ עַל יְדֵי שֶׁלֹּא חָס עַל בֶּן הַבָּקָר שֶׁהָיָה מִתְחַבֵּא אֶצְלוֹ וְאָמַר לוֹ "זִיל לְכָךְ נוֹצַרְתָּ" (בָּבָא מְצִיעָא פה.) בָּאוּ לוֹ יִסּוּרִין, שֶׁהֵם מִצַּד הַדִּין שֶׁהֲרֵי הָרַחֲמִים מְגִנִּים עַל הַדִּין, וְכַאֲשֶׁר רִחֵם עַל הַחֻלְדָּה וְאָמַר "רַחֲמָיו עַל כָּל מַעֲשָׂיו" כְּתִיב, נִצּוֹל מִן הַדִּין מִפְּנֵי שֶׁפֵּרַשׂ אוֹר הַחָכְמָה עָלָיו וְנִסְתַּלְּקוּ הַיִּסּוּרִים. וְעַל דֶּרֶךְ זֶה לֹא יְבַזֶּה בְּשׁוּם נִמְצָא מִן הַנִּמְצָאִים שֶׁכֻּלָּם בְּחָכְמָה וְלֹא יַעֲקֹר הַצּוֹמֵחַ אֶלָּא לְצֹרֶךְ, וְלֹא יָמִית הַבַּעַל חַי אֶלָּא לְצוּרֵךְ, וְיִבְרֹר לָהֶם מִיתָה יָפָה בְּסַכִּין בְּדוּקָה לְרַחֵם כָּל מַה שֶׁאֶפְשָׁר.
(ב) זֶה הַכְּלָל: הַחֶמְלָה עַל כָּל הַנִּמְצָאִים שֶׁלֹּא לְחַבְּלָם תְּלוּיָה בַּחָכְמָה, זוּלָתִי לְהַעֲלוֹתָם מִמַּעֲלָה אֶל מַעֲלָה, מִצּוֹמֵחַ לְחַי, מֵחַי לִמְדַבֵּר שֶׁאָז מֻתָּר לַעֲקֹר הַצּוֹמֵחַ וּלְהָמִית הַחַי - לָחוּב עַל מְנָת לְזַכּוֹת:
(1) To have mercy upon all of the creatures: He must also have his mercy extend to all the creatures. He [should] not disgrace them nor destroy them. As behold, the Highest Wisdom is spread over all the creatures - the inanimate, the growing (plants), the living (animals) and the speaking (people). And we are warned about disgracing food for this reason. And about this thing it is fitting that [just] like the Highest Wisdom does not disgrace anything in existence and everything was made from There, as it is written, "You made all of them with wisdom" - so [too, should] the mercy of a person be over all of His creations, may He be blessed. And for this reason was the holy Rebbe punished: Since he did not pity the young calf that was hiding with him and said to it, "Go, you were created for this," afflictions came upon him (Bava Metzia 85a). As they were from the side of judgement; since behold, mercy protects from judgement. And when he had mercy on a weasel and said, "It is written (Psalms 145:9), 'and His mercies are over all of His creatures,'" he was saved from the judgement - since the light of Wisdom was spread over him and the afflictions withdrew. And upon this way, he [should] not disgrace anything in existence from that which exists, as all of them are with Wisdom. And [so] he [should] not uproot a plant except for a need nor kill an animal except for a need. And [then] he [should] chose a nice death, with a checked knife, to have mercy in as much as is possible.
(2) This is the general rule: Compassion upon all things in existence - not to injure them - is [rooted] in Wisdom. [This is] unless it is to raise them from [one] level to [another] level - from growing to living; from living to speaking. As then it is permitted to uproot a [plant] and kill an [animal] - to disadvantage [it] in order to benefit [it].
(א) וראוי שנבאר הטעם אל השנוי הזה שמצאנו שמה שנאסר לאדם הותר לנח ושמה שהותר לנח נאסר קצתו לישראל. וכדי שיתבאר זה באור יפה נשאל מה חטא קין בהביאו מפרי האדמה מנחה לה׳ שלא שעה השם אליו ואל מנחתו, ואם מפני שלא הביא מבחר הצאן ואילי נביות כמו שהביא הבל, מה חטא בזה אם נתעסק בעבודת האדמה והצליח בה והביא מפריה מנחה לשם להודות לפניו כעל כל אשר גמלהו ה׳, למה לא שעה השם אליו ואל מנחתו, כי הדעת נותן שכל מקבל טובה מאחר בשהאכילהו והשקהו שישלם לו תודות מעין הטובה שקבל ממנו, ולא יחויב להודות לפניו שהלבישו והעשירו ושעשה עמו מה שלא עשה, אבל ראוי שתהיה ההודאה מעין קבול הטובה, ואם לא תהיה ההודאה יותר אין עליו בזה תפיסה ולא עון אשר חטא.
(ב) ואם על שלא הביא מפרי העץ אלא מפרי האדמה כמו שכתבנו למעלה, לא היה ראוי לעונש גדול שנכתב עליו הלוא אם תיטיב שאת ואם לא תיטיב לפתח חטאת רובץ וגו׳. וכן יש לשאול אחר ששעה השם אל הבל ואל מנחתו למה נהרג, ואיך לא חנה מלאך ה׳ סביב ליראיו להציל ממות נפשו, וכן למה נאמר בשת ויולד בדמותו כצלמו, ולא נאמר כן בהבל ששעה השם אל מנחתו.
(ג) ובאור כל זה לפי מה שאחשוב הוא על זה הדרך, כי מלבד מה שיש בהריגת הבעלי חיים אכזריות חמה ושטף אף ולמוד תכונה רעה אל האדם לשפוך דם חנם, עוד יוליד אכילת בשר קצת הבעלי חיים עובי ועכירות ואטימות בנפש, כמו שבאר הכתוב זה כשאסר לישראל קצת בעלי חיים, אמר בסוף ולא תשקצו את נפשותיכם וגו׳, ולא תטמאו בהם ונטמתם בם חסר אל״ף להורות על שהם מולידים עובי ואטימות בלב, וכן אמרו רבותינו ז״ל על זה הפסוק, עבירה מטמטמת נפשו של אדם, שנאמר ונטמתם בם אל תקרי ונטמאתם אלא ונטמתם, ובעבור זה אף על פי שבשר קצת הבעלי חיים מזון טוב ונאות אל האדם, רצה השם להסיר ממנו הטוב המועט הזה שיש באכילת הבשר בעבור הרע וההזק המרובה שאפשר שימשך מזה אליו, ולזה אסר אכילת הבעלי חיים לאדם, ותיקן מה שחסר בזה ממזונות נאותים בשיחד אל האדם בצמחים מזונות נאותים טובים, כחטה והשעורה וכל דבר שיש בו זרע שראוי להזרע וכל העץ אשר בו פרי עץ זורע זרע, ולשאר הבעלי חיים נתן להם לאכילה כל ירק עשב שאין בו זרע שראוי להזרע, וזה להעיר על היתרון שיש בין מין האדם לזולתו מבעלי חיים.
(ד) וכשנולדו קין והבל וראו את אדם אביהם טורח בעבודת האדמה וזורע חטה ושעורה וחרצן ואוכל ונזון מן הצמחים, חשב כל אחד מהם דרך לעצמו, וכונת כל אחד מהם היתה נכרת מתוך מעשיו. כי קין לקח לו אומנות לעבוד את האדמה, לפי שהיה חושב שאין יתרון לאדם על הבעלי חיים אלא בזה בהיותו יודע לעבוד את האדמה להיותו נזון ממבחר הצמחים, כי אחר שראה האדם נזון מן הצמחים כשאר הבעלי חיים, חשב שרוח אחד לכל וכמות זה כן מות זה, ולזה הביא מנחה מפרי האדמה לשבח השם על היתרון שנתן לו על הצמחים, ולא הביא קרבן מן הבעלי חיים, כי לא חשב היתרון שיש לו עליהם בעבודת האדמה יתרון גדול שראוי להביא קרבן עליו, אלא שלפי שהיה לו להביא מפרי העץ שהוא מבחר הצמחים ולא הביא אלא מפרי האדמה, כלומר מן הירקות, חטא כמו שאמרנו למעלה, אבל עיקר החטא היה לפי שלא חשב היתרון שיש לאדם על הבעלי חיים לכלום, וחשב גם כן היותו אסור בהריגת הבעלי חיים אחר היותו שוה אליהם לפי דעתו כי כמות זה כן מות זה, וחשב שעיקר תכליתו היה לאכול ולשתות אחר היותו נזון מן הצמחים כבעלי חיים.
(ה) והבל היה חושב שיש לאדם יתרון על הבעלי חיים, ואבל חשב שהיתרון הזה הוא שיהיה לו ממשלה עליהם ויכבוש אותם תחתיו לעשות מלאכתו, אבל לא שיהיה מותר בהריגתן, כי לא חשב שיהיה לאדם יתרון על הבעלי חיים בזה, ולזה אמר הכתוב והבל הביא גם הוא מבכורות, כלומר גם הוא על כונת קין, והיה חושב שיהיה האדם אסור בהריגת הבעלי חיים אם לא לצורך גבוה ולעשות קרבן מהן לפניו, להורות שהוא יתברך הוא שיש לו יתרון על האדם והבהמה כי כולם יאבדו והוא יעמוד, אבל האדם אין לו יתרון עליהם כי אם בהיותו רועה אותם ומנהיג המדינות וכיוצא בזה, ולזה נהרג הבל להיות זה הדעת קרוב מאד מדעת קין ויותר מוכן לטעות בו האנשים ולהמשך אחריו.
(ו) אבל לפי שדעת הבל היה שיש לאדם יתרון על הבעלי חיים וממשלה עליהם ויכול להרוג אותן לצורך גבוה, והוא קרוב אל שיוכר על ידו יתרון האדם על הבעלי חיים, והכיר מעלת האדון להביא מבכורות צאנו ומחלביהן, שעה השם אל הבל ואל מנחתו להיותו קרוב אל השלמות מדעת קין, ולא שעה אל קין ולמנחתו להיותו רחוק מאד מהאמת, אחר שחשב שאין לאדם יתרון על הבעלי חיים וגם שלא הכיר מעלת האדון אחר שהביא מפרי האדמה ולא מפרי העץ כמו שאמרנו. ואמר לו השם יתברך למה חרה לך ולמה נפלו פניך הלוא אם תיטיב שאת, כלומר אמת הוא כדברך כי עיר פרא אדם יולד, ואין לו יתרון והתנשאות על הבעלי חיים בפעל בעת צאתו לאויר העולם, אבל יש לו עליהם יתרון בכח להטיב במעשיו ולהוציא מה שבכחו אל הפעל ולהכיר מעלת האדון, ואם ייטיב מעשיו יהיה לו התנשאות עליהם, וזהו הלוא אם תיטיב שאת. ובעבור זה נכנסה קנאה בלב קין והרג את הבל, בהיותו נמשך אחר כונתו הראשונה שאין לאדם יתרון על הבעלי חיים, ואמר בלבו כי אחר שהשם יתברך שעה אל הבל ואל מנחתו, נראה שהוא מותר להרוג את הבעלי חיים וחשב שאין בהריגת הבל איסור יותר מבהריגת אחד מבעלי חיים, ולפי שעדיין לא היתה כונת הבל ראויה מכל וכל לא הושגה להנצל מכף מעול וחומץ.
(ז) וכשנגלה השם יתברך על קין ויעד לו העונש על כך, לא חשב בעבור זה שתהיה שפיכת דם האדם חמורה משפיכת דם שאר הבעלי חיים, אבל היה חושב כי כמו שהיה נענש על שפיכת דם האדם כן יהיה נענש על הבעלי חיים, אחר שלא הותר לאדם להרגם, כי רוח האדם ורוח הבהמה שוה כמות זה כן מות זה, ונשאר זה הדעת הנפסד בקין ובתולדותיו עד שנולד שת, שהכיר היתרון שיש לאדם על הבעלי חיים כמו שהכיר זה אדם אביו, ולזה נאמר עליו ויולד בדמותו כצלמו, כי זה לבדו היה בצלם אלהים כאדם, אבל הראשונים לא הכירו מעלת הצורה האנושית אשר בהם שהיא בצלם אלהים.
(ח) ועל אלו השלש דעות מקין והבל ושת תמצא כל האנשים נחלקים לשלש כתות. כת תמשך לסברת קין ותחשוב עבודת האדמה עקר, ותקנא במנהיגי המדינות ותחשוב להרוג אותם, כמו שהרג קין את הבל. וכת תמשך לסברת הבל ותחשוב הנהגות המדינות עקר, ויסכנו נפשם על זה כמו הבל ויחשבו זה עיקר שלמות האדם, כמו שסופר זה על קצת מנהיגי רומי, וכן יסכנו המלכים עצמם בסבת השררה וכאלו זה טבעי להם אחר הבל שהיה הרועה והמנהיג הראשון ונהרג. וכת תמשך לסברת שת ותחשוב עבודת השם יתברך עיקר ותמאס השררה ושאר ההצלחות. ולפי שהיה דעת שת בלתי מושג בתחלת הדעת לא היו נמשכים אחריו רק יחידי סגולות, אבל דעת קין היה מתפשט מאד בתולדותיו, ובעבור זה מלאה הארץ חמס מפניהם, כי לא היו חושבים שהיה לאדם יתרון על הבעלי חיים אלא כל דאלים גבר, ולזה היו משחיתים דרכם כבעלי חיים, ובעבור זה נגזרה גזרה למחות שמם מן הארץ בימי המבול.
(ט) וכאשר נמחו כלם ונשאר אך נח ואשר אתו בתבה, רצה השם יתברך לשרש זה הדעת ולעקור אותו מן העולם, וכשיצא נח מן התיבה הקריב קרבן לה׳ מן הבעלי חיים, מדעתו כי האדם יש לו יתרון כח שכלי להכיר ולעבוד בוראו יותר מהם ולהודות לשם על זה, על כן נתקבל קרבנו ברצון, כמו שכתוב וירח ה׳ את ריח הניחוח. ולפי שחשש שזה הדעת אם לא יתוקן אפשר שיטו לדעת הבל, ויחשבו בני נח שמה שקבל השם יתברך קרבן אביהם היה כמו שקבל קרבן הבל ויחזרו לקלקולם הראשון, על כן אחר הקרבן מיד מיהר להתיר להם אכילת הבעלי חיים והריגתם, ואמר להם כירק עשב נתתי לכם את כל, כלומר כמו שאפילו קין הודה שיש לאדם יתרון על הצמחים להיותם נבראים לצורך האדם, כן כל בעלי חיים הם לצורך האדם ויש לאדם יתרון עליהם שאין רוח אחד לכל, ועל כן אסר שפיכת דם האדם, ונתן הטעם בזה לפי שאין רוחו כרוח הבעלי חיים, כי בצלם אלהים עשה את האדם, כלומר שיש בו צורה שכלית יותר נכבדת מרוח הבעלי חיים, והיה ראוי לפי זה שיתיר להם כל הבעלי חיים ולא ישים לאחד מהם יתרון על האחר, ולזה התירם כולם כדי לעקור הדעת הקודם ולמחות זכרו מן העולם.
(י) וכשנתנה תורה לישראל שכבר נמחה זה הדעת מן העולם, אסר להם קצת הבעלי חיים המולידים עובי ועכירות בנפש, ואפילו מה שהתיר מהם לא דברה תורה אלא כנגד יצר הרע, כמו שהתיר להם יפת תואר על זה הדרך, וכן אמרו רבותינו ז״ל כי תאוה נפשך לאכול בשר, למדה תורה דרך ארץ שלא יאכל אדם בשר אלא לתאבון, הנה גלו בפירוש שאכילת הבשר לא הותר אלא על צד ההכרח, ועל כן נאסר בתחלת היצירה עם היותו מזון טוב לסבה שזכרנו בתחלת הפרק, כמו שהיין אף על פי שהוא מזון טוב ומותר לאדם יקרא הכתוב את הנזיר הפורש ממנו קדוש. ונתבאר מכל זה כי כבר אפשר שיהיה הדבר האחד מותר אחר שנאסר ואסור אחר שהותר, ואם כן כבר אפשר שנאמר שיבואו בתורה האלהית דברים ימשך אסורם זמן מה כפי מה שתגזור החכמה האלהית, ואחר כך יתירם כפי מה שתגזור חכמתו יתברך, ואין בכתובים ראיה על הפך זה. ואמנם אי אלו הם הדברים שהוא אפשר שיבא בהם הבטול, עוד יתבאר בזה המאמר בעזרת השם יתברך:
(1) We must now explain the reason for the change that we have found, namely that that which was forbidden to Adam was permitted to Noah, and that a part of that which was permitted to Noah was forbidden to Israel. In order to explain this properly, we must first inquire what was Cain’s sin when he brought an offering to God from the fruit of the ground, as a result of which God refused to have respect unto him or his present. Was it that he did not bring of the best of the sheep and rams of Nebayoth, as Abel did? Surely this is no sin. If his occupation was the tilling of the ground and he prospered therein and brought of its fruit a present to God to thank Him for His benefits, why did the Lord refuse to have respect unto him or his offering? It stands to reason that when a person receives a benefit from another, having been treated with food and drink, he should return thanks to his benefactor corresponding to the kindness which he received. He is not obliged to thank him for having clothed and enriched him if he has done nothing of the sort. But the thanksgiving must correspond to the benefit received. If it is not greater, that is no cause for criticism and surely does not involve guilt.
(2) And if we say that Cain’s sin consisted in the fact that he did not bring of the fruit of the tree but only of the fruit of the ground, as we said before, this did not deserve such severe punishment as is expressed in the verse, “If thou doest well, shall it not be lifted up? and if thou doest not well, sin coucheth at the door …” The question also suggests itself, since God favored Abel as well as his present, how is it that he was killed? Why did not an angel of God protect the God-fearing man and save him from death? Another question is, why is it that we read about Seth, “And begot a son in his own likeness, after his image,” while there is no such expression in reference to Abel, though God favored his present?
(3) The explanation of all this is, I think, as follows: In the killing of animals there is cruelty, rage, and the accustoming oneself to the bad habit of shedding innocent blood, but the eating of the flesh of some animals produces besides, coarseness, ugliness and stupidity, as is stated in the Bible. After prohibiting the food of certain animals to Israel, the text ends up, “Ye shall not make yourselves detestable … neither shall ye make yourselves unclean with them, that ye should be defiled thereby.” The word translated “defiled” (ונטמתם) is written without an aleph, thus indicating that the forbidden food produces mental coarseness and obtuseness. The Rabbis also say, in reference to the verse in question, “Transgression of a law stupefies the person, as is said, ‘that ye should be defiled thereby.’ Read not ‘defiled’ (ונטמאתם), but ‘stupefied’ (ונטמתם).” This is the reason why, though the flesh of certain animals is good food and suitable for man, God chose to deprive him of the slight good of eating the meat, in order to prevent the much greater evil which might result therefrom. This is why he forbade Adam the eating of animal food. He made up for this loss of good food by assigning to Adam vegetable food which was very good and nourishing, like wheat, barley, and the other seed-bearing plants that can be sown, also all those trees which bear fruit having seed in them. To other animals he gave for food all green grass that has no seed that may be planted. The purpose of this was to show the superiority of the human species to the other animals.
(4) When Cain and Abel were born and saw their father Adam laboring in the tillage of the ground and planting wheat and barley and other grains, and nourishing himself by eating the plants, each one of them chose his own way, indicating his purpose and ideas in his practice. Cain took to tilling the ground because he thought that the only superiority of man to the animals consisted in his ability to till the ground and live on the choice plants. Seeing that Adam lived on plants like the animals, he thought that the spirit is the same in all and that all die alike. Therefore he brought an offering of the fruit of the ground, to thank God for the superiority He gave him over plants. He did not bring an animal offering, because he did not think that his superiority to them in the ability to till the ground was important enough to warrant bringing an offering. Part of his sin consisted, as we said before, in the fact that instead of bringing fruit of the tree, which is the best of plant life, he brought of the fruit of the ground, i. e. green vegetables. But his main offence was that he did not think that man’s superiority to the animals amounted to anything. Also he thought that he was forbidden to kill the animals because they were like him and were subject to death like him. He thought too that the main purpose of man is to eat and drink, since he fed on plants like the animals.
(5) Abel, on the other hand, thought that man was superior to the animals, but that the superiority lay in the fact that he has control over them and can subdue them and make them do his work. But he did not think that man was authorized to kill the animals. So far human superiority did not reach, according to his opinion. Hence we read, “And Abel, he also brought of the firstlings of his flock.” The meaning is, he, too, thought like Cain that man is not allowed to kill animals except for God as an offering to show that God is superior to both man and animal, for He remains forever, while they perish. Man is superior only, he thought, in that he pastures them, governs countries, and so on. This is why Abel was killed, because his opinion was close to that of Cain, and more calculated to mislead men.
(6) Nevertheless, Abel held that man has superiority over the animals and controls them, and is allowed to kill them for God—an opinion which is likely to lead to a recognition of the general superiority of man over the animals. Also he recognized the greatness of the Lord and brought of the first-born of his flock and of their fat ones. Hence God had respect unto Abel and his offering, because it was nearer the truth than the opinion of Cain, but He did not have respect unto Cain and his offering, because he was very far from the truth, since he thought man had no superiority over the animals and failed to appreciate the greatness of God in that he brought of the fruit of the ground instead of the fruit of the tree, as we said before. Therefore God said to him, “Why art thou wroth? and why is thy countenance fallen? If thou doest well, shall it not be lifted up?” The meaning is, You are right, man is born a wild ass, and has no superiority over the animal in actuality when he comes into the world, but he has superiority potentially if he practises goodness and realizes his potentialities and recognizes the greatness of the Lord. If he does well, he will be lifted up above the animals. This is the meaning of the expression, “If thou doest well, shall it not be lifted up?” For this reason envy took hold of Cain and he killed Abel. For he still held the opinion that man is not superior to the animal. Therefore he said to himself, Since God favors Abel and his present, it is clear that it is permitted to kill animals, and hence it is just as lawful to kill Abel as any other animal. On the other hand, since Abel’s opinion was not altogether correct, he was not protected by God from violence.
(7) Then when God revealed Himself to Cain and announced his punishment for the crime, Cain did not yet understand that to shed the blood of a human being is a more serious matter than to shed the blood of an animal, but he thought that as he was punished for shedding human blood, so he would be punished for shedding animal blood, since Adam was not permitted to kill animals; for the spirit of man and the spirit of the beast are alike, as the one dies so does the other. This erroneous opinion remained among the descendants of Cain until Seth was born, who knew the superiority of man over the animals, as his father Adam did. Therefore it says in reference to him, “And he [Adam] begot in his own likeness, after his image.” For he alone was in the image of God like Adam, whereas those before him did not understand the dignity of the human form in them, which is in the image of God.
(8) According to these three opinions of Cain, Abel and Seth, respectively, all mankind are divided into three classes. One class follow the opinion of Cain, and think that the most important human occupation is agriculture. They feel hostility toward political rulers and desire to kill them, as Cain killed Abel. A second class follow the opinion of Abel, thinking that politics is the most important pursuit, and risk their life for political activity like Abel, because they think that it leads to human perfection, as we are told concerning certain Roman rulers. So kings risk their lives for the sake of power, which is natural to them as it was to Abel, who was the first shepherd and ruler and lost his life on that account. The third class follow the opinion of Seth, thinking that the important thing is to worship God, and despise power and the other pleasures. As the opinion of Seth is not easily grasped at first sight, he was followed by only a few rare individuals. But the opinion of Cain was widely prevalent among his descendants, and hence the earth was filled with violence on their account, their belief being that man has no superiority over the animal, and might is right. Therefore they were corrupt and lived like animals. For this reason it was decreed that their name should be wiped out from the earth in the flood.
(9) When they were all destroyed and only Noah and those with him in the ark remained, God wanted to eradicate this opinion. Hence when Noah, after leaving the ark, brought an animal offering to God because he knew that man is superior by virtue of his reason and can know his Creator and serve Him better than the animals and can be thankful to God for this privilege, his offering was accepted with favor, as is said, “And the Lord smelled the sweet savour.” But He feared that unless this opinion was made firm, the Noahites might deviate in the direction of Abel’s idea and assume that God accepted their father’s offering as he accepted Abel’s offering, thus going back to the former errors and wrongdoing. Hence immediately after the offering, He hastened to permit the killing of animals and the eating of their flesh, “As the green herb have I given you all.” The meaning is that as even Cain admitted that man is superior to the plants, since they are created for man, so all the animals are also for the sake of man, who is superior to them, and there is not the same spirit in all. For this reason He prohibited the shedding of human blood, giving as a reason that the spirit of man is not like the spirit of the animal, for in the image of God made He man, i. e. man has a rational form which is nobler than the spirit of the animal. For this reason it was necessary to permit all animals without distinction, which He did, in order to eradicate the former opinion and wipe off its memory.
(10) But when the Torah was given to Israel, and the opinion in question had been wiped out, God prohibited certain animals which produce coarseness and ugliness of soul. Nay, even the animals that were permitted were merely a concession to human lust and desire, in the same way as the Israelites were permitted women taken in war. Thus the Rabbis say, commenting on the verse, “because thy soul desireth to eat flesh,” There is a moral lesson in this expression, namely that one should not eat flesh unless he has an appetite for it. This shows clearly that the eating of flesh was permitted only because of necessity. For this reason it was forbidden at the time of creation, though it is good for food, for the reason we mentioned at the beginning of the chapter. The same is true of wine. It is good food and is permitted, and yet the Bible calls the Nazirite, who abstains from it, holy. At any rate all this shows that a given thing may be forbidden and then permitted, and vice versa. We may say, therefore, that there are matters in the divine law which are forbidden for a certain length of time, as God’s wisdom decrees, and later are permitted in accordance with the same divine wisdom. There is no evidence in the Bible to the contrary. As to the kind of things that may be abolished or repealed, this will be explained later on in this Book.
והענין כי התורה הזהירה בעריות ובמאכלים האסורים והתירה הביאה איש באשתו ואכילת הבשר והיין א"כ ימצא בעל התאוה מקום להיות שטוף בזמת אשתו או נשיו הרבות ולהיות בסובאי יין בזוללי בשר למו וידבר כרצונו בכל הנבלות שלא הוזכר איסור זה בתורה והנה יהיה נבל ברשות התורה לפיכך בא הכתוב אחרי שפרט האיסורים שאסר אותם לגמרי וצוה בדבר כללי שנהיה פרושים מן המותרות ימעט במשגל כענין שאמרו (ברכות כב) שלא יהיו תלמידי חכמים מצויין אצל נשותיהן כתרנגולין ולא ישמש אלא כפי הצריך בקיום המצוה ממנו ויקדש עצמו מן היין במיעוטו כמו שקרא הכתוב (במדבר ו ה) הנזיר קדוש ויזכור הרעות הנזכרות ממנו בתורה (בראשית ט כא) בנח ובלוט וכן יפריש עצמו מן הטומאה אע"פ שלא הוזהרנו ממנה בתורה כמו שהזכירו (חגיגה יח) בגדי עם הארץ מדרס לפרושים וכמו שנקרא הנזיר קדוש (במדבר ו ח) בשמרו מטומאת המת גם כן וגם ישמור פיו ולשונו מהתגאל ברבוי האכילה הגסה ומן הדבור הנמאס כענין שהזכיר הכתוב (ישעיהו ט טז) וכל פה דובר נבלה ויקדש עצמו בזה עד שיגיע לפרישות כמה שאמרו על רבי חייא שלא שח שיחה בטלה מימיו באלו ובכיוצא בהן באה המצוה הזאת הכללית אחרי שפרט כל העבירות שהן אסורות לגמרי עד שיכנס בכלל זאת הצוואה הנקיות בידיו וגופו כמו שאמרו (ברכות נג) והתקדשתם אלו מים ראשונים והייתם קדושים אלו מים אחרונים כי קדוש זה שמן ערב כי אע"פ שאלו מצות מדבריהם עיקר הכתוב בכיוצא בזה יזהיר שנהיה נקיים וטהורים ופרושים מהמון בני אדם שהם מלכלכים עצמם במותרות ובכיעורים וזה דרך התורה לפרוט ולכלול בכיוצא בזה כי אחרי אזהרת פרטי הדינין בכל משא ומתן שבין בני אדם לא תגנוב ולא תגזול ולא תונו ושאר האזהרות אמר בכלל ועשית הישר והטוב (דברים ו יח) שיכניס בעשה היושר וההשויה וכל לפנים משורת הדין לרצון חבריו כאשר אפרש (שם) בהגיעי למקומו ברצון הקב"ה וכן בענין השבת אסר המלאכות בלאו והטרחים בעשה כללי שנאמר תשבות ועוד אפרש זה (רמב"ן על ויקרא כ״ג:כ״ד) בע"ה:
